HomeMy WebLinkAboutR-2011-077 - Approved request by Lazaro Monteagudo for modification to Site Plan (SP-05-03) at 2828 Hidden Harbour Court RESOLUTION NO. 2011-077 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,APPROVING THE REQUEST SUBMITTED BY LAZARO MONTEAGUDO ON BEHALF OF HH OAKS LLC,FOR PROPERTY LOCATED AT 2828 HIDDEN HARBOUR COURT IN DANIA BEACH(REQUEST IS FOR A MODIFICATION TO SITE PLAN (SP-05-03) APPROVED BY RESOLUTION 2003-046 ON MARCH 25,2003,AS PER CONDITION"C-4");PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on March 25,2003,the Dania Beach City Commission approved Resolution 2003-046(subject to conditions)to allow construction of 55 zero lot line homes and townhomes with accessory boat slips at properties located North of SW 45th Street,East of SW 30th Avenue,West of SW 28th Terrace, and South of the Dania Cut-Off Canal in the City of Dania Beach; and WHEREAS, condition (c) Staff recommendation conditions as follows ... (4)" states that "Installation of screen enclosures and/or patios shall require approval of a revised site plan by the City Commission.Please note screen enclosures must comply with building setback requirements."; and WHEREAS,the applicant,Lazaro Monteagudo on behalf of HH Oaks LLC,is requesting a site plan modification to allow for the proposed construction of a 250 square foot swimming pool and 126 square foot paver patio (376 total square feet)on an individual lot located at 2828 Hidden Harbour Court,Dania Beach; NOW, THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the proposed modifications to the site plan(SP-05-03MOD)for property located at 2828 Hidden Harbour Court, Dania Beach, Florida is approved. Section 2. That based upon the criteria set forth in Part 6, "Development Review Procedures and Requirements",Article 635,of the City of Dania Beach Florida Land Development Code, all site plan approvals shall automatically expire and become null and void unless building permits are obtained on or before 12 months from the date of this Resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4.
