CITY OF DANIA BEACH
COMMUNITY REDEVELOPMENT AGENCY
TUESDAY, FEBRUARY 22, 2011
(During City Commission Meeting beginning at 7:00 p.m.)
1. Call to Order/Roll Call
Chairman McElyea called the meeting to order at 8:32 p.m.

Jeremy Earle, CRA Executive Director, noted the March 2, CRA Regular meeting has been
canceled. He thanked Board Member Anton for his leadership, support and friendship over the
past three years.
2. Resolution#2011-CRA-004
A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, COMMUNITY REDEVELOPMENT
AGENCY (CRA) AUTHORIZING THE PROPER COMMUNITY REDEVELOPMENT AGENCY OFFICIALS
TO EXECUTE A SEVENTH AMENDMENT TO THE 1NTERLOCAL AGREEMENT (ILA) EXISTING
BETWEEN THE CITY OF DANIA BEACH, THE COMMUNITY REDEVELOPMENT AGENCY AND
BROWARD COUNTY, PERTAINING TO COUNTY FUNDING OF INFRASTRUCTURE IMPROVEMENTS
PROPOSED FOR THE DANIA BEACH CRA AREA; AUTHORIZING THE EXECUTION OF A LOAN
AGREEMENT AND PROMISSORY NOTE PURSUANT TO THE SEVENTH AMENDMENT TO THE ILA;
PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution #2011-CRA-004.
Jeremy Earle, CRA Executive Director, advised that the Sixth Amendment to the Interlocal
Agreement (ILA) was approved by Broward County today, allowing us to have a one week
extension. He further noted that after several contacts with Broward County, they gave us the
Seventh Amendment to the ILA around 5:00 p.m. today. Director Earle indicated this issue will
be discussed at the County Commission meeting next Tuesday, March 1. He asked the
Commission for their support.
Bill Salim, CRA Special Counsel, noted he saw the Seventh Amendment to the ILA for the first
time today at 5:17 p.m. He stated that he can assure the Commission that this document will not
be approved by the County because he re-wrote a number of provisions that were inconsistent
with what they had previously discussed. Attorney Salim explained that the Seventh
Amendment is essentially the same format of the Fifth Amendment. He indicated that County
staff refused to allow the City to put the "do not exceed" $1,600,000.00 balance of the RCP
funding from our allotment.
Director Earle explained that the County would prefer to give us less, but the fact is that we do
not want less; we want what was promised to us. He advised that tomorrow he will meet with
the County civil engineer to review his concerns.
Vice-Mayor Castro confirmed with Director Earle that if the County put a fixed amount on the
agreement we will be locked into that number.
Director Earle noted there are no'more funds left in the Redevelopment Capital Program (RCP),
although in 2005 there was a promise made b the Count that this program would continue to

be funded.
Attorney Salim pointed out that anything that we do not get done between now and March 1, will
be lost. He advised that Mike Moskowitz is trying to get as much money as he can. Attorney
Salim asked the Board to approve the Seventh Amendment to the ILA.
Vice-Chairman Castro motioned to approve Resolution #2011-CRA-004; seconded by
Board Member Anton. The motion carried unanimously.
Vice-Mayor Castro asked if any of the Commissioners would be going to Washington, D.C. to
meet with some of the Department of Transportation officials and others.
Director Earle noted that the projects for the marine industry being discussed in Washington,
D.C. are important. He thought it was essential that we have a presence in Washington, D.C.
Vice-Mayor Castro asked Director Earle to make the necessary travel arrangement for her to
travel to Washington, D.C., February 28-March 1, 2011.
3. Adjournment
Chairman McElyea adjourned the meeting at 8:43 p.m.
