1. Call to Order/Roll Call
Mayor Flury called the meeting to order at 7:00 p.m.

Commissioner Castro gave the invocation followed by the Pledge of Allegiance to the United
States Flag.
3. Presentations and Special Event Approvals
3.1 Special Event request from Jason and Kim Wenig of the Creative Workshop, to host
an Ebay, Inc. "Cocktail Party Gathering", on Tuesday, February 7, 2012 from 7:00
p.m. — 10:00 p.m. at The Creative Workshop, located at 118 Hill Street
Commissioner Castro motioned to approve the Special Event request for the Cocktail
Party Gathering; seconded by Commissioner Duke. The motion carried on the following 5-
0 Roll Call vote:

5. Citizen Comments
Ann Page, 38 SW 5th Street, noted the 0 Annual Walk for the Paul DeMaio Library last
Saturday was a great success. She introduced Alison Vasquez the 6-year old girl who won the
contest for the T-Shirt Program Art Work. Ms. Page asked if the City would proclaim the
Saturday after the Martin Luther King, Jr., birthday celebration as an Annual Walk Day for the
Library. She thanked everyone for supporting our Library.
Frances Tyler, 361 East Sheridan St. 4205, noted she has recently moved to Dania Beach and
thanked everyone for being so welcoming.
Victoria Payne, Executive Director, Dania Beach Chamber of Commerce, 100 W Dania Beach
Boulevard, provided an update of Chamber events.
Carolyn Jones, 722 SW 3rd Street, thanked everyone involved in the MLK Parade.
George Jason, 4549 SW 37th Avenue, invited all community neighborhood organizations to join
the Dania Beach Neighborhoods United and become a part of their council.
Debbie McElyea, Wendy Shaver, and other members of the McElyea family, honored
Commissioner McElyea for his 80th birthday.
Kathy Philpart, 216 SW 1 lth Avenue, expressed birthday wishes to Commissioner McElyea.
Rose Lizana, 214 SE 2"d Street,expressed birthday wishes to Commissioner McElyea.
John Bertino expressed birthday wishes to Commissioner McElyea well for his birthday.
Joan Richardson, 5300 Washington St. #B-127, Hollywood, expressed birthday wishes to
Commissioner McElyea.
Bob Adams, 330 SE 3`d Terrace, provided an update on the Dania Beach Housing Authority 2"d
Annual Family Day event. He also expressed birthday wishes to Commissioner McElyea.
Kelvin Daise, 110 NW 14th Avenue, addressed the invoices he received from Fire Rescue
transport. He asked the Commission to reduce the bills because they are astronomical.
Teddy Bohanan, 312 SW 15th Street, wished Commissioner McElyea birthday greetings.
6. Public Safes Reports
Charles Raiken, Deputy Fire Chief of Administration, BSO Fire Rescue, reported on the Dania
Beach Housing Authority event that was held on Saturday.

Mayor Flury requested that the BSO Fire Rescue Quarterly Reports reflect prior quarter and prior
year comparisons.
Donn Peterson, BSO Chief of Police, introduced Detective Connie Bell, the new Crime

Prevention Specialist.
Commissioner Castro noted that some youngsters are out of control in the Triangle Village area.
She asked Chief Peterson to look into the matter.

AUTHORIZING THE PROPER CITY OFFICIALS TO EXTEND AN AGREEMENT WITH THE CITY OF
HOLLYWOOD, FLORIDA FOR BEACH SAND MAINTENANCE SERVICES TO BE PERFORMED IN AND
FOR THE CITY OF DANIA BEACH FROM JANUARY 31, 2012 UP TO AND THROUGH SEPTEMBER 30,
2012, FOR AN AMOUNT NOT TO EXCEED $40,800.00; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
Commissioner Castro motioned to adopt the Consent Agenda, with the exception of Items

7.5 RESOLUTION#2012-010
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,
AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AMENDMENT NUMBER 5 TO THE
EXISTING AGREEMENT FOR AN IMPLEMENTATION PLAN FOR DANIA BEACH BRIDGE PROJECTS
WITH KIMLEY-HORN AND ASSOCIATES, INC., TO PROVIDE ADDITIONAL CONSULTING SERVICES
FOR AN AMOUNT NOT TO EXCEED $20,314.00; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING
FOR AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution#2012-010.
Mayor Flury questioned why we continue to spend money on this issue if the railroad tracks are
not going to be raised.
Commissioner Castro noted they are not actually raising the bridge. She remarked that this is a
huge project and the Commission should be long range on this. Commissioner Castro advised
that both the Florida East Coast Railway (FEC) and the Florida Department of Transportation
(FDOT) agree with what we are trying to do. She further explained that in order to get funding,
we must provide a study to demonstrate what the initial cost would be. Commissioner Castro
thinks it is imperative that we move forward with this plan.
Mayor Flury noted her bigger concern is the half million dollars sitting in the capital budget for
this project. She suggested the money be used to purchase property around the surrounding area
and position ourselves better for the time when the economy recovers.
Commissioner Castro noted FDOT is willing to assist at no cost to the City.

AUTHORIZING THE EXPENDITURE OF CITY FUNDS EXCEEDING ONE MILLION DOLLARS
($1,000,000.00), WHICH EXPENDITURE IS NOT TO EXCEED THE PROJECT ESTIMATE APPROVED BY
THE CITY COMMISSION, TO FUND THE WATER TREATMENT PLANT UPGRADES CONSISTING OF
THE REHABILITATION OF THE EXISTING LIME SOFTENING PLANT AND THE LIME SLUDGE
HANDLING UNIT; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING)
City Y Attorne Ansbro read the title of Ordinance #2012-006. He noted per the City Charter, two
public hearings are required for expenditures over $1 M.
Mayor Flury opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition, she closed the Public Hearing.
Vice-Mayor Grace motioned to adopt Ordinance #2012-006, on first reading; seconded by
Commissioner Castro. The motion carried on the following 5-0 Roll Call vote:

City Attorney Ansbro advised the remaining items were quasi-judicial hearings and swore-in
those who would speak. He asked the Commission to disclose any communication they had on
these matters.
Commissioner Castro disclosed that she spoke to Mr. Platt.
9.2 RESOLUTION#2012-008
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING
THE REQUEST FOR MODIFICATIONS TO SITE PLAN SP-04-98, ORIGINALLY APPROVED ON MARCH
24, 1998, AS MODIFIED BY DOCUMENTS IDENTIFIED IN RESOLUTION NO. 2011-066 ADOPTED JULY
12, 2011, SUBMITTED BY GEORGE PLATT, REPRESENTING THE PROPERTY OWNER SOUTHERN
WASTE SYSTEMS, LTD., FOR PROPERTY LOCATED AT 3200 SW 26TH TERRACE, DANIA BEACH;
PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution#2012-008.
Corinne Lajoie, AICP, Principal City Planner, noted the site is an existing construction and
demolition debris recycling facility. She provided an overview of the proposal. Ms. Lajoie
advised that the proposed site plan modifications have been reviewed and staff is recommending
approval of the request.
Commissioner Castro confirmed that the use of the property will not be changed.
Mayor Flury opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition, she closed the Public Hearing.

9.3 RESOLUTION #2012-009
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING
THE VARIANCE REQUEST SUBMITTED BY JOHN PINDAR FROM THE UNIFIED LAND DEVELOPMENT
CODE, PART 2, SECTION 265-50, "SCHEDULE OF MINIMUM OFF-STREET PARKING REQUIREMENTS"
FOR PROPERTY LOCATED AT 2 SOUTH FEDERAL HIGHWAY, DANIA BEACH; PROVIDING FOR
CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution#2012-009.
Corinne Lajoie, AICP, Principal City Planner, noted the applicant is requesting approval of a
parking variance for a bartending and casino dealing specialty school. She provided an overview
of the proposal. The applicant is willing to provide 4 parking spaces where Code requires 11
spaces. Ms. Lajoie advised that the CRA Director and staff recommend approval of the request,
with the condition that the applicant participates in the City's Payment in Lieu program for the
remaining three parking spaces for a total of$19,500.00.
Mayor Flury opened the Public Hearing.
John Pindar advised that he does not have a problem with the Parking in Lieu program. He
noted that Kodner Galleries, their neighboring business, has entered into a parking agreement
allowing them to use their parking area on Monday-Thursday.
Seeing as there was no one else to speak in favor or opposition, Mayor Flury closed the Public
Hearing.

11. Commission Comments

Dania Beach City Commission
Tuesday,January 24,2012—7:00 p.m.
11.1 Commissioner Castro
Commissioner Castro noted Clare Vickery is sponsoring the "Pirates School"program at Collins
Elementary and she may need assistance with transportation.
Colin Donnelly, Assistant City Manager, responded they need a bus for four hours and the City
is making arrangements to provide transportation.
Commissioner Castro motioned for the City to contribute $200.00 for transportation of the
students from Collins Elementary; seconded by Vice-Mayor Grace. The motion passed
unanimously.
Commissioner Castro provided an update on items she discussed with Broward County Mayor
John Rodstrom, some of which include:
• To extend the Sales Assistance Program, once the Interlocal Agreement is approved by
the Federal Aviation Administration(FAA).
• To provide a resolution requesting the City of Dania Beach name be placed on the
Airport parking garage. She asked City Attorney Ansbro to prepare a resolution for
Commission approval at the next Commission meeting.
• To provide the County with a resolution requesting stop signs be placed in the SE 5th
Avenue area.
• Request for the County to pay for maintenance of the Griffin Road Corridor considering
they will be using it during the construction of the south runway airport expansion.
Commissioner Castro clarified that we are responsible for the maintenance of this area
even though we do not own it.
• Stormwater issues in the western part of the City. She noted the County is willing to help
us with this matter. Commissioner Castro asked staff to present a program to the
Commission to move forward with this issue.
Commissioner Castro spoke about the FDOT property on the corner of Griffin Road and
Interstate 95. She noted FDOT is willing to give it to the City and asked staff to follow up on
this issue and report back to the Commission. Commissioner Castro also mentioned other sites
in the City that need to be cleaned-up. She further reminded staff that the dead trees on Griffin
Road have not yet been removed.
Commissioner Castro referred to the current Boyd Gaming negotiations in Tallahassee. She
advised she gave City Attorney Ansbro the name of a possible Special Counsel who would help
us make sure that our City is considered for portability, if this issue is discussed at an upcoming
legislative session. Commissioner Castro noted that she reached out to Mayor Joy Cooper, City
of Hallandale Beach, as well as the City of Miami,to share a Special Counsel.
Mayor Flury noted the Commission should decide tonight.

Tuesday,January 24,2012—7:00 p.m.
Commissioner Duke suggested the City Manager reach out to our lobbyist, Carole Duncanson,
for her comments before we make a decision. He would like each member of the Commission to
receive the same information from Ms. Duncanson.
Commissioner Castro noted nothing will happen until after the November election.
It was the consensus of the Commission to have City Attorney Ansbro and City Manager
Baldwin look for a Special Counsel, who will discuss the matter with Carole Duncanson.
11.2 Commissioner Duke
Commissioner Duke requested the Commission look at the maps sent by Public Services
Director Orlando and Assistant City Manager Donnelly, regarding some common areas in the
City, and provide their comments.
Commissioner Duke noted he would like the Martin Luther King, Jr. parade route expanded.
Commissioner Duke commended staff and the Commission for handling so many issues in a
very professional way.
11.3 Commissioner McElyea
Commissioner McElyea thanked everyone for his birthday wishes.
11.4 Vice-Mayor Grace
Vice-Mayor Grace commended the MLK Committee for a great job. She asked everyone
involved to make sure that in the future,the event route is cleaned up prior to starting the parade.
Vice-Mayor Grace noted the Solar Lights on NW 12 Avenue have not been fixed. She asked
Public Services Director Orlando to look into the matter.
Vice-Mayor Grace noted that the Broward County School Board Superintendent will be visiting
the Hollywood-Dania Beach area on February 6. She encouraged everyone to attend the 6:30
p.m. meeting at Attucks Middle School,to show support for our schools.
11.5 Mayor Flury
Mayor Flury questioned if we are up to date with SRF funds. She asked City Manager Baldwin
to provide an update at the workshop on Wednesday, February 1.
Mayor Flury noted she would like to meet with the Auditors and asked City Manager er Baldwin to
arrange a meeting.

Dania Beach City Commission
Tuesday,January 24,2012—7:00 p.m.
Mayor Flury commented that we have a problem with homeless people hanging out at the
children's playground area at the beach. She asked City Manager Baldwin to investigate the
matter.
Mayor Flury noted the "windmill" signs are getting out of hand, and we need to enforce the law
because the proliferation is outrageous.
Commissioner McElyea noted that the lights in the alley east of Winn Dixie, between Dania
Beach Boulevard and Park Street,need to be fixed.
12. Appointments
There were no appointments at this meeting.
13. Administrative Reports
13.1 City Manager
City Manager Baldwin noted the Commission Workshop will be Wednesday, February 1, at 6:00
p.m. He added that another workshop will be scheduled at a later date.
13.2 City Attorney
City Attorney Ansbro noted we received the confidentiality report from Mr. Flanigan for the Pier
Restaurant lease. He advised that their proposal letter is also forthcoming.
City Attorney Ansbro noted that Citizens for Responsible Development, Inc. served the City
with the lawsuit regarding the Dania Entertainment Center. He commented that since we would
not agree to give them the extension to serve the suit, they proceeded with it; therefore, we will
have to defend ourselves.
