DANIA BEACH CITY COMMISSION
TUESDAY, APRIL 12, 2011 — 7:00 P.M.
1. Call to Order/Roll Call
Mayor Flury called the meeting to order at 7:00 p.m.

2. Invocation and Pledge of Allegiance
Father Roger Holoubek, St. Maurice Catholic Church, gave the invocation followed by the
Pledge of Allegiance to the United States Flag.
3. Presentations and Special Event Approvals
3.1 Special Event request from the American Cancer Society for a Relay for Life
Fundraiser Event to be held Friday/Saturday, April 15-16, 2011 at Frost Park. The
applicant is also requesting a fee waiver.
Kurt Ely, Chairman of the Parks, Recreation and Community Affairs Advisory Board noted they
approved the request.
Commissioner Castro motioned to approve the Special Event and fee waiver request for
the American Cancer Society Relay for Life; seconded by Commissioner Duke. The
motion carried unanimously.
4. Proclamations
4.1 Relay for Life
Mayor Flury presented the Relay for Life proclamation to Myrtle Corbin, Chairman of the Relay
for Life Dania Beach, and other members of the Relay for Life committee.
Myrtle Corbin, 248 SW 13th Street, Chairman of Relay for Life, thanked the City and the
residents for their support.
5. Citizen Comments
Bill Harris, 902 Natures Cove Road, requested an update on the SE 5th Avenue traffic calming
project.
Mayor Flury suggested Mr. Harris contact Assistant City Manager Donnelly for an update.
Linda Sacco, 4481 SW 38th Terrace, and Christine Douglas, introduced themselves as the
president and vice-president of Davis Isles. Ms. Sacco remarked that they are part of Dania
Beach and their association is renewed and improved. Ms. Douglas requested a street sign for
SW 38th Terrace.
Carol Grampa, Grampa's Bakery and Restaurant, 17 SW lst Street, commented on the US 1
Landscape project. She noted that she is embarrassed by the appearance of Federal Highway.
Ms. Grampa said that we need to attract visitors to our City and show them how proud we are to
live and work in Dania Beach.
Jacqueline Hayes, 16 S. Federal Highway, representing Rexall Drugs, spoke in favor of the US 1
Landscape project.
David Campbell, 34 S. Federal Highway, business owner and resident of Dania Beach, said he
supported the US 1 Landscape project.
Steve Davidson, business owner at 57 N. Federal Highway, noted he is in favor of any
improvements on US 1.
Claudia Rimoli, resident and business owner at 38 S. Federal Highway, Canterbury Square, and
Cora Davenport, spoke in favor of the US 1 Landscape project.
6. Public Safety Reports
Charles Raiken, BSO Deputy Fire Chief, noted the transition is over and everything is going
well. He advised that they will be participating in the Dania Beach Relay for Life event.
Donn Peterson, BSO Chief of Police, briefed the Commission on the countywide drug operation
held in March. He introduced Deputy Mike Marotta and recognized him as the Deputy of the
Month for March 2011,for his professionalism and dedication to duty.

Vice-Mayor Grace motioned to adopt the Consent Agenda; seconded by Commissioner
Castro. The motion carried on the following 5-0 Roll Call vote:

8. Bids and Requests for Proposals
There were no proposals on this agenda.
9. Public Hearings and Site Plans
There were no public hearings on this agenda.
10. Discussion and Possible Action
10.1 Commission Summer Vacation
Mayor Flury requested the second meeting in July be cancelled.
City Manager Baldwin concurred this would be the best meeting to cancel.
The Commission concurred to cancel the July 26, 2011 Regular Commission meeting.
10.2 Ethics Ordinance

Dania Beach City Commission
Tuesday,April 12,2011 —7:00 p.m.
Commissioner Castro requested the current County ordinance applicable to them, including the
key elements. She also wants to know what the City has on the books. Commissioner Castro
further asked to see the comparisons by element so the necessary adjustments can be made.
City Attorney Ansbro responded that he will work on it. He confirmed that the City does not
have a policy or ordinance on this issue. City Attorney Ansbro advised that Broward County has
an ordinance that applies to County employees only. The ballot question determined that there
should be an ordinance that applies to all cities. He thinks we can make our provisions more
stringent than the County.
CityAttorney Ansbro noted he will draw u a policy.

Mayor Flury requested that an ordinance for texting during meetings be presented for
consideration at the next Commission meeting.
Commissioner Castro would like to provide input in the ethics ordinance. She thought it was
imperative that we participate in the process.
Commissioner Duke requested Advisory Boards be included in the ordinance.
10.3 US 1 Landscape Project
City Manager Baldwin noted the CRA would like to do all of Federal Highway at the same time.
He provided a memorandum outlining alternative funding for the project, which is attached to
and incorporated into these minutes.
Commissioner Castro assured everyone that there is no intention to scrap the project; however,
we need to determine the funding. She explained the project and the costs involved.
Vice-Mayor Grace concurred with Commissioner Castro.
Commissioner Duke commended staff for working on this issue since the last CRA meeting. He
remarked that residents want to clean up Federal Highway. Commissioner Duke noted that we
would have to work on a water main looping project which would allow us to save some money.
He would like to move forward with the recommendations of Assistant City Manager Donnelly
to use the 36th and 37th Year CDBG grants.
Commissioner Castro asked staff to comment on the timing of the project and how it would
relate to receiving CDBG funds.
Jeremy Earle, CRA Executive Director, noted the original commencement date was set for the
end of April, with a possible completion date of April, 2012. He indicated that depending on the
Commission decision, we could ask the contractor to put the project back on schedule. Director
Earle further commented that we could begin with phase 1, but re-bid phase 2 in order to be able
to use CDBG funds.

Colin Donnelly, Assistant City Manager, noted the additional $400,000.00 would come from
another project that is fully funded for cash.
The Commission concurred on this, and to rebid phase 2.
Commissioner Duke motioned to move forward with both phases of the project, using 36th
and 37th Year CDBG funds as a basis, and recommending that staff take the necessary
steps to satisfy these requirements; seconded by Commissioner Castro. The motion carried
on the following 5-0 Roll Call vote:

10.4 Donation Policy
Mayor Flury noted this issue belongs at budget time and that donations should be budgeted. She
does not think that taxpayer dollars should be donated to charities. Mayor Flury remarked that it
is essential to have a policy and allocate funds during the budget. She added that it is important
to donate to agencies that have matching funds.
Commissioner Duke noted we tried that last year with a budgeted amount. He said that he has a
problem with the County policy because it affects an elected official's ability to raise money for
non-profit organizations. Commissioner Duke indicated this issue can be discussed when we
address the ethics ordinance.
City Manager Baldwin noted the Commission did not like the policy he proposed and reallocated
the money. He recommended the Commission decide the amount they want to allocate during
the budget process and to stick to it.
City Attorney Ansbro noted the bus bench and bus shelter revenues will go away because we
will be using County benches.
Commissioner Castro noted the Commission needs to be out of the process of determining
donations; she would prefer someone else make this decision. She asked the City Manager to
consider this.
Mayor Flury asked if we could re-establish the Human Relations Advisory Board.
The City Manager will develop a policy for the Commission to discuss.
11. Commission Comments
11.1 Commissioner Castro

Commissioner Castro noted she received complaints about the parking meters at the beach. She
also had complaints of trash on the beach in the early morning hours. Commissioner Castro
remarked the beach is one of our best assets and we should keep it clean.
Commissioner Castro would like staff to address the False Alarm Policy.
Commissioner Castro noted that Davis Isles has always been a part of the City. She added they
are a wonderful group of people and we all look forward to working with them.
Commissioner Castro thanked those neighborhoods who have invited her to discuss the Airport
issue. She expressed her appreciation for their input and ideas on this important issue.
Commissioner Castro noted the Library Grand Opening was a great event. She noted we are all
very proud of it and thanked those involved in making it possible.
Commissioner Castro spoke about the new Skate Park at Frost Park. She noted maybe we
should consider charging a non-resident fee which would help maintain the park.
11.2 Commissioner Duke
Commissioner Duke asked everyone to support Relay for Life this weekend.
Commissioner Duke noted our beach is our most treasured asset and he is glad our Marina is
being renovated. He commented that our beach tends to attract working class people.
Commissioner Duke suggested we consider a cohesive master plan to improve and clean-up the
beach.
Commissioner Duke noted that the Library is gorgeous. He said he is excited for our residents
and added that this is truly a catalyst for the progress we are making downtown.
Commissioner Duke spoke about the Frost Park Skate Park. He noted he is pleased to see it is
frequently used by our children and hopefully we will not have to charge for its use.
11.3 Commissioner McElyea
Commissioner McElyea asked for the status of the Pirates Inn property.
City Attorney Ansbro responded the bank is working with the consultant on the asbestos inside
the building which has to be remediated before the demolition.
Commissioner McElyea noted that the street light by Winn Dixie on 3`d Avenue has been out for
over two years.
Commissioner McElyea noted that in the new parking garage the rails in the elevator are loose
by the wall.

11.4 Vice-Mayor Grace
Vice-Mayor Grace noted she attended the grand opening of the Skate Park at Frost Park. She
commented there were about 150 children at the event. Vice-Mayor Grace said that staff was
exceptional and congratulated the Parks and Recreation Department on a great turnout.
Vice-Mayor Grace noted the Concert on the Green series was a lot of fun. She is looking
forward to their return in October.
Vice-Mayor Grace noted she was touched by the Library because she knows the residents have
waited for a long time to have a stand alone Library. She thanked everyone for attending the
grand opening.
11.5 Mayor Flury
Mayor Flury noted the Library opening was wonderful.

13. Administrative Reports
13.1 City Manager
City Manager Baldwin noted the Capital Improvements Program(CIP) workshop will be held on
Wednesday, May 11 at 6:00 p.m. He provided the components of the workshop.
City Manager Baldwin noted that he suggested a non-resident fee for the Skate Park because it is
taking a lot of staff time. He will bring a recommendation with the budget.
13.2 City Attorney
City Attorney Ansbro had no comments.

The total cost for Phases I&II of the Federal Highway Landscaping Project
(Project) is$1,288,851.16, which is inclusive of fees and irrigation. The original
contract with Green Construction Technologies was funded with$450,000 from
the Tree Preservation Fund and$429,156.12 from the City General Fund
Unassigned Fund Balance.
The CRA Board originally chose to do Phase I and II. If the Commission chooses
to do the whole project at one time,both Phases I and II, the project would
require $409,695.04 of additional funding.
The funding deficit could be met by using Community Development Block Grant
(CDBG) funding in the approximate amount of$443,253. This total is comprised
of the 36 Year CDBG (2010-11)funds in the amount$219,000 that has been
applied for Phase II, of the Federal Highway Project. These funds were not
applied to the project because at the time of bid and award, the City had not yet
entered into the required CDBG agreement. To utilize 36 Year CDBG funds
would require re-biding the Phase II of the project. Additionally, the 37 Year
CDGB (2011-12) funds in the amount of$224,253 which were earmarked for
storm water improvements in the SW 33rd Avenue area could be reallocated for
use in this landscaping project.
To utilize 37 Year CDBG funds, the City would replace the storm water project
with a capital project that has already been funded in the capital budget that
meets CDBG criteria. The re-tasked funds would be available for use now for
use on Federal Highway project, and the later, the de-funded capital project
could then be re-funded through a new CDBG application. The 37 Year CDBG
funds are not available for use until Broward County approved their budget in
October 2011 and an agreement is executed.
The capital budget workshop scheduled for May 11, will present the opportunity
to reprioritize the capital plan which may result in additional funds being made
available for the Project.
