Call to Order/Roll Call Mayor Flury called the meeting to order at 7:00 p.m. Present: Mayor: Patricia A. Flury Vice-Mayor: Bobbie Grace Commissioners: Anne Castro Walter Duke C. K. "Mac"McElyea City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Pastor Mario Cinelli, Lighthouse Community Church, gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Fire Department presentation to Patricia Brook Bruce Caruso, Division Chief, BSO Fire Department, read a memorial commemorative plaque that will be presented to Patricia Brook, widow of,former Dania Beach Firefighter, William A. Brook. 3.2 Special Event Request from Marine Industries Associates of South Florida for the 15th Annual Plywood Regatta to be held Saturday, April 30 thru Sunday, May 1, 2011, at the north end of the Dania Beach Marina Vice-Mayor Grace motioned to approve the Special Event request for the 15th Annual Plywood Regatta; seconded by Commissioner Castro. The motion carried unanimously. 3.3 Special Event Request from Neptune Fireworks for a fireworks sale to be held from June 7, 2011 to July 11, 2011 at 768 East Dania Beach Boulevard Commissioner Castro motioned to approve the Special Event request for Neptune Fireworks; seconded by Vice-Mayor Grace. The motion carried unanimously. 3.4 Special Event Request from Harry Stampler of Stampler Auctions to have an auction on Wednesday, June 29, 2011 from 11:00 am - 12:00 pm, at 1914 Tigertail Boulevard Commissioner Castro motioned to approve the Special Event request for Stampler Auctions; seconded by Vice-Mayor Grace. The motion carried unanimously. 3.5 Central Broward Transit Draft EIS Presentation- Jacobs Engineering Jill J. Quigley, representing Jacobs Engineering, provided a PowerPoint overview of the project which was included in the agenda packet. She thanked the Community Development staff for working with them in their outreach efforts and placing this item on tonight's agenda. Ms. Quigley noted the purpose of the study is to provide premium transit from Sawgrass Mills in Sunrise to the Fort Lauderdale-Hollywood International Airport which would allow residents to get to places faster. She explained the alternatives and the type of transportation services proposed. Ms. Quigley indicated that the project would be completed in approximately two years. Commissioner Castro confirmed with Ms. Quigley that the EIS Study would include both the economics and financial components of the project. 4. Proclamations 4.1 Choose Peace— Stop Violence Mayor Flury and Commissioner Duke presented the proclamation to Nancy Vaniman, Project Coordinator, United Way of Broward County. 5. Citizen Comments George Jason, 4549 SW 37th Avenue, provided an update on the Hurricane Preparedness Forum that will be held on June 2, 2011 at 7:00 p.m. in the Commission Chamber at City Hall. Victoria Payne, Executive Director, Chamber of Commerce, 102 W. Dania Beach Boulevard, provided an update of Chamber events. Clare Vickery, 49 N. Federal Highway, Grace Cafe and Galleries, spoke about her support to the After School Programs. She introduced Yanira Collado, the Art teacher contributing to this exhibit. Ms. Collado noted she teaches art at Collins Elementary, through the ASP Program. She added that the students are providing art that is currently on display in the atrium at City Hall. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,April 26,2011 —7:00 p.m. Mayor Flury confirmed the ASP Program is funded by T.I.M.E. For Kids which has helped many children in our community. She explained how the program originated and thanked all those involved for the work they do with our children. Rose Lizana, 214 SE 2nd Street, Dania Beach Press, President of the Kiwanis Club, noted their fundraiser will be held on Saturday, April 30, 2011 at Hollywood Golf and Country Club. 6. Public Safety Reports Commander Michael Grimm, BSO Police Department, provided information on a criminal that was apprehended last week for theft at local marinas. Commander Grimm noted they have moved into former Fire Station #93. He thanked the City for their help in assisting in the move. Discussion followed between the Commission and Commander Grimm regarding the importance of securing cars and homes to prevent burglaries, as well as the situation with homeless people at the new Library. Item #9.2 was heard after Public Safety Reports 9.2 ORDINANCE#2011-012 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, PROVIDING THAT A PORTION OF NW 12 AVENUE BE CO-DESIGNATED AS TAMARA JAMES AVENUE, SUCH PORTION BEING LOCATED BETWEEN NW 3rd STREET AND NW Is' STREET IN THE CITY OF DANIA BEACH, PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (SECOND READING) City Attorney Ansbro read the title of Ordinance #2011-012. Mayor Flury opened the Public Hearing. Charles Murphy noted that Mr. James inspired many young children through the years. He stated that people are impressed by what Tamara James does for the community; not just her basketball career. Mr. Murphy asked the Commission to approve the request. Richard Walker noted that he coached Tamara James in high school. He stated that the neighborhood has come together because of Tamara James. Pastor Anderson, Hollywood, noted that the measure of a great city is the care of their elders and their children. He said that Tamara James represents the City well and she gives back to the community. Vice-Mayor Grace noted this family grew up in Dania Beach. She said that the Tamara James Foundation is alive and well and they do a lot of good things for the community. City Attorney Ansbro read the title of Resolution#2011-036. Commissioner Castro noted that the survey results give a clearer picture of what the residents want. She advised she has shared the information with members of the County Commission as well as some of our state and federal representatives. Commissioner Castro asked City Manager Baldwin to post the results to the City's website. City Attorney Ansbro read the title of Resolution#2011-039. Commissioner Duke applauded the effort to add decorum to Commission meetings; however he thought banning electronic devices is not the answer. He said abiding to the Commission Policy Manual or Roberts Rules of Order should control the decorum of the meetings. Commissioner Duke noted that no one has been disruptive during the meetings. He remarked he is for transparency in meetings. Commissioner Duke said this is a First Amendment issue that the legislature should address. He noted that the City Attorney amended the resolution to include emergencies for business and family, but a ban does not work. Commissioner Duke stated that he does not support the resolution as presented because it is not right and relevant. He would prefer to table it until the ethics issue is discussed. Commissioner Duke said the resolution should say "to each other" or"amongst each other": Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,April 26,2011 —7:00 p.m. Vice-Mayor Grace concurred with Commissioner Duke. She noted we should not ban it because someone is not technical. Vice-Mayor Grace thought it is a good tool for those who use it. Commissioner Castro said she has been indifferent to the issue. She noted that she does not look at her devices during the meetings. Commissioner Castro would like for the webstreaming to be interactive considering these meetings are public. She indicated that the biggest concern is that there are lobbyists contacting Commissioners or special interests urging them to vote in their favor. Commissioner Castro stated that to her it is disrespectful to see someone texting during meetings. Lastly, she noted that she will support this resolution because of all the investigations and special interests currently going on in Broward County. Commissioner McElyea motioned to adopt Resolution #2011-039; seconded by Commissioner Castro. Mayor Flury noted that she considers herself an employee of the taxpayers because they pay her salary. She stated that she should not be texting family or work during a meeting because she is here to serve the public and provide her best judgment. Mayor Flury remarked that it is not appropriate for her to do this while she is at the meeting. She added that she is concerned about someone else making the decisions. The motion carried on the following 3-2 Roll Call vote: Commissioner Castro Yes Vice-Mayor Grace No Commissioner Duke No Mayor Flury Yes Commissioner McElyea Yes 7.6 RESOLUTION#2011-040 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN INTERLOCAL AGREEMENT WITH BROWARD COUNTY, A POLITICAL SUBDIVISION OF THE STATE OF FLORIDA, TO PROVIDE COST SHARE SUPPORT OF A WATER CONSERVATION INCENTIVE PROGRAM TO BE COORDINATED BY BROWARD COUNTY WITHIN THE WATER UTILITY SERVICE AREAS, IN AN AMOUNT NOT TO EXCEED TEN THOUSAND THREE HUNDRED NINETY-.FOUR DOLLARS ($10,394.00)ANNUALLY, PLUS 3%INCREASES IN YEARS 2 THROUGH 5 IN THE MEDIA OUTREACH/ADMINISTRATIVE PORTION OF THE AGREEMENT;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2011-040. Commissioner Castro confirmed this would be a citywide program. She questioned if the information would be available on the website. City Manager Baldwin responded in the affirmative. Commissioner Castro motioned to adopt Resolution #2011-040; seconded by Commissioner McElyea. Bids and Requests for Proposals 8.1 RESOLUTION#2011-037 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO PURCHASE CONSTRUCTION SERVICES FROM STRAIGHTLINE ENGINEERING GROUP, LLC, WITHOUT COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS IN AN AMOUNT NOT TO EXCEED NINETY-NINE THOUSAND SEVEN HUNDRED NINETY-NINE DOLLARS ($99,799.00); PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2011-037. City Manager Baldwin noted this item did not go through the bid process because the Commission indicated that they wanted to move the project forward. Commissioner Duke noted he would like to see what the design of the medians look like before installation. Commissioner Castro questioned the landscaping for the medians. Dominic Orlando, Director of Public Services, noted these are small medians which will have brick pavers. Commissioner Castro noted she is not happy with pavers and added that the medians should have landscaping. Commissioner Duke noted there are plants that require low maintenance. Director Orlando noted they could change the pavers and do landscape in-house. Commissioner Castro addressed the signs. Commissioner McElyea questioned why we did not go out to bid. Director Orlando noted the Commission wanted to expedite this project and the price would go up if we go out to bid because of the engineering costs. Mayor Flury commented that in the future, the Commission will be looking for bids. Commissioner Duke motioned to adopt Resolution #2011-037, subject to Commission and community review; seconded by Commissioner McElyea. Discussion and Possible Action 10.1 Donation Policy City Manager Baldwin noted there are two items presented for Commission consideration, the donation policy and the requests for funding. He indicated that the Commission has not yet appropriated the $28,000.00 funded in this year's budget, except for $5,000.00 for Relay for Life. City Manager Baldwin recommended the same policy submitted to the Commission last year with some modifications. Commissioner Duke noted there is a donation policy in the Commission Policy Manual. He suggested this program should be used. Commissioner Castro noted the Commission shot down all the recommendations made by staff under the donation policy and started making donations again; however, we need to stop doing that. She explained that in the past, the Human Relations Board used to make the recommendations; but there should be another layer other than staff. Commissioner Castro would like the following conditions incorporated into the policy: that the Commission cannot approve anything from the dais, without going through the application process and staff approval. She would also like citizens to help evaluate the process. Commissioner Castro suggested a 75/25 split for the groups that come up later in the year. Commissioner Duke noted the taxpayers want us to help. Mayor Flury is concerned that our money should go to organizations that provide assistance to residents of Dania Beach. She noted she supports the policy prepared by staff. Mayor Flury further indicated that she agrees on having citizen input. She suggested that the Chair of the Parks and Recreation Board be added to the review committee. Commissioner Duke questioned the selection process to create the review committee. He suggested including the chairman of the Marine Advisory Board. Commissioner Castro recommended the following two clauses be included in the policy: adding two citizens (the Chair of the Parks and Recreation Board, and the Chair of the Marine Advisory Board) and three staff members to be the review committee; and that the Commission is prohibited from voting live from the dais. The Commission directed City Manager Baldwin to bring back the amended policy at the next Commission meeting for consideration. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,April 26,2011 —7:00 p.m. 11. Commission Comments 11.1 Commissioner Castro Commissioner Castro noted she will participate in the Jail and Bail Program. Commissioner Castro acknowledged Clare Vickery for all the work she has done for the City during the last five years. Commissioner Castro encouraged parents in the community to support our schools. Commissioner Castro noted she represented the City at "Fleet Week" opening ceremony last week. She recognized the men and women who serve our country. 11.2 Commissioner Duke Commissioner Duke followed up on the texting ban for decorum. He would like to see decorum in the meetings and asked the Mayor to provide it. Commissioner Duke noted there was no backup to the resolution presented, which he requested from the City Attorney. He noted the City Attorney is looking for another job and he supports it. Commissioner Duke noted we need to RFP legal services during the budget because we need good legal services at a reasonable price. 11.3 Commissioner McElyea Commissioner McElyea spoke about the trash along Bryan Road. He further noted he is willing to pile up trash along Old Griffin Road and have it ready for the City to pick up. Commissioner McElyea noted that the street light on 3rd Avenue was finally repaired. However, there are now four light bulbs out on 5 h Avenue. 11.4 Vice-Mayor Grace Vice-Mayor Grace thanked everyone who participated in Relay for Life. Vice-Mayor Grace noted that it was unacceptable the way the kids left our park after the Easter egg hunt. She remarked that she wants all of our parks to look the same. Vice-Mayor Grace further said that she wants the organizers to clean up the parks after their events, if not we give them a fine. 11.5 Mayor Flury Mayor Flury congratulated the Relay for Life teams-. Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,April 26,2011 —7:00 p.m. Mayor Flury noted that when we rent our parks we take a deposit. She indicated that if the parks are not cleaned up after the event, we should keep the deposit. 12. Appointments 12.1 Airport Advisory Board Mayor Flury appointed Chris Johnston and Randy Wright. 12.2 Green Advisory Board Mayor Flury appointed Paul Fetscher, Jr. 12.3 Marine Advisory Board There were no appointments to this board. 12.4 Nuisance Abatement Board Patricia Hart was appointed to one of the Alternate positions. 12.5 Planning& Zoning Board Bill Harris was appointed to the Alternate position. Commissioner Castro motioned to approve the appointments; seconded by Vice-Mayor Grace. The motion carried unanimously. 13.
