HomeMy WebLinkAboutR-2011-090 - Established Building & Permit & Related Land Development Fees RESOLUTION NO. 2011-090 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, ESTABLISHING BUILDING AND PERMIT AND RELATED LAND DEVELOPMENT FEES; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That as provided by Section 8-3 of the City Code of Ordinances, which section is entitled "Building Permit Fees", and the City's Land Development Code, the schedule of such fees and related fees is established as follows, effective August 1, 2011: 8-3 SCHEDULE OF PERMIT FEES FOR CONSTRUCTION (a) Administrative Fees 1 Change of contractor $ 75.00 2 Re-inspection ("red tag") 90.00 3 Overtime inspection(for up-to 3 hours) 360.00 Each additional hour or portion of an hour 120.00 4 Certificate of occupancy ("C.O.") Residential, SFR and Duplex 150.00 Residential, Multi-family,per unit 60.00 Commercial 275.00 5 Certificate of Completion("CC") Residential 100.00 Commercial 175.00 6 Expired Permit Renewal(plus percentage below) 75.00 All Disciplines: (a) Within 90 days of expiration: Original Fee at 50% (b)After 90 days of expiration: Original Fee at 75% 7 Plan replacement or revision, Minimum 40.00 Plus 20.00 per page 8 Replacement permit card 35.00 9 Annual Contractor Record Maintenance Fee—Applies to contractors holding a certificate of competency and business tax receipt in a community other than the City of Dania Beach. (a) Fee shall become due on the anniversary of the date the 40.00 contractor first registered with the City. (b) Construction Fees, General Building Permit fees shall be charged to qualified applicants applying for permits to build, remodel or repair in the City of Dania Beach. Fees are based on the cost of providing inspection service, per inspection. Should the work being performed under an issued permit require additional inspections, each inspection shall be paid for at the time that the inspection is requested. If a Certificate of Occupancy is to be issued for the project, the amount due for additional inspections shall be collected prior to the issuance of the Certificate of Occupancy Additional inspection $ 90.00 Minimum Fee 90.00 Any permit that cannot be classified under this schedule, including but not limited to hotels, condominium hotels, timeshares, entertainment complexes and parking garages, shall be issued up to a maximum rate of 3.4% of the contract value of the work being performed or as determined by the Building Official. A copy of the contract shall be provided to the Building Division for this purpose or the cost will be determined using "R.S. Means" (plus 13% increase). (c) Impact Fees and Assessments Per City Ordinance, Article 7, Section 19-86: Additional fees for City Required Impact Fees are due prior to securing a Building Permit. Impact Fees and Assessments include, but are not limited to the following: Water and Sewer,Administrative, Fire, Police. (d) Plan Review A minimum Building plan review fee will be collected at the time of application for permit, or submission of plans for pre-review, for new construction or additions in accordance with Section A of this fee schedule. Fire Safety Inspection and Plan Review fees will be in accordance with Dania Beach Code of Ordinances Chapter 11, Article III. Fire Prevention, Section 11-46.1. Establishment of fees, (e) Amounts listed in this resolution are minimum fees. Actual fees may be higher based on the scope/extent of the work and the number of inspections required to final the permit(s). "Tree Preservation". Applicants are advised to review Article 825 of the City Land Development Code to determine all tree preservation/relocation requirements. (1) Land Development Application Fees The following fees shall apply to all applications for land use plan amendments, rezoning, special exception use, variances, site plans and other zoning related applications. These fees are used to defray staff cost in the evaluation of the proposal made and provide for the required notices and public advertisements according to Florida State Statute and the Dania Beach Land Development Code. Should any applicant have more than one type of request to the City, the applications involved should be submitted at the same time. The present City policy is to have concurrent reviews being processed before the final review and actions by the Planning and Zoning Board, City Commission, or both. It is the obligation of each applicant to review the appropriate City Codes and design standards related to the proposal before making any application to the City. The standard review process for all development applications are two (2) review cycles. That if any section, clause, sentence or phrase of this Resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Resolution Section 3. That all resolutions or parts of resolutions in conflict with this Resolution shall be repealed to the extent of such conflict. Section 4.
