5. Citizen Comments
George Jason, 4547 SW 37th Avenue,provided an update on the CERT Program.
Victoria Payne, Chamber of Commerce, 102 W. Dania Beach Boulevard, provided an update of
Chamber events.
Moses Padro, Moe Moe's Brooklyn Hot Dog, 50 SE 14th Street, noted he received a code
violation for feather flags at his restaurant. He said he needs the flags to attract customers. Mr.
Padro commented that he has been robbed 4 times at his home residence in Dania Beach.
Mayor Flury suggested he contact Nick Lupo, Code Compliance Manager to discuss the flags.

City Attorney Ansbro read the title of Resolution#2011-084.
Commissioner Castro noted the committee has a consensus that the wall will be one color,
however, they are still working on the plant materials.

6. Public Safety Reports
Charles Raiken, Deputy Fire Chief of Administration, BSO Fire Rescue, provided an update on
Hurricane Irene and the City's readiness, if required.
Lieutenant Diana Brown, BSO Patrol Commander, provided an update on recent criminal
activity in the city.

10. Discussion and Possible Action
10.1 Preliminary approval for Commissioner Anne Castro to attend the 3rd Annual SE
Florida Regional Climate Change Summit in Key Largo, Florida on October 27-28,
2011 (Estimated cost$800.00)
The Commission approved the request for Commissioner Castro to attend the 3rd Annual SE
Florida Regional Climate Change Summit in Key Largo, Florida.
10.2 Dania Entertainment Center, LLC — Discussion and Resolution to amend
Development Agreement for Dania Jai Alai and Casino
RESOLUTION#2011-095
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,
AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN AMENDED AND
RESTATED DEVELOPMENT AGREEMENT WITH DANIA ENTERTAINMENT CENTER, LLC,
PERTAINING TO THE JAI ALAI COMPLEX; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
Mayor Flury noted that we've had a Development Agreement with Boyd Gaming since 2006.
Dania Entertainment Center has asked for changes to the existing agreement, and the
Commission also wants to make changes to the agreement with Boyd Gaming.
Robert Daniels, Director of Community Development, provided an overview of the proposed
phases of the redevelopment of Dania Jai Alai, which is attached to and incorporated into these
minutes by reference. He noted the Development Agreement is fluid and still has items that need
to be addressed.
Mayor Flury noted that she opposes parallel parking along NE 2nd Street, and prefers all parking
to remain on site.
Vice-Mayor Grace concurred with Mayor Flury on the parking issue. Her concern is that we
protect the residents in the neighborhood.
Director Daniels explained parallel parking provides a buffer between the parking area and the
sidewalk, which makes it pedestrian friendly, and there is a psychological effect that makes you
want to slow down when you see parallel parking.
Commissioner Castro questioned if the continuous sidewalk was along both sides of the street,
and how the tomato field property would be maintained.

Debbie Orshefsky, Attorney representing DEC, responded they are willing to add the sidewalk
on the north side as part of Phase 1B. She noted the tomato field has contaminants and the
County requires that the area be secured by a fence, until it is cleaned up. This will also be part
of Phase 1B.
The Commission agreed to include the additional sidewalk and to eliminate the parallel parking.
Director Daniels noted the other unresolved issue is parking on the south side of Frost Park. He
said staff is requesting pervious parking improvements to make it more organized and perhaps
add some additional parking space. This condition has not been agreed upon.
Director Daniels noted he requested an updated traffic study, which was the basis for the
negotiations for the off-site traffic improvements that are reflected in the updated development
agreement. He confirmed that the developer and staff have agreed to a joint traffic study 3 years
after the operation begins to determine the impacts and what mitigations are needed.
Johanna Lundgren, Weiss Serota, Special Counsel for the City, noted this agreement is stronger
and more protective of the City's interests than the prior agreement with Boyd Gaming.
Debbie Orshefsky, Attorney representing DEC, introduced the Dania Entertainment Center team
and advised that Lakes Entertainment Inc. will be the operator of the development. She provided
a PowerPoint overview of Lakes Entertainment, Inc. and their proposal, which is attached to and
incorporated into these minutes. Phase 1 is the development of the casino; Phase IA is the
landscape, lighting and hotel. Ms. Orshefsky noted they had several community meetings and
discussed different options for access on Fronton Boulevard; the design restricts as much
neighborhood intrusion as possible. She confirmed that under the agreement, they must come
back to the Commission for approval of both Phase I and Phase 1B. Ms. Orshefsky said all of
Phase 1 should be complete in 1 year; the hotel could begin six months later and be complete in
12-18 months. She confirmed that under current FAA guidelines, they could construct the
proposed hotel up to 150% and also confirmed that they would not use any of the City's RAC
units. Ms. Orshefsky noted Phase 1B is the development of the marina, with final plans
dependent upon whether or not they acquire the church property. She said they would be
working with the City and FDOT to install directional signs in key locations throughout the city.
Commissioner Castro asked if they could work with FDOT to consolidate some of the directional
signs with existing signs.
Ms. Orshefsky explained that Frost Park belongs to the City and they would prefer that they not
be responsible for improvements to a public facility. She noted the pari-mutuel facility does not
need to meet many City codes, but they have agreed to do so. This project will have a positive
fiscal impact on the City and they look forward to working with us.
Vice-Mayor Grace noted her concern is not making money; it is to insure that the quality of life
for the citizens is impacted as they see fit because they have been here and need to prosper from
this.

Mayor Flury opened the Public Hearing.
Bruce Hannover, 617 NE 2"d Place, Dania Beach, is concerned with 2"d Street parking. He
indicated the neighborhood is in favor of no parking on 2"d Street behind Jai-Alai.
Dick Sokol, 609 NW 1 Oth Street, Dania Beach, spoke in favor of the project.
Clive Taylor, 642 NE 3rd Street,Dania Beach, spoke in favor of the project.
Craig Urbine, 1211 Stirling Road, Dania Beach, spoke in favor of the project and noted that the
Stirling Road Design District is also in favor of the development.
Kevin Daise, 110 NW 14th Avenue, Dania Beach, is concerned that the wealth of the casino will
not be spread into the impoverished neighborhoods.
Mayor Flury noted if all goes as planned, the Commission will discuss how to allocate the funds,
including the possibility of establishing a scholarship fund.
Albert Frevola, Conrad and Scherer, 633 S. Federal Highway, Ft. Lauderdale, Attorney
representing Citizens for Responsible Development, Inc., noted there are still questions that need
to be answered in the agreement. He indicated that public notice requirements should have been
adhered to as would be required in a normal development agreement. Mr. Frevola said there is
little evidence to support that public safety issues have been addressed. He questioned the
experience of Lake Entertainment, and the financing for the project. Mr. Frevola said the traffic
study does not explain the change in the traffic patterns, and asked for more time to study the
proposal.
Chickie Brandimarte, 101 SE 3rd Avenue, #604, Dania Beach, spoke in favor of the
development.
Dr. E. K. Schandl, 168 NE 6th Court, Dania Beach, questioned the parking and traffic, but noted
that he favored the development.
Irene Lathrop, 818 NW loth Avenue, Dania Beach, had several questions and asked if they
answers could be posted to the City website. Is there any future expansion of US 1 from 4lanes
to 6 lanes? How will all the extra cars and people impact Frost Park? Who are the target patrons
for the facility? Will the construction of the casino be overlapped by the possible construction at
the airport? Why would DEC not have to agree with City standards when they are going to be
building things? A 60 x 30 LED sign will be daylight 24/7.
City Manager Baldwin noted the answers will be posted under Hot Topics on the City website.
Henry Saludes, 707 SE 3rd Court, Dania Beach, noted this will impact all residents in the
residential neighborhood; the traffic will be untenable; the casino will be a black hole for
surrounding businesses; and the jobs are low paying low sector jobs. He said property values are
depressed and will be negatively impacted, and Frost Park will be destroyed. Mr. Saludes

questioned if satellite businesses such as Pawn Shops would follow the development of the
casino.
Mayor Flury clarified that we are not voting on whether or not we want a casino; that was voted
upon by the residents of Broward County several years ago. We are looking at a change in the
Development Agreement that already exists.
Bob Mikes, 601 NW 7th Street, Dania Beach, is concerned if they have the finances and
professionals to put this operation together in this economy. He said that the only choice for the
property, due to the expansion of the airport, is this or industrial marine use. Mr. Mikes hopes
this does not become a burden to the CRA financing.
Patty Hart, 517 NE 2A Place, spoke in favor of the development. She thanked staff for all their
assistance on this project.
Seeing as there was no one else to speak,Mayor Flury closed the Public Hearing.
City Attorney Ansbro read the title of Resolution#2011-095.
Commissioner Castro motioned to adopt Resolution #2011-095; seconded by Commissioner
Duke.
Attorney Orshefsky responded to Commissioner Castro that the effectiveness of the agreement is
tied to closing on the property; if they close, they build. She confirmed that financing is
currently only for the casino, not the hotel, but that financing is in place for the hotel. She said
the branding of the hotel and restaurants has not been determined.
Attorney Lundgren acknowledged that the City Code has provisions to prevent pawn shops in the
neighborhood.
Commissioner Castro said she has not had a chance to read the development agreement, and
wants the recommendation and assurances from the City Attorney that she should vote for this.
City Attorney Ansbro responded in the affirmative.
Attorney Lundgren reiterated that it is a good agreement.
Commissioner Castro commented to the attorney for Conrad and Scherer on the robo-call sent
out to the community. She took exception to some of the statements made in the call due to the
insinuation that staff and the Commission were not doing their job, or that they did not have
community input. Commissioner Castro noted the NE has to pay attention to the airport issue
because it will impact their residential quality of life more than this development.
Vice-Mayor Grace wants to work as partners with the developers and the residents. She would
like for them to be involved in the future scholarship fund. Vice-Mayor Grace wants to give jobs
to Dania Beach residents, and would like to see Dania Beach on the casino sign.

Commissioner Duke noted he was cynical at first, however, they have been extremely responsive
and have done a good job at presenting their project. He acknowledged that staff has also done a
tremendous job working on this project. Commissioner Duke said if the neighborhood is good
with it,he is good with it, and he thinks this is a good plan.
Commissioner McElyea noted he was here when Jai Alai began, and he wants to see this project
happen.
Mayor Flury commented the revised development agreement is an improvement over the Boyd
agreement.

RETIREMENT SYSTEM TO PROVIDE FOR THE IMPACT OF BECOMING A CLOSED PLAN FOR
FIREFIGHTER PARTICIPANTS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY;

9.2 RESOLUTION#2011-088
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING
THE VARIANCE REQUEST SUBMITTED BY LUKES-SAWGRASS LANDSCAPING FROM SECTION 115-
50 "CONDITIONS OF USE" #76, OF THE UNIFIED LAND DEVELOPMENT CODE FOR PROPERTY
LOCATED AT 2711 SW 36TH STREET, IN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS;
FURTHER,PROVIDING FOR AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution#2011-088.
Corinne Lajoie, AICP, Principal Planner, noted the request is to reduce the perimeter landscape
screening the buffer surrounding outdoor storage. She advised the property is under the flight
path. Staff recommends approval with conditions noted in the resolution.
Mayor Flury opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition, she closed the Public Hearing.

AN EXTENSION OF THE SITE PLAN(SP-31-10), GRANTED BY RESOLUTION NO. 2010-112 ON JULY 27,
2010,FOR PROPERTY LOCATED AT 48 SOUTH FEDERAL HIGHWAY IN THE CITY OF DANIA BEACH,

City Attorney Ansbro read the title of Resolution#2011-089.

11. Commission Comments
11.1 Commissioner Castro
Commissioner Castro noted she attended the League of Cities Conference and will provide a
report for the Commission and staff. There was a presentation by Dr. Florida, who argued that
creativity and diversity are the new ways to market your City. She suggested that CRA Director
Earle and Community Development Director Daniels read his books to see if we can incorporate
his ideas with our City.
Commissioner Castro thanked staff for the Ethics Ordinance comparison, and suggested we need
to have a workshop on this.
Commissioner Castro noted a local artist would like to do a project in the parking garage, and
she encouraged him to reach out to staff.
Commissioner Castro hopes we work something out with the flags at Moe Moe's Brooklyn Hot
Dog, and asked the City Manager to reach out to him.
Commissioner Castro thanked staff for setting up the Transportation Symposium to discuss the
bridge projects.
11.2 Commissioner Duke
Commissioner Duke had no comments.

Commissioner McElyea had no comments.
11.4 Vice-Mayor Grace
Vice-Mayor Grace noted there will be a grant meeting at City Hall on September 10, 2011.
Vice-Mayor Grace commented that we are hurting Moe's Brooklyn Hot Dog business and asked
the City Manager to work with staff to help keep this business stay in the City.
11.5 Mayor Flury
Mayor Flury thanked the residents for coming out tonight, and for their positive comments; it
was nice to have their support this evening. She also thanked the people who called her in
response to the robo-calls.

Mayor Flury thanked Kristen Jones, Director of Parks and Recreation, for bringing the Fishing
Pier back to life.
Mayor Flury commented that the Finance Director's Monthly Report contained a comment on
the delay of the repayment of$6M from the SRF funds. She asked if we received the funds.
City Manager Baldwin responded we have not received the funds, and staff is working on the
problem. He will report to the Commission when the money is received.
12. Appointments
Mayor Flury appointed E. J. Shinsky to the Marine Advisory Board.
Commissioner Castro motioned to approve the appointment; seconded by Vice-Mayor
Grace. The motion carried unanimously.
13. Administrative Reports
13.1 City Manager
Mayor Flury acknowledged that everyone is interested in helping Moe's Brooklyn Hot Dog,
however, she is not in favor of feather flags along Federal Highway. She noted we have to be
consistent in what we do with all businesses.
City Manager Baldwin appreciates the work of BSO Fire Services during this hurricane.
Dominic Orlando, Director of Public Services, reported on the progress of SE 5th Avenue. He
noted the project was submitted to Broward County for the 3rd time this morning. The project
will only include the medians at each end of the roadway and the landscaping. The medians are
the same as the original project approved by Broward County, but they are now looking at the
new design because they don't meet standards. Director Orlando accepted partial responsibility
for the delay of the project, and said he expects approval from the County this week.

THE CITY OF DANIA BEACH, FLORIDA, REGARDING
ADOPTION OF THE FOLLOWING PROPOSED ORDINANCES:
NOTICE IS GIVEN that on August 23, 2011 at 7.00 p.m. or as soon thereafter as the matter may
be heard,the City Commission of the City of Dania Beach, Florida, will conduct a public hearing
in the Commission Chamber at Dania Beach City Hall, 100 West Dania Beach Boulevard, Dania
Beach,Florida,to consider the proposed adoption of the following ordinances:
ORDINANCE NO. 2011-028
AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA,
AMENDING SECTION 18-40, "DEFINITIONS" AND SECTION 18-46
"ADMINISTRATION" OF CHAPTER 18, "PENSIONS AND RETIREMENT"
OF THE CITY CODE OF ORDINANCES RELATING TO THE POLICE AND
FIREFIGHTERS RETIREMENT SYSTEM TO PROVIDE FOR THE IMPACT
OF BECOMING A CLOSED PLAN FOR FIREFIGHTER PARTICIPANTS;
PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
Copies of the proposed ordinances are on file in the Office of the City Clerk, City Hall, 100 West
Dania Beach Boulevard, Dania Beach, Florida, and may be inspected by the public during
normal business hours.
Interested parties may appear at the meeting and be heard with respect to the proposed
ordinances. Any person who decides to appeal any decision made with respect to any matter
considered at this hearing will need a record of the proceedings and for such purpose may need
to ensure that a verbatim record of the proceedings is made, which record includes the testimony
and evidence upon which the appeal is to be based.
In accordance with the American with Disabilities Act, persons needing assistance to participate

SUBJECT: SP-20-11: The applicant, Dania Entertainment Center, LLC., is requesting
to amend and restate a previously approved Developers Agreement for
the construction of a casino, hotel, marina and commercial use on the
current Dania Jai Alai site located at 301 East Dania Beach Boulevard.
THIS ITEM REQUIRES A PUBLIC HEARING
PROPERTY INFORMATION
EXISTING ZONING: East Dania Beach Boulevard-Mixed Use (EDBB-
MU), and Residential Single Family (RD-8000)
LAND USE DESIGNATION: Regional Activity Center
OVERLAY DISTRICTS: Community Redevelopment Agency, Arterial
Corridor Overlay District
The applicant, Dania Entertainment Center, LLC (DEC) is proposing to amend and restate the
existing Developers Agreement with the City of Dania Beach. The proposed modification to the
agreement includes three (3) development phases. These phases include:
PHASE 1
This Phase includes the expansion of the existing Jai Alai building to accommodate casino
activity and a cabana club. Modifications are being made to the landscaping on site. The
applicant is modifying Fronton Boulevard by changing the on-street parking for Frost Park,
closing NE 1 Street at Fronton Boulevard and adding median and swale landscape treatments.
Signage is also a component of this phase. In addition to numerous directory and monument
signs, they are proposing three (3) LED signs, similar to the Seminole Hard Rock sign on State
Road 7. These signs are capable of full motion video. The main sign, located at the corner of
East Dania Beach Boulevard and Fronton Boulevard will be thirty (30) feet wide and sixty (60)
feet in height. The remaining two (2) signs are attached and located approximately 400 feet
west of Fifth Avenue on East Dania Beach Boulevard and will be fifteen (15) feet wide and thirty
(30) feet in height.
PHASE1A
Two hotel buildings totaling 500 rooms would be added to the site in Phase 1A. No rendering of
the buildings have been provided. The proposed pool deck is shown to be forty-six (46) feet
from the east property line, which is shared with the Danian's Condominium. Also proposed in
this phase is modification of the parking area to accommodate a grand tree lined entrance into
the site with a round-about at the hotel.

PHASE 1 B
The third phase identifies the construction of a marina and commercial retail on the site of the
old tomato field north of NE 2 Street. A seventy-five (75) foot perimeter landscape buffer has
been identified adjacent to NE 3 Avenue and a fifty (50) foot perimeter landscape buffer has
been identified along NE 2 Street. However, there has been no dimension identified for the
mitigation and surface water management areas on the west side of the property. In addition,
the marina dock and parking lot are only ten (10) feet from the east property line which provides
an inadequate area to properly landscape and buffer the uses from the adjacent property.

The Community Development Department has reviewed the project in light of the fact that
Section 550.155 Florida Statutes exempts pari-mutuel developments from local codes and

regulations unless the municipality is able to demonstrate that the pari-mutuel development
would present a justifiable and immediate hazard to the health and safety of municipal
residents. In an effort to fully understand the impact of the project on the City, Department staff
has conducted development review of the proposed improvements using the standards
generally applicable to other developments in the City, and has determined that some elements
of the project are in compliance with the Code, while other Code requirements have been met
through alternative negotiated solutions. A few issues remain for the Commission's
consideration, as outlined later in this report.
ACTIONS SUBSEQUENT TO ISSUANCE OF PRELIMINARY STAFF REPORT
City staff and the applicant's development team have coordinated since the Preliminary Staff
Report was submitted to discuss outstanding issues. Issues numbered 1, 2 and 5 have been
resolved and appropriate language has been incorporated into the Amended and Restated
Development Agreement. Issues and concerns that remain are identified below.
1. BSO-Police requests two (2) deputies to handle arrests, crimes and other situation
inside the fronton/casino above what private security can handle for events on the
property. Status: THIS ISSUE HAS BEEN RESOLVED. Based on research of
facility operations in other jurisdictions, BSO-Police for Dania Beach has
withdrawn this request.
2. BSO-Fire Rescue has requested the applicant to agree to sufficiently mitigate, and
accept financial responsibility for the fire rescue services impacts of its development as
determined by BSO-Fire Rescue so as not to negatively impact the delivery services.
Status: THIS ISSUE HAS BEEN RESOLVED. Agreement has been reached and
articulated in paragraphs 8.d. and 11 of the Amended and Restated Development
Agreement.
3. Staff requests that the applicant provide on street parallel parking on NE 2 Street for the
length of the project, consistent with the CRA Redevelopment Plan. Status:
Unresolved. The applicant has not agreed to this request and an objection has
been received from the Northeast neighborhood. Staffs reason for this request is
to provide traffic calming and a safer pedestrian environment where there will now
be a continuous sidewalk; provide additional parking for events at Frost Park and
to implement the Community Redevelopment Agency Redevelopment Plan.
4. Staff requests that the applicant provide pervious parking on NE 1st Street on the south
side of Frost Park. Status: Unresolved. The applicant has not agreed to this
request

5. Staff requests that the applicant mitigate off-site traffic impacts the development will
incur by contributing its proportionate fair share. Status THIS ISSUE HAS BEEN
RESOLVED. Agreement has been reached and articulated in paragraphs 9.g. and
10 of the Amended and Restated Development Agreement.
CITY COMMISSION PREVIOUS ACTION
On November 15, 2006, the City Commission approved the Second Amendment to the
Developers Agreement with the Aragon Group for the development of a new Jai Alai fronton and
casino.
STAFF RECOMMENDATION
Staff recommends approval of the Amended and Restated Development Agreement with the
condition that the issues outlined in this staff report are resolved.
