A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, APPROVING THE REQUEST MADE BY TAMARA
PEACOCK, CONSULTANT REPRESENTING ANGELA M. KELSEY OF
PORT 5 LTD., FOR AN EXTENSION OF THE SITE PLAN (SP-03-01)
GRANTED BY RESOLUTION NO. 2001-061, AND VARIANCE (VA-18-01)
GRANTED BY RESOLUTION NO. 2001-060, FOR PROPERTY LOCATED
AT 2150 NW 7 h AVENUE (SOUTH OF HERTZ RENTAL CAR AND EAST
OF THE FT LAUDERDALE INTERNATIONAL AIRPORT) IN THE CITY OF
DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on April 10, 2001, pursuant to Resolution No. 2001-061, a site plan(SP-03-
01) was approved for the proposed construction of a 72,000 square foot office/warehouse
building located at 2150 NE 7 b Avenue,Dania Beach, subject to conditions; and
WHEREAS, on that same date, pursuant to Resolution No. 2001-060, variance (VA-18-
01)was approved to allow:
1) 20%pervious area (Chapter 28, "Zoning" and Part 2, Section 215-130 of the Unified
Land Development Code provides that 30%is required); and
2) A generalized landscaping variance from Part 2, Article 275, "Landscape
Requirements of the Unified Land Development Code"; and
WHEREAS, Tamara Peacock, consultant representing Angela M. Kelsey of Port 5
LTD., is requesting an extension of the approvals for an additional 18 months, until February 12,
2013;
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH,FLORIDA:
Section 1. That the request to extend the expiration dates of the approvals identified
above of the site plan (SP-03-01) and the variance (VA-18-01) to February 12, 2013, are
approved, subject to the following previous conditions:
1. Provide written documentation that the applicant has contacted BCAD/FAA.
2. Fire Marshall comments must be addressed:
a. Note 32 ton weight limits and compliance with SFOC Ch. 52, Section
5211.2(g)(g)(F) on the plan. Also type of subsurface intended — concrete stones,
grids, etc.
b. Provide fire access road signs at both ends on both sides of access road and
clearly mark and identify the emergency road per SFBC Ch. 52, Sec.
5211.2(g)(2)(ii) along its length.
3. Architect to provide letter (signed and sealed) indicating that he or she has informed
the applicant and property owner that industrial uses cannot be substituted for
warehouse/distribution uses due to limited parking.
Section 2. That all such approvals are subject to the conditions previously approved
by the City Commission.
Section 3. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 4. That this Resolution shall be in full force and take effect immediately
upon its passage and adoption.
