RESOLUTION NO. 2012-018 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUEST FOR A PARKING VARIANCE(VA-07-12)SUBMITTED BY DAVID WARNER,REPRESENTING WARNER GALLERIES,FROM THE DANIA BEACH LAND DEVELOPMENT CODE SECTION 265-20,FOR PROPERTY LOCATED AT 21 SOUTH FEDERAL HIGHWAY, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,Section 265-20 of the Dania Beach Land Development Code sets the off-street parking regulations for zoning districts in the City of Dania Beach; and WHEREAS,David Warner,representing Warner Galleries,is requesting a variance to use an unpaved surface for off-street parking on a vacant lot located at 21 South Federal Highway,within the Community Redevelopment Area(CRA)South Federal Mixed Use(SFED-MU)zoning District, in the City of Dania Beach; and WHEREAS,the City Community Development and Public Services Department staff have reviewed this request and recommend that the City Commission grant approval of the variance request provided that: 1) the ground is stabilized; and 2) landscape screening is provided and approved by the CRA Director; NOW,THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-07-12 for the variance described above from requirements in the Dania Beach Land Development Code, Section 265-20, a copy of which application is attached and made a part of this Resolution as Exhibit"A",is approved based on the following conditions: 1) the ground is stabilized; and 2) landscape screening is provided and approved by the CRA Director. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3. That this Resolution shall be in full force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on February 28, 2012.
