AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, CREATING SECTION 2-16 OF CHAPTER 2, ENTITLED
"ADMINISTRATION", OF THE CITY CODE OF ORDINANCES TO
REQUIRE SUBMISSION TO THE CITY COMMISSION FOR ADVANCE
APPROVAL OF CAPITAL PROJECTS AND PURCHASES WHERE
BIDDING OR WAIVER OF BIDDING IS EXPECTED TO BE SOUGHT BY
THE CITY AND THE COMMUNITY REDEVELOPMENT AGENCY
("CRA"); PROVIDING FOR SEVERABILITY; PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA,
FLORIDA:
Section 1. That Section 2-16, entitled "Advance City Commission Approval of
Purchases Involving Bidding", of Chapter 2, entitled "Administration", of the City Code of
Ordinances is created to read as follows:
Sec. 2-16. Advance City Commission Approval of Capital Projects and Purchases
Involving Bidding.
The CRA and all City departments, divisions and City staff, prior to incurring costs or
placing an item on a City Commission or CRA agenda for formal City Commission or CRA
approval for competitive bidding or for waiver of bidding, shall obtain advance City Commission
or CRA conceptual approval by Resolution of any proposed capital project or capital purchase
appropriated in the City or CRA budget approved by the City Commission when bidding would
otherwise be required (i.e., matters anticipated to cost $25,000.00 or more), for any of the
foregoing matters. This Resolution shall also identify all sources of planned funding including
appropriations of available cash balances, loans and grants.
Section 2. That if any section, clause, sentence or phrase of this ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this Ordinance.
Section 3. That all ordinances or parts of ordinances in conflict with the provisions of
this Ordinance are repealed to such extent of the conflict.
Section 4. That this Ordinance shall take full effect immediately at the time of its
passage and adoption.
