All of the issues regarding the landscaping project have everything to do with the fact that Dania Beach is the oldest city in Broward County and our infrastructure is still in the process of being upgraded. In order to have a successful project, we will have to address our existing water-lines which are at various depths; electrical conduits for the light poles which we recently discovered were owned by the City of Dania Beach and other conflicts in the field which have only recently been brought to light by actually digging test holes for the landscaping. Please review the memo and resolution which has been issued by the Public Services Director,Mr. Orlando that outlines the exact request. Any delay at this stage would mean that the project would immediately be delayed by over a month. I recommend approval. Please let me know if you have any questions. Director of Public Services Date: October 5, 2011 RE: US-1 Landscaping Phase I Project-Additional Cost to Relocate Existing Street Lighting Conduits and Water Mains Due to Conflicts with Proposed Landscaping Introduction and Background The US-1 Landscaping Project has been under construction since July of this year. . During that period of time the City and CRA have worked with the contractor to remedy various issues that have arisen including items related to maintenance of traffic (MOT). Over the past few weeks the Contractor, Green Construction discovered numerous conflicts in the field that also require prompt attention. The Contract requires Green Construction q o struction to check and confirm location of existing utilities and t inform 0 in o m Engineer and City ASAP of any potential conflicts. During construction Green Construction performed soft digs and confirmed conflicts with existing street lighting conduits and water mains at several locations. Another newly discovered conflict has to do with gas line that no one including the utility company TECO knew existed. Almost all of these issues stem from the fact that we are an old City and do not have records of existing facilities, however if these issues are not addressed immediately then the US-1 Landscaping Project would be in jeopardy. The Contract Drawings show existing utilities in the areas where the new landscaping is proposed. The Engineer assumed the existing utilities were installed according to present design standards that require a minimum of 24" of cover over the electrical conduits and minimum of 36" of cover over the water mains. The soft digs revealed cover was less than present design standards. f City of Dania Beach Department of Public Services West Dania Beach Blvd•Dania Beach,FL 33004 -(954)924-3741 •(954)-923-1109(fax) The ursery informed Green Construction that the root ball on the Medjools will be 42" Deep and 36" Round. Based on this information conflicts exist with proposed locations of all the Medjools, approximately 16 locations. Several meetings were held with Green Construction. The CRA Executive Director asked if the Public Services Department (PSD) could address relocating the existing utilities in-house. The PSD could address relocating the water mains but not the electrical conduits due to the fact a licensed electrician would need to do this work. Green Construction submitted a cost proposal to replace the entire length of conduit by directional boring of new conduits under the sidewalk at a cost of$121,000. Green Construction only considered this option and did not want to entertain relocating sections of conduit to avoid the interferences. PSD initial estimate to relocate the water mains to avoid interference with Medjools was approximately $15,000. A meeting was held on Monday October 3, 2011 with the CRA Executive Director, the City's Consultant, City's Project Manager and Public Services. At this meeting the City's Consultant confirmed that the other proposed landscaping also interferes with the existing water main. Public Services offered other options for discussion. Prior to this meeting Public Services asked R&R Electric a Contractor presently working for City on other Projects to submit a cost proposal to relocate electrical conduit around the landscaping. Preliminary discussions with R&R Electric indicated that they may be able to do this work for about$15,000 and complete the work in 4-5 days. After the meeting we contacted R&R Electric again to submit a revised quote to relocate entire sections of conduit. Their preliminary estimate is about$30,000 and they would be able to do the work in less than 2 weeks. They are preparing and finalizing their quote. Public Services' is revising our initial estimate for materials and equipment cost to reflect relocating entire sections of water mains in- house. Preliminary estimated cost is approximately $30,000. To avoid further delay and expedite a resolution to the conflict, Public Services' is recommending that the electrical conduits be relocated by R&R Electric for a not to exceed cost of$30,000. Also, that the City Commission approves an additional$30,000 for material cost to have Public Services replace the existing water mains in-house with City Staff. Total additional cost to address the conflicts with existing utilities is $60,000.00. The Finance Director indicated that we have a remaining approved budget appropriation for Phase I of the US-1 Landscaping Project of about-$175,000 (-$704,000 has already been committed from the Commission approved funding of-$879,000). Estimate of needed Phase I change order costs$60,000 as noted above - coupled with estimated cost of Phase II - will be the amount of additional funding that will be needed for the completion of both these Projects (Phase I and II). The CRA Executive Director should provide estimated cost for Phase II. Recommendation It is recommended that the City Commission approve the additional funding of$60,000 required to address the conflicts with existing utilities, allow City Staff to proceed as stated above and authorize the City Manager to execute the documents. RESOLUTION NO. 2011-123 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE USE OF APPROPRIATED CAPITAL PROJECT FUNDS IN CONNECTION WITH THE US-1 LANDSCAPING PROJECT IN AN AMOUNT NOT TO EXCEED $30,000.00; WITHOUT COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Manager has determined that it is necessary to provide services for relocation adjustments to the water main on US 1 to accommodate the US-1 Landscaping Project to provide adequate area for the projects' plantings ; and WHEREAS, the work for some parts of the project can best be done with the use of in- house staff and equipment; and WHEREAS, there are other costs associated including part purchases from vendors under the S.E. Co-op Program that may include installation which cost amount will not exceed $30,000.00; NOW, THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City Manager is authorized and directed to procure necessary parts and installation from the S.E. Co-op Program specifically for the US-1 Landscaping Project that may include installation without competitive bidding in an amount not to exceed$30,000.00. Section 2. That funding for this procurement shall be provided for this expenditure from available US-1 Landscaping Project Fund appropriations in the amount of$30,000.00. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection 0), provides that during unusual conditions or emergencies, the City Commission may, by resolution, authorize the purchase by the City Manager of designated supplies, services, equipment and materials in amounts in excess of Twenty Five Thousand Dollars ($25,000.00) without competitive bids and without advertisement for bids; and WHEREAS, the City Manager has determined that it is necessary to immediately obtain electrical services for the US-1 Landscaping Beautification Project so as to avoid delays and impacts on other areas of this Project; and WHEREAS, the City Manager has determined that such services can be provided by R&R Electric of Broward Inc. for the most competitive pricing; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City Manager is authorized and directed to procure electrical service work specifically for the US-1 Landscaping Project from R&R Electric of Broward Inc. without competitive bidding for an amount not to exceed $30,000.00. Section 2. That funding for this procurement shall be provided for this expenditure from available US-1 Landscaping Project Fund appropriations in the City's approved Capital Projects Fund—US-1 Landscaping in the amount of$30,000.00. WHEREAS, the City of Dania Beach and Broward County propose to execute a Settlement Agreement which is intended to resolve a dispute and litigation existing between the parties related to the proposed construction of a new south runway at Fort Lauderdale- Hollywood International Airport; and WHEREAS, as a part of the Agreement, the City agrees to cooperate with the County to effectuate the transfer of certain lands referred to as "Plats 7 and 8" (as such lands are legally described in Exhibit "A, a copy of which is attached to this Resolution and incorporated by this reference)pursuant to Section 125.38, Florida Statutes; and WHEREAS, the City represents to the County that the lands are to be acquired "for public or community interest and welfare", as prescribed by the law identified above; NOW THEREFORE, BE IS RESOLVED THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City of Dania Beach, Florida adopts this Resolution evidencing the application of the City of its request for conveyance to the City of Dania Beach by the Broward County Board of County Commissioners of parcels known as Plats 7 and 8 as further described in Exhibit "A" (attached to this Resolution and incorporated into and made a part of it by this reference) in connection with a Settlement Agreement proposed to be executed by the City and Broward County related to litigation existing between the parties in connection with construction of a new south runway at Fort Lauderdale-Hollywood International Airport, such application being authorized by Florida Statutes, Section 125.38. Section 2. That the City Manager and City Attorney are authorized to submit written documentation to Broward County with respect to the requested conveyance, to include a certified copy of this Resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4.
