Call to Order/Roll Call Mayor Flury called the meeting to order at 7:00 p.m. Present: Mayor: Patricia A. Flury Vice-Mayor: Bobbie Grace Commissioners: Anne Castro Walter Duke C. K. "Mac"McElyea City Manager: Robert Baldwin City Attorney: Thomas Ansbro Deputy City Clerk: Miriam Nasser 2. Invocation and Pledge of Alle igjaj c Father Roger Houloubek, St. Maurice Catholic Church, gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals There were no presentations on this agenda. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Ann Page, 38 SW 5 h Street, noted the 1st Annual Walk for the Paul DeMaio Library, sponsored by Friends of the Library, will take place on Saturday, January 21, from 8:00-11:00 a.m. At the conclusion of the Walk, there will be a full day of children's programs at the Library. She invited everyone to attend this community event. Ms. Page asked for the City to assist with providing a 4-hour police coverage for the event, at $60.00 per hour. Mayor Flury suggested Ms. Page contact City Manager Baldwin on this matter. Carolyn Jones, 722 SW 3rd Street, noted the Martin Luther King, Jr. event will be on Monday, January 16. She invited everyone to attend and be a part of this event. Ms. Jones thanked the MLK Committee for their assistance and support. Vice-Mayor Grace asked if the amount allocated for the breakfast would be enough. Ms. Jones noted this year they are not having a banquet since they want to save money to provide a scholarship in the name of Dr. Martin Luther King, Jr. and the City of Dania Beach. Victoria Payne, Executive Director, Dania Beach Chamber of Commerce, provided an update of upcoming Chamber events. She further noted all events are listed on both the City and Chamber Websites. George Jason, 4549 SW 37th Avenue, noted his challenge for the New Year is that we keep this City together. He advised that Dania Beach Neighborhoods United is inviting all condo associations or geographic neighborhood groups in the City to become a member of their council. Mr. Jason added they are waiving all membership fees for those who are interested. Chickie Brandimarte, 101 SE 3rd Avenue, noted there is no lighting in the alley behind Paolo's Restaurant, and asked the City to look into this matter. John Bartley, 201 SE 2nd Avenue, spoke about the high cost of impact fees. He distributed copies of a Development Review Fee Statement, which is attached to and incorporated into these minutes. Mr. Bartley noted that Broward County charges $6,878.00 and the City charges $11,637.00, for a total cost of approximately $18,515.00 for a single family house. He remarked that no one would be willing to build a house in Dania Beach. Mayor Flury suggested he discuss the matter with City Manager Baldwin. 6. Public Safety Reports Donn Peterson, BSO Chief of Police, described a recent incident where Detective Carlos Salazar was involved, and recognized him as the December BSO Deputy of the Month. Commissioner Duke noted he recently visited the new police station and said that it is one of the nicest units in Broward County. He thanked Chief Peterson and his staff for keeping the residents of Dania Beach safe and for doing a great job. Commissioner Castro asked Chief Peterson to bring Detective Tarrant's replacement and introduce her to the Commission and the citizens of Dania Beach. Chief Peterson noted he plans to present Detective Connie Bell to the community at the next Commission meeting. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,January 10,2012—7:00 p.m. Vice-Mayor Grace noted she recently worked with some BSO officers and she thanked them for everything they do for the citizens of Dania Beach. Charles Raiken, Deputy Fire Chief of Administration, BSO Fire Rescue, said they will be celebrating the first anniversary of the Fire Department merger with BSO on January 29. 7. City Attorney Ansbro read the title of Resolution#2012-004. Commissioner Castro confirmed that the contract with this company includes the extra maintenance of new landscaping throughout the City. She asked staff to look for other types of plantings to be placed along the ramp on I-95 and Griffin Road, since the current ones are costly and difficult to maintain. Commissioner Castro further commented that a dead palm at the junction of Old Griffin Road and Griffin Road should be removed. Commissioner Duke requested that the Commission receive a list of the maintenance areas to be included in the bid packet prior to its release, because they may have additional areas to include in the bid document. Commissioner Castro motioned to adopt Resolution #2012-004; seconded by Vice-Mayor Grace. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,January 10,2012—7:00 p.m. City Attorney Ansbro read the title of Resolution#2012-007. Mayor Flury questioned why we have to pay more for this project. Colin Donnelly, Assistant City Manager, noted the original contract did not include construction management; only permitting and design work. He advised that they are not looking for additional services and the work is almost done. Assistant City Manager Donnelly clarified that Calvin Giordano and Associates proceeded with the job because they knew we were going to validate this agreement. Mayor Flury noted we are slow with some contracts. She pointed out that when we issue a contract it should be complete. Corinne Lajoie, AICP, Principal City Planner, provided an overview of the zoning map amendments within the Regional Activity Center. She noted that these properties are located within the CRA. Ms. Lajoie explained each of the areas included in the proposed rezonings and the additional permitted uses that would be allowed in some areas. She clarified that the St. Ruth's Missionary Baptist Church property would not be affected by the rezoning. Ms. Lajoie advised that the Planning and Zoning Board, as well as the Community Development Director and CRA Director, recommend approval of the request because of the consistency with the CRA Redevelopment Plan. Commissioner Duke thanked the Community Development staff for recognizing the needs of the residents and local businesses in Dania Beach. Mayor Flury opened the Public Hearing. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,January 10,2012—7:00 p.m. 9.5 RESOLUTION #2011-146 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE VARIANCE REQUEST SUBMITTED BY ATTORNEY ROD FEINER ON BEHALF OF BROWARD CASTING FOUNDRY, INC., FROM THE UNIFIED LAND DEVELOPMENT CODE, PART 1, "USE REGULATIONS", SECTION 115-40, "SCHEDULE OF PERMITTED USES" AND PART 2, SECTION 265-170, "NONCONFORMING PARKING FACILITIES", FOR PROPERTY LOCATED AT 2240 SW 34TH STREET, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (Continued from December 13,2011) City Attorney Ansbro read the title of Resolution#2011-0146. Corinne Lajoie, AICP, Principal City Planner, explained the applicant is requesting parking and landscape variances. She provided an overview of the project. Ms. Lajoie noted that this item was continued from the December 13, 2011 meeting to allow time for the applicant to deal with some code violations which are now in compliance. Staff recommends approval of the request. Mayor Flury opened the Public Hearing. Rod Feiner, Law Offices of Coker & Feiner, representing Broward Casting, noted all code violations have been addressed. He pointed out that the storage area is screened from adjacent property by existing buildings. In addition, the proposed storage area is screened from the rear because the rear of the property is owned by Broward County and it is being used for Airport clearance areas. Attorney Feiner thanked the Community Development staff for doing an excellent j ob. Commissioner Castro noted we are currently in negotiations with Broward County regarding the Airport expansion and part of the settlement calls for some of these parcels to convert back to the tax rolls. She would like a condition to be added to the approval that if the property is eventually utilized the storage container would need to be screened and blocked. Commissioner Duke noted he has the same concerns as Commissioner Castro. Attorney Feiner agreed to install a fence in the eventuality that someone purchases the property. Commissioner Castro motioned to adopt Resolution #2011-146, subject to construction of a solid fence to visually screen the outdoor storage upon development on the property south of the application site; seconded by Commissioner Duke. She provided an overview of the project. Ms. Lajoie noted Cruise.com is planning to relocate its headquarters to Dania Beach in the space previously occupied by the Broward County Library. She indicated that they currently have approximately 80 employees and the new location will allow the company to grow and hire additional staff. The property is located in the CRA and the request has the support of the CRA Director. Ms. Lajoie noted that staff recommends approval of the request. Commissioner Duke confirmed that in addition to the internet website, the company is planning to expand their retail portion of the business. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,January 10,2012—7:00 p.m. Mayor Flury opened the Public Hearing. Chickie Brandimarte, 101 SE 3`d Avenue #604, noted this would be a great asset to the City and asked the Commission to approve the request. Victoria Payne, Chamber of Commerce, asked for approval of the request. Jeanne Wyndrum, representing Cruise.com, noted they are excited to come to Dania Beach. Commission Comments 11.1 Commissioner Castro Commissioner Castro commented the Florida Department of Transportation (FDOT) painted the Melaleuca wall. She thanked City Manager Baldwin for his efforts to get this accomplished, and requested some plantings be placed around the wall. Commissioner Castro noted she had an interesting meeting with FDOT regarding landscape maintenance and other important City issues. In addition to finding out that they were supposed to be maintaining the landscape at certain ramps within the City, Commissioner Castro asked FDOT to put a monument sign on the corner of Griffin Road and I-95 to identify Dania Beach. Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,January 10,2012—7:00 p.m. She advised that FDOT owns that corner lot and they are willing to annex or transfer it to the City. Commissioner Castro asked for consensus to direct the City Manager to pursue this matter with Jim Walton, FDOT, District IV. The Commission agreed with Commissioner Castro's request. Commissioner Castro further commented that the stormwater problems in the western portion of the City were also discussed with FDOT. She asked City Manager Baldwin to follow up on the possibility of obtaining some funding that may be available to the City. Commissioner Castro provided an update on the Airport issue, and noted that we have not heard anything from the Federal Aviation Administration(FAA). Commissioner Castro commented on the National Council of Legislators from Gaming States (NCLGS) Conference she recently attended. She noted she met with representatives of Boyd Gaming but they did not provide a lot of information. Commissioner Castro pointed out that the gaming license may bring us problems and revenue. She urged the Commission to hire counsel to advise the City on this matter. Commissioner Castro asked for consensus to have City Manager Baldwin find a special counsel to represent the City in Tallahassee for this specific subject. Mayor Flury noted that this issue is very uncertain. She indicated that we already have Carole Duncanson and did not think another special counsel would be necessary. Mayor Flury questioned what type of control we would have if someone tried to buy the license from Boyd Gaming. Commissioner Castro noted portability of the license is the important thing. Mayor Flury asked if we want to hire a lobbyist other than Carole Duncanson to take care of this matter. Commissioner Castro clarified that she does not want a lobbyist; she wants a special counsel in Tallahassee who can determine whether or not they can take the license out of the City, and if we are entitled to any compensation. She emphasized she would like to do it this year. It was the consensus of the Commission to direct City Manager Baldwin to look for a special counsel and report back to the Commission. City Manager Baldwin noted Steve Geller, Chairman of the NCLGS, will provide names. 11.2 Commissioner Duke Commissioner Duke referred to George Jason's comments regarding unity in our City. He noted we will be facing a lot of challenges and expressed his commitment to work with his fellow Commissioners to move the City forward. He noted they are very enthusiastic and excited to be in our City. City Attorney Ansbro noted the Broward County Ethics Law came into effect on January 2, 2012. He advised he will schedule a training session for the Commission and City Staff regarding the new provisions before the end of the month. City Attorney Ansbro asked the Commission to contact him for advice prior to any meetings with contractors, lobbyists or vendors. City Attorney Ansbro discussed the pending actions regarding Dania Jai Alai. He clarified that Citizens for Responsible Development, Inc. have not yet served the City with the lawsuit. City Attorney Ansbro indicated that their attorneys have requested a 120-day extension on the time to serve the lawsuit and asked the Commission for their opinion.
