Call to Order/Roll Call Mayor Flury called the meeting to order at 7:00 p.m. Present: Mayor: Patricia A. Flury Vice-Mayor: Bobbie Grace Commissioners: Anne Castro Walter Duke C. K. Invocation and Pledge of Allegiance Deacon Leroy Green, Mose Holy Church, gave the invocation followed by the Pledge of Allegiance to the United States Flag. 9. Public Hearings and Site Plans 9.1 ORDINANCE #2011-031 Continued from October 3, 2011 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A SETTLEMENT AGREEMENT IN COMPLIANCE WITH CITY CHARTER REQUIREMENTS, WITH BROWARD COUNTY, FLORIDA, RELATED TO LITIGATION EXISTING BETWEEN THE PARTIES IN CONNECTION WITH CONSTRUCTION OF A NEW SOUTH RUNWAY AT FORT LAUDERDALE-HOLLYWOOD INTERNATIONAL AIRPORT; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (SECOND READING) (Continued from October 3, 2011) Neal McAliley, Airport Special Counsel, provided an overview of the Airport Settlement Agreement and recommended that the Commission approve it. He pointed out that the residents get choices but they do not have to agree to anything; nothing takes their rights away. Attorney McAliley further advised that, as part of the Settlement Agreement, the City will get the transfer of plats 7 and 8 and the parcels are to be acquired for public or community interest and welfare. Furthermore, the land acquisition will put properties back on the tax roll which is important for the redevelopment of the City. Mayor Flury opened the Public Hearing. Mark LaRocca, 4511 SW 34th Avenue, Airport Advisory Board, spoke in favor of the Settlement Agreement. Robert Del Chiocca, 734 NW 12th Avenue, noted he lives in the 64 DNL and will not be eligible to any benefits for the diminished value of his property. He said he is very disappointed in how this played out. Mr. Del Chiocca said if the proposed Agreement is not approved by the County and the FAA, he suggests the City renegotiate an agreement that makes everybody whole. Rae Sandler, 810 NW 7th Avenue, noted it is unfortunate that we could not delay this issue anymore; however, she is proud of what we have accomplished for the residents of Dania Beach. Ms. Sandler stated that we are not finished fighting this Airport expansion. Bob Mikes, 601 NW 7th Street, noted that when Broward County chose the South Runway Expansion of the Airport, they selected the worst choice for human impact from all the seven options being discussed. He said that the City did the right thing. This shows how much we can rely on the County to keep their promises. Mr. Mikes stated that this does not solve the problem; the County will be back in litigation after they open the runway because they did not deal with it right now. Seeing as there was no one else to speak in favor or opposition, Mayor Flury closed the Public Hearing. City Attorney Ansbro read the title of Ordinance#2011-031. Commissioner Castro introduced Jesse Diner, mediator during the Airport negotiations. Jesse H. Diner, attorney, noted he was asked by both Broward County and the City to be the mediator in the negotiation. He recognized the efforts put forth by the City's representatives and how tenaciously they negotiated this matter on behalf of the City. Attorney Diner further spoke about the validity of the process. Lastly, he remarked that everything that was possible to be negotiated, was negotiated. Commissioner Castro wanted everyone to understand the negotiation process. She reiterated that this is not over, there is more to be done. Commissioner Castro motioned to adopt Ordinance #2011-031, on second reading; seconded by Commissioner Duke. Commissioner Castro motioned to adopt Resolution 42011-125; seconded by Commissioner McElyea. Presentations and Special Event Approvals 3.1 Presentation by Dania Beach Improvement Committee for a Street Clock Tim Ryan, Dania Beach Improvement Committee, requested the Commission fund one third of the cost($7,500.00) for a Street Clock that would be located at the eastern end of the landscaping median in front of the Paul DeMaio Library in the City Center. He requested Commission approval to contribute toward the clock. Mr. Ryan noted that the CRA Director has concerns with the proposed location. He further stated that if the location of the clock presents a problem in the future, the Commission will have authorization from the Committee to move it to another site. Vice-Mayor Grace does not think the clock should be placed now and moved later. She said staff should select the appropriate location. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,October 11,2011 —7:00 p.m. 7 Jeremy Earle, CRA Executive Director, explained that staff is concerned that the overall design of the area did not include a clock at this location. He noted that they like the clock but they would like to work with the Improvement Committee to find a suitable location. Commissioner McElyea noted that he is a member of the Improvement Committee and likes the project. He suggested placing the clock on the US 1 Highway entryway. Director Earle confirmed if the roadway is not completed by May 31, 2012, we will lose the funding from the County. Commissioner Castro is in favor of the Street Clock. She agreed that it could be placed temporarily at the suggested location and moved at a later date. Commissioner Castro motioned to accept the Street Clock donation from the Dania Beach Improvement Committee, to allocate $7,500.00 from General Contingency Fund, and for staff to find a location for the Clock; seconded by Vice-Mayor Grace. Proclamations There were no proclamations at this meeting. 6. Public Safety Reports Donn Peterson, BSO Chief of Police, noted burglaries are up throughout the State of Florida; he asked everyone to lock up their valuables. Charles Raiken, Deputy Fire Chief of Administration, BSO Fire Rescue, commended staff on their efforts for the rain event over the weekend. 5. Citizen Comments Mark LaRocca, 4511 SW 34th Avenue, noted they are having problems with code enforcement out west. He said they need help out there and requested more police patrols. 7. Commissioner Castro motioned to adopt the Consent Agenda, with the addition of Item #7.5 and Item #7.6; seconded by Vice-Mayor Grace. Bids and Requests for Proposals There were no proposals on this agenda. 10. Discussion and Possible Action 10.1 Discussion and possible action concerning outsourcing Code Compliance — Commissioner McElyea Commissioner McElyea opined that both Code Compliance and the Building Department should be outsourced. He thought this would represent savings to the City. Mayor Flury noted we currently outsource Building Services through Broward County. Commissioner McElyea requested that we reconsider outsourcing Building Services. Commissioner Castro recommended the City Manager look at outsourcing Code and Building Inspection Services together. Vice-Mayor Grace commented that we need to consider outsourcing the Managers and Department Heads as well. She is not in favor of outsourcing any department. Commissioner Duke said we should look at outsourcing legal because we have a tremendous legal budget in the City and other cities are doing it. He thinks we should not outsource the Code Department at a time when we are redeveloping our City, and a lot of properties need to be cleaned up. Commissioner Duke pointed out that we looked at this option a couple of years ago, and these are issues we should take up during budget meetings. He noted that Code has been helpful at introducing policies and coordinating with BSO. Commissioner Castro noted that Commissioner McElyea has brought up an interesting point of outsourcing a bigger division (Building and Code). She is curious to see pricing and what new technologies other companies may offer. Commissioner Castro thought there was no harm in looking for alternatives. Mayor Flury noted she was disappointed at the last meeting when we did not award the bid for Building Services to a private company, as opposed to continue using Broward County. Commissioner Castro motioned to ask the City Manager to prepare Letters of Interest for Building Inspection and Code Enforcement Services; seconded by Commissioner McElyea. Commission Comments 11.1 Commissioner Castro Commissioner Castro referred to the CRA request for an additional $100,000.00 for the Neighborhood Improvements Program. She asked Director Earle for an explanation. City Manager Baldwin noted the money would come from General Fund Contingency. He said the budget for Contingency is $600,000.00 for the year. City Manager Baldwin further clarified that the Undesignated Fund Reserve is $13M, with $3M designated to SRF funding. He advised that $1-2M may be needed for other funding. City Manager Baldwin will provide a monthly report to the Commission. Director Earle provided the history of the CRA Neighborhood Projects. He explained that we did not receive any bids in September for two of the projects, as described in a Memorandum to the City Commission which is attached to and incorporated into these minutes. Director Earle noted that the CRA Board had already authorized the amount of$750,000.00 for these projects. Based on their final negotiations with Straightline Engineering, he asked the Commission to approve the amount of $850,000.00 to move forward with Phases I and II of the Sun Garden Isles and College Gardens projects. Commissioner Duke motioned for the CRA Director to execute a contract with Straightline Engineering in the amount of$850,000.00; seconded by Commissioner Castro. The motion carried on the following 5-0 Roll Call vote: Commissioner Castro Yes Vice-Mayor Grace Yes Commissioner Duke Yes Mayor Flury Yes Commissioner McElyea Yes City Attorney Ansbro clarified that Director Earle will have the CRA Board ratify this approval at their next meeting. Commissioner Castro noted that the Griffin Civic Association is looking for additional handicap parking spaces at Meli Park. She spoke with Corinne Lajoie, Principal Planner, who advised staff will do an analysis to ascertain whether we would still meet our parking standards by adding a couple of handicap parking spaces. She further noted that the neighbors requested additional solar lighting in the alleyways among SW 13, 14 and 15 Streets. Commissioner Castro asked Public Services Director Orlando to evaluate and report back to the Commission. Dominic Orlando, Director of Public Services, commented on the water issue at the Water Plant. He noted that two samples were taken, however, there were no issues with the water. Director Orlando advised that the public needs to be notified within 90 days. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,October 11,2011 —7:00 p.m. Commissioner Castro commended City staff for doing an outstanding job with the rain event this past weekend. She further noted that there was a drainage problem on SW 35 Avenue and Stirling Road, on the Hollywood side. Commissioner Castro asked Director Orlando to notify the City of Hollywood of this situation. Commissioner Castro recognized Dan Stubbs, in the Public Services Department, as her Employee of the Month. Commissioner Castro advised that there is one street in the Playland area that does not have solar lighting. She noted it is either SW 42 or SW 43 Street. Director Orlando noted that certain residents in that area did not want solar lighting. He said if that is the will of the residents now, staff will address the issue. Commissioner Castro noted she attended the Broward County Climate Change Task Force where they discussed water issues. She asked everyone to pay attention to any water reports and conserve water whenever possible. Commissioner Castro spoke about the Broward County Planning Council. She asked staff to look at the information provided to Community Development Director Daniels and let her know their findings in order to be prepared for the upcoming Planning Council meeting. Commissioner Castro wanted to make sure we are moving forward with losing some of the billboards on Stirling Road and Griffin Road. City Attorney Ansbro noted he is working on this matter. Commissioner Castro noted that the South Florida Regional Transportation Authority is holding a "Rail Fun Day" at the Dania Beach Tri-Rail Station on October 29, from 11:00 a.m. to 3:00 p.m. She encouraged parents to bring their children to this family fun event. Commissioner Castro spoke about the Airport issue. She noted this was not an easy vote; however, she wants everybody to know that we did the best we could. This is just the beginning and there is more that can be done. Commissioner Castro thanked the Commission and City staff for their support during this process, as well as the residents of Dania Beach for their patience and understanding. 11.2 Commissioner Duke Commissioner Duke had no comments. 11.3 Commissioner McElyea Commissioner McElyea discussed the solar lights in the southeast area between Park Road and Dania Beach Boulevard. He further noted several lights are out throughout the City. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,October 11,2011 —7:00 p.m. Commissioner McElyea thanked the Public Services staff for taking care of the flooding situation in the southeast area. 11.4 Vice-Mayor Grace Vice-Mayor Grace thanked everyone who attended the Relay for Life Kickoff. She noted the event will be held at Frost Park, March 23-24, 2012. Vice-Mayor Grace noted the residents on NW 11, 12, 13 and 14 Avenues asked for more solar lighting in their neighborhood. She asked Public Services Director Orlando to look into this matter. Vice-Mayor Grace thanked staff for keeping our residents safe during the recent rain event. 11.5 Mayor Flury Mayor Flury asked staff for the schedule for solar lighting. City Manager Baldwin noted a recommendation for solar lighting will be presented at the next meeting for Commission approval. Mayor Flury invited everyone to join St. Ruth Missionary Baptist Church at their "Laps for the Cure"walk on Saturday, October 22. 12. Appointments There were no appointments at this meeting. 13. Administrative Reports 13.1 City Manager City Manager Baldwin thanked staff for their hard work on the flooding issues. City Manager Baldwin noted that Carole Duncanson, Lobbyist, and Representative Evan Jenne would like to meet individually with the Commissioners on Monday, October 24, between 3:00 - 5:00 p.m. They want to brief the Commission on upcoming items for the Legislative session. Commissioner Duke asked City Manager Baldwin to prepare a list of items for the Commission to review prior to their meetings. City Manager Baldwin noted some of the items that will be discussed at his upcoming meeting with the County Administrator. He asked the Commission if they had any issues they would like him to bring to the County for discussion. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,October 11,2011 —7:00 p.m. City Manager Baldwin noted he will meet individually with the Commissioners to discuss our Collective Bargaining issues and the possible increase in the Pension contribution. City Manager Baldwin reported that since taking over the Pier operation in July, the City has collected $93,000.00 in revenues. He further noted that the Parking revenues have exceeded budget by 37%. City Manager Baldwin thanked staff for getting the situation under control. 13.2 City Attorney City Attorney Ansbro noted David Nicholas, our consultant for the Pier Restaurant, said we should use a broker for the restaurant. Commissioner Duke questioned if we could retain Mr. Nicholas on an hourly basis, to act as our broker. He thought we had agreed to advertise for the Letters of Interest first and added that he is confident there will be a lot of interested people. If we do not receive any, we can discuss the possibility of retaining a broker. Commissioner Duke remarked he does not think we are there yet. Mayor Flury agreed with the consultant and further noted that if we are looking for corporate people, we should do this right. Commissioner Castro questioned the cost of obtaining a broker. City Attorney Ansbro noted it would cost approximately $50,000.00. Commissioner Duke noted the cost of a broker would be 3-6% of the commission. Commissioner Castro recommended asking the consultant to get the cost for a broker, with options. Commissioner Duke noted that on this initial phase, the consultant is fully capable of handling this matter for us. This was after the CRA had advertised both projects for bid, but we did not get any submittals. After some very tough negotiations and many meetings and phone calls between all parties including Public Services, I am pleased to announce that we have been able to reduce the cost of the project from in excess of a million dollars to$850,000 for both projects. This means that we would be$100,000 dollars over the amount of$750,OOO.that you as the CRA Board authorized me to sign off on. After contacting multiple companies who were listed on the Broward County Approved list,and receiving quotes from one of them, I also contacted Straightline Engineering Inc.,who previously did work for the city on the Oasis project as well as SE 5th Ave. After much review of scope and numbers and quite a bit of discussion with staff,the company that I have selected to work on both neighborhood projects is Straightline Engineering Inc. Based on your previous desire as the CRA Board to have me execute a contract in order to move these projects forward, I would now like to request that you as the City Commission authorize me to enter into a contract with Straightline Engineering Inc., so that we can begin the neighborhood projects as soon as possible. I believe that this is within your purview as the City Commission due to the fact that the city will be contributing funds to the projects as well. At the next CRA Board meeting however, I will ask for a motion for the additional amount listed above. The only portion of this project for which we do not have solid numbers is the cost of the design for the roundabout at the intersection of SW 2"d Ave and W. Dixie Hwy. I am still in the process of negotiating with an engineering firm to design it and provide a construction cost estimate. Please let me know if you have any questions.
