DANIA BEACH CITY COMMISSION
TUESDAY, SEPTEMBER 13, 2011 — 7:00 P.M.
1. Call to Order/Roll Call
Mayor Flury called the meeting to order at 7:00 p.m.

2. Invocation and Pledge of Alle ig,ance
Vice-Mayor Grace gave the invocation followed by the Pledge of Allegiance to the United States
Flag.
3. Presentations and Special Event Approvals
3.1 Presentation of Dania Beach Marina Redesign by Craven Thompson & Associates,
Inc.
Chad Edwards, Senior Project Engineer, Craven Thompson & Associates, noted they met with
the Dania Beach Marine Advisory Board and the Broward County Marine Advisory Committee,
who were both very receptive to the design. He introduced the members of his team.
Tyler Chappell, Vice-President, The Chappell Group, presented an overview of the redesign of
the City Marina, which is attached to and incorporated into these minutes.
Commissioner Duke confirmed with Mr. Chappell that the Marina will be able to accommodate
jet skis and kayaks.
Mr. Chappell responded for Mayor Flury that water and electricity will be available on all the
docks.
Don Wilkins, Associate Principal, ACAI Architects, reviewed the improvements to the Dock
Master building, courtyard and kiosks.
Vice-Mayor Grace asked how they addressed the issues raised by the Marine Advisory Board.
Mr. Edwards responded that the northern dock will be accessible and low enough to the water so
that access is suitable for all vessels. He also noted that the boat slips have been designed to
accommodate different size vessels. Mr. Edwards further indicated that they will place
receptacles for bags to be used by anyone bringing their pets.
Commissioner Castro clarified with Mr. Edwards that the Dock Master and Lifeguard offices
will be located in two separate buildings.
Mr. Edwards responded for Commissioner Castro that the total cost of the project is $4.5M. He
added that staff is currently working on the funding application. Mr. Edwards advised that
there is a 50%match through the Florida Inland Navigation District(FIND) and Broward County
has offered a$1.5M contribution.
Colin Donnelly, Assistant City Manager, noted that the Broward County Boating Improvement
Program (BBIP) grant application is due on September 19`h. He advised that he met with John
Fiore, Broward County Parks and Recreation Division, who said they will fund all three
elements of the plan. Assistant City Manager Donnelly confirmed that FIND will match up to
50% of the project. He also indicated that the Florida Boating Improvement Program (FBIP)
will provide funding for Phase 1 for $180,000.00, which is a good indication that they might
fund Phase 2. Assistant City Manager Donnelly clarified that there are no elements that are not
covered for funding. Lastly, he commented that as we move closer to seeking our permits and
going out to bid on this project,there will be multiple funding sources.
Commissioner Duke complimented the Craven Thompson team for doing an excellent job.
Mayor Flury confirmed with Mr. Edwards that under the new plan all docks will be floating
docks. She remarked that the new building for the Dock Master is luxurious for this type of
Marina and added that if we run out of money this part of the project should be the lowest
priority on our list.
Mr. Edwards noted there is a need for this type of facility at this location.
3.2 Special Event request from Stampler Auctions for an Automobile Auction on
Wednesday, September 28, 2011 from 11:00 a.m. - 1:00 p.m., at Tigertail Industrial
Park, 1914 Tigertail Boulevard
Commissioner Castro motioned to approve the Special Event request for Stampler
Auctions Automobile Auction; seconded by Commissioner McElyea. The motion carried
on the following 5-0 Roll Call vote:

4. Proclamations
There were no proclamations at this meeting.
5. Citizen Comments
Linda Sacco, 4481 SW 380' Terrace, read a report from the Airport Advisory Board relating to
the Airport Settlement Agreement, which is attached to these minutes.
Bob Mikes, 601 NW 7th Street, addressed the Airport presentations in the community. He
expressed his concerns with the proposed Settlement Agreement. Mr. Mikes noted that staff
needs to do more research before the Commission adopts this Agreement.
David Clark, 411 SE 51h Street, discussed establishing Campaign Finance Reform, and said he
would like to have a discussion on this subject prior to the next election cycle. He distributed a
copy of the ordinance adopted by the City of Fort Lauderdale in 2002 to the Commission.
Rose Lizana, 214 SE 2nd Street, invited the Commission to the Kiwanis Installation Banquet at
Lorenzo's Restaurant on Federal Highway, on Friday, September 16, 2011 at 6:00 p.m.
6. Public Safety Reports
Donn Peterson, BSO Chief of Police, recognized Deputies Tucker and Anderson for their work
on the apprehension of a criminal.
Charles Raiken, Deputy Fire Chief of Administration, BSO Fire Rescue, reported on the CERT
Team. Deputy Fire Chief Raiken noted that the Broward Sheriff's Office will provide AED and
CPR training for all City staff.
Joseph Maurice Louissaint, Pastor, South Florida Haitian First Baptist Church, 23 NW 1st Street,
requested assistance to purchase fire escapes and trees as required by City Code.
Vice-Mayor Grace suggested he meet with Assistant City Manager Donnelly for grant
opportunities.

DEPARTMENT OF COMMERCE, ECONOMIC DEVELOPMENT ADMINISTRATION, FOR FUNDING OF
THE U.S. 1/FEDERAL HIGHWAY AND FLORIDA EAST COAST RAILWAY BRIDGES PROJECT;
PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution#2011-104.
Commissioner Castro explained we are resubmitting our EDA grant application hoping that we
have now addressed the concerns raised by the Economic Development Administration. She
thanked Assistant City Manager Donnelly, CRA Executive Director Earle, Josh Gaboton of
Alcalde & Fay and City staff, for their efforts to renew this application.

City Attorney Ansbro advised the remaining items were quasi-judicial hearings and swore-in
those who would speak. He asked the Commission to disclose any communication they had on
these matters.
9.1 RESOLUTION#2011-096
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING
THE REQUEST MADE BY A PROPERTY OWNER,WILLIAM STAMM,FOR AN EXTENSION OF THE SITE
PLAN (SP-19-10), GRANTED BY RESOLUTION NO. 2010-109; SPECIAL EXCEPTION (SE-19-10),
GRANTED BY RESOLUTION NO. 2010-107; AND VARIANCE (VA-20-10), GRANTED BY RESOLUTION
NO. 2010-108 FOR PROPERTY LOCATED AT 684 SW 7TH TERRACE IN THE CITY OF DANIA BEACH,

City Attorney Ansbro read the title of Resolution#2011-096.
Kristin Dion, City Planner, provided an overview of the request for the extension of the
previously approved site plan and special exception. The applicant stated that the economic
downturn, and the unforeseen expenses incurred in the site planning process are the reasons for
requesting a two-year extension. She noted staff recommends approval with the prior conditions.
Mayor Flury opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition, she closed the Public Hearing.
Commissioner Duke motioned to adopt Resolution #2011-096; seconded by Commissioner

THE VARIANCE REQUEST SUBMITTED BY ALEXANDER DEMIDOV REPRESENTING RHYTHMIC ART,
INC., FROM THE UNIFIED LAND DEVELOPMENT CODE PART 2, SECTION 265-50 SCHEDULE OF
MINIMUM OFF-STREET PARKING REQUIREMENTS; FOR PROPERTY LOCATED AT 301 BRYAN ROAD
(SPACES 301-309), DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN

City Attorney Ansbro read the title of Resolution#2011-097.
Kristin Dion, City Planner,provided an overview of the parking variance request for a gymnastic
studio. She advised that based on the approved site plan, the three subject units are allocated 20
parking spaces. The Community Development Director and the Economic Development
Manager have visited the site and concluded that parking is adequate and that this use will not
negatively impact other businesses in this industrial park. Ms. Dion noted that staff recommends
approval.

10. Discussion and Possible Action

11. Commission Comments
11.1 Commissioner Castro
Commissioner Castro requested an update on the solar lights on NW 10t'Avenue. She indicated
that these lights have been out twice since they were installed and commented they may need
batteries.
Commissioner Castro noted that the building to the west of the Royal India Restaurant on Griffin
Road has been cited by Code Compliance. She advised that the case will probably appear before
the Special Magistrate at their next hearing.
Commissioner Castro noted that the Southeast Florida Regional Climate Task Force meeting was
changed to December 8-9, 2011. She said she will not be able to go and asked if any other
Commissioner would like to attend.
Commissioner Castro thanked Public Services Director Orlando and staff for making
arrangements for Dania Beach to participate in the C-51 project. She noted the item will be
presented at the September 27 meeting for Commission approval.
Commissioner Castro spoke about the Airport meetings. She thanked staff for their hard work
on this important issue. Commissioner Castro encouraged everyone to participate in the
upcoming Open House and Public Hearings.
Commissioner Castro noted she attended the Florida League of Cities Annual Conference in
Orlando. She will pass on the information to City Manager Baldwin to give to the Commission.
Commissioner Castro provided an overview of the resolutions adopted by the League of Cities at
the meeting. Lastly, she said she would like to discuss the desalinization plant issue with
Director Orlando,which they also talked about at the Conference.

11.2 Commissioner Duke
Commissioner Duke thanked staff for their work, particularly Community Development and
Code Compliance. He also thanked the audience for participating and being involved in our
City.
11.3 Commissioner McElyea
Commissioner McElyea said we need to install solar lights in the alley near Paolo's Restaurant.
He noted many lights throughout the City are not working.
11.4 Vice-Mayor Grace
Vice-Mayor Grace reminded everyone of the street dedication for Barker Lane this Saturday.
11.5 Mayor Flury
Mayor Flury questioned the status of the RFP for the Pier Restaurant.
City Attorney Ansbro noted the Request for Letters of Interest should be ready to present to the
Commission in the next two weeks.
Mayor Flury commented on the Airport situation. She noted that there are a lot of people who
do not know what is happening. Mayor Flury asked that the informational sheet be placed in the
lobby for anyone to pick up. She wanted to make sure that the results of the mediation are
available for everyone. Lastly, Mayor Flury reminded the community that the Airport Public
Hearings will be held at 7:00 p.m. on Thursday, September 22 and Monday, October 3,
respectively.
Mayor Flury requested the information for all City projects be available for the Second Budget
Public Hearing. She asked that a line item be added to the budget for Neighborhood
Improvements. Mayor Flury would like staff to do a thorough investigation for other Solar
Lighting companies.
12. Appointments
12.1 Dania Beach Housing Authority
Mayor Flury appointed Brenda Lowary for the term expiring October 31, 2013. She also
reappointed Bill Winkelholz for another 4 year term expiring on October 31, 2015.
Vice-Mayor Grace motioned to approve the appointments; seconded by Commissioner

12.2 Marine Advisory Board
Commissioner Duke appointed Mark LaRocca to the Marine Advisory Board.
Commissioner Castro motioned to approve the appointment; seconded by Vice-Mayor
Grace. The motion carried unanimously.
13. Administrative Reports
13.1 City Manager
City Manager Baldwin noted it has been difficult getting the permit to remove the Sea Grapes at
the Beach. He advised that a decision should be made tomorrow by the Florida Department of
Environmental Protection; however, we are willing to give them more time if necessary.
City Manager Baldwin spoke about an issue with Broward County regarding a method to get
multi-directional signs on SE 5th Avenue; however, we will need to go before the County
Commission for approval. He indicated that County staff will not recommend approval of the
request.
City Manager Baldwin encouraged everyone to attend the First Budget Public Hearing to be held
tomorrow at 7:00 p.m. in the Commission Chamber.

AN ORDINANCE AMENDING CHAPTER 12, "ELECTIONS, " OF
THE CODE OF ORDINANCES OF THE CITY OF FORT
LAUDERDALE, FLORIDA, AMENDING SECTION 12-1 TO
PROVIDE FOR CAMPAIGN FINANCING PROVISIONS
SUPPLEMENTING STATE LAW; CREATING SECTION 12-3,
"DEFINITIONS"; CREATING SECTION 12-4, "CAMPAIGN
CONTRIBUTION LIMITS AND PROHIBITED
CONTRIBUTIONS, " TO PROVIDE FOR CAMPAIGN
CONTRIBUTION LIMITATIONS AND SPECIFYING ENTITIES
AND ORGANIZATIONS PROHIBITED FROM MAKING
CONTRIBUTIONS TO CANDIDATES IN ELECTIONS FOR
MAYOR-COMMISSIONER AND CITY COMMISSIONER; AND
CREATING SECTION 12-5, "PENALTIES . "
WHEREAS, the United States Supreme Court has held in
several instances beginning with the decision in Buckley v. Valeo, 424
U.S. 1 (1976) , that the perception of corruption is inherent in a
system of large financial contributions to candidates for public
office, and the City Commission of the City of Fort Lauderdale has
determined that it is necessary to prevent corruption and the
appearance of corruption that results from large campaign contributions
and campaign contributions from certain entities and organizations must
be prevented from having an adverse effect on municipal elections for
mayor-commissioner and city commissioner; and
WHEREAS, in the case of Claravella v. Board of County
Commissioners of Sarasota County, et al . , No. 99-4201 (Fla. Cir. Ct.
Sept. 10, 1999) , local election campaign contribution limits lower than
provided for in Section 106. 08, Florida Statutes, have been upheld as
enforceable and constitutional; and
WHEREAS, the City Commission has found that it is necessary
for the preservation of the integrity of representative democracy in
the City of Fort Lauderdale to impose limitations and restrictions on
campaign contributions, which includes direct expenditures on behalf of
candidates, in municipal elections in order to remove the perceived
corruption stemming from candidate dependence upon large contributors
and contributors such as corporations, special interest groups and
other entities and organizations; and

WHEREAS, the United States Supreme Court has found that
when the perception of corruption is not addressed, the resulting
cynical assumption of voters that large donors unduly influence the
work of government could jeopardize the willingness of voters to
participate in the democratic process of representative government; and
WHEREAS, the City Commission has found that the public' s
awareness of the possibilities of abuse and corruption arising from
large contributors and contributions from certain entities and
organizations erodes the public' s confidence in the democratic system
and in the integrity of municipal elections in the City of Fort
Lauderdale; and
WHEREAS, the City Commission has determined that in order
to prevent the appearance of undue influence and access to candidates
by contributors and to prevent candidates from gaining an unfair
advantage in the political marketplace, it is necessary to address the
potential for abuses associated with campaign contributions, including
direct expenditures, by entities formed for business purposes such as
corporations, limited liability companies, professional associations,
national and state banks, unincorporated associations, labor
organizations, and limited partnerships, limited liability
partnerships, and general partnerships, as well as special interest
groups such as political committees, political action committees,
committees of continuous existence and unincorporated associations; and
WHEREAS, business entities and entities formed for business
purposes have the ability to amass great wealth in the economic
marketplace and to utilize such wealth to disproportionately impact
municipal elections with campaign contributions, which unfairly
influences elections and creates the perception that public officials
may be influenced by special interests to the public detriment; and
WHEREAS, resources in the treasury and accounts of a
business entity are not an indication of popular support of the
entity' s political ideas, but instead reflect the economically-
motivated decisions of investors, owners, and customers; and

WHEREAS, the City Commission has determined that in order
to prevent abuses that are likely to result from an ordinance limiting
campaign contribution amounts and prohibiting specified business
entities from contributing to a candidate, it is necessary to prohibit
contributions from other groups and organizations to inhibit
circumvention of the ordinance' s contribution limitations; and
WHEREAS, there is a danger that a candidate' s reliance on
contributions from corporations, special interest groups and other
entities and organizations for election assistance will impair such
candidate' s ability to make independent choices; and
WHEREAS, the City Commission has determined that the
appearance of quid pro quo relationships between special interest
contributors and political recipients, whether or not it exists,
seriously undermines public confidence in the political system, and has
the potential for disproportionate impact on elections in the City of
Fort Lauderdale; and
WHEREAS, the City Commission has determined that campaign
contributions in previous elections demonstrate that candidates can
amass the resources necessary to participate effectively in the
electoral process, by means of contributions from individuals and
without relying on contributions from corporations, special interest
groups and other entities and organizations; and
WHEREAS, the City Commission has determined the campaign
finance provisions of this ordinance will eliminate the appearance of
and the potential for undue and unfair influence on elected city
officials helping to instill more faith and trust in government, will
ensure that competition among candidates in the political arena is
truly a competition of political ideas, and will level the playing
field for qualified individuals, who may not otherwise choose to run
for public office, desiring to devote the time and effort necessary
seek and hold the office of mayor-commissioner or city commissioner of
the City of Fort Lauderdale;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF FORT LAUDERDALE, FLORIDA:
SECTION 1 . That Section 12-1, entitled "State law to apply, " of the
Code of Ordinances of the City of Fort Lauderdale, Florida
is hereby amended as follows :
Sec. 12-1 . State law to apply.
All city elections shall be conducted in accordance with
the requirements set forth in Florida Statutes, and with
the coexisting provisions of this chapter.
SECTION 2 . That Section 12-3, entitled "Definitions, " of the Code of
Ordinances of the City of Fort Lauderdale, Florida is
hereby created as follows:
Sec. 12-3. Definitions.
For the purposes of this chapter, the following terms,
phrases, words and their derivations shall have the meaning
given herein. When not inconsistent with the context,
words used in the present tense include the future tense,
words in the plural number include the singular number, and
words in the singular number include the plural number.
Words not defined in this article shall be defined in
accordance with state and federal law or otherwise shall be
given their common and ordinary meaning, unless the context
clearly provides otherwise.
(a) Candidate shall have the meaning given to such term in
Chapter 106, Florida Statutes, as amended from time
to time.
(b) Committee of continuous existence shall have the meaning
given to such term in Chapter 106, Florida
Statutes, as amended from time to time.

(c) Contribution shall have the meaning given to such term
in Chapter 106, Florida Statutes, as amended from
time to time. An independent expenditure, as that
term is defined in Chapter 106, Florida Statutes,
is not included within the meaning of contribution.
(d) Labor organization or union means any organization of
any kind, or any agency or employee representation
committee or plan, in which employees participate
and which exists for the purpose, in whole or in
part, of dealing with employers concerning
grievances, labor disputes, wages, rates of pay,
hours of employment, or conditions of work.
(e) N_a_t_ural person shall mean any human being other than an
unemancipated child under the age of eighteen.
(f) Political Committee shall have the meaning given to such
term in Chapter 106, Florida Statutes, as amended
from time to time.
(g) Unincorporated association means any group of natural
persons formed for a common purpose or objective.
(h) Unopposed candidate shall have the meaning given to such
term in Section 106. 011 (15) , Florida Statutes, as
amended from time to time.
SECTION 3 . That Section 12-4, entitled "Campaign contribution limits
and prohibited contributions, " of the Code of Ordinances of
the City of Fort Lauderdale, Florida is hereby created as follows :
Sec. 12-4 Campaign contribution limits and prohibited
contributions .

(a) It shall be unlawful for any natural person, either
directly or indirectly, to make contributions to
any candidate with respect to any election for the
office of mayor-commissioner or city commissioner,
which, in the aggregate, exceed $250 .00 .
(b) It shall be unlawful for any candidate or other natural
person to knowingly accept or receive any campaign
contribution prohibited by this section.
(c) The contribution limitations of this section apply to
each election conducted to fill a particular
office. Each primary, special and general
election are separate elections provided the
candidate is not an unopposed candidate.
(d) No contribution shall be made to any candidate with
respect to any election for the office of mayor-
commissioner or city commissioner, except by a
natural person. It shall be unlawful for any
entity or organization listed below to make a
contribution in connection with any primary,
general, or special election held to select
candidates for mayor-commissioner or city
commissioner, or for any candidate or other person
to accept or receive any contribution prohibited by
this section, or any officer or director of any
entity or organization below to consent to any
contribution by the entity or organization, as the
case may be, prohibited by this section:
(1) any corporation, corporation not for profit,
partnership, limited partnership, limited
liability partnership, association
cooperative, joint venture, business trust,
limited liability company, professional
service corporation, or sole proprietorship
organized under the laws of the State of
Florida or any other state or foreign country,
and as defined in Florida Statutes;

(2) any bank or financial institution organized or
doing business under the laws of the United
States, the State of Florida or any other
state;
(3) any labor organization or union;
(4) any political committee or political action
committee;
(5) any committee of continuous existence;

SECTION 4 . That Section 12-5, entitled "Penalties, " of the Code of
Ordinances of the City of Fort Lauderdale, Florida is
hereby created as follows:
Sec. 12-5 Penalties .
Any candidate, natural person, entity or organization who
violates, permits to be violated or causes to be violated
any provision of this chapter shall, upon such a finding by
a court of competent jurisdiction, be assessed a civil fine
in an amount not to exceed five hundred ($500 . 00) dollars
per violation.
SECTION 5 . That if any clause, section or other part of this Ordinance
shall be held invalid or unconstitutional by any court of
competent jurisdiction, the remainder of this Ordinance shall not be
affected thereby, but shall remain in full force and effect.

herewith, be and the same are hereby repealed.

be designated on the agenda for citizens and interested persons to speak on matters not scheduled on that day's agenda. The
citizen comments' period shall begin promptly at 7:30 PM. Each speaker shall be limited to 3 minutes for his or her comments.
Persons desiring to speak during the citizen comment period shall inform the City Clerk immediately prior to the beginning of the
meeting of their intention to speak. If more than 10 speakers express a desire to speak, the Commission shall determine on a
meeting by meeting basis whether to (a) extend the time allotted for citizen comments to accommodate all speakers, or (b)
whether to limit the number of speakers or amount of time per speaker. A speaker's time shall not be transferable to another
speaker.
