HomeMy WebLinkAboutR-2012-021 Approved request for modification of Site Plan for property located at 205 North Federal Highway RESOLUTION NO. 2012-021 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUEST FOR MODIFICATION TO SITE PLAN SP-08-08, ORIGINALLY APPROVED ON AUGUST 26, 2008 PURSUANT TO RESOLUTION 2008-142, AS MODIFIED ON MAY 12, 2009 PURSUANT TO RESOLUTION 2009-078 AND AS EXTENDED ON MAY 25, 2010 PURSUANT TO RESOLUTION 2010-078,FOR PROPERTY LOCATED AT 205 NORTH FEDERAL HIGHWAY IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,Part 6 of"Development Review Procedures and Requirements"of Article 635 of the Land Development Code ("Code") of the City of Dania Beach, Florida("City"), states that approval of a site plan is required prior to the commencement of any development in the City, including but not limited to grading,excavating,dredging,filling,installation of roads and utilities incidental to vertical construction,interior building alterations that increase the number of residential units,business/tenant spaces,or otherwise increase the parking requirement under Article 265,prior to the issuance of a building permit; and WHEREAS,pursuant to Section 63 5-80 of the Code,any changes or deviations of approved site plans must be reviewed and approved under the same procedures that apply to new site plans; and WHEREAS,on August 25,2008,the City Commission of the City of Dania Beach,Florida ("City Commission") approved site plan request SP-08-08 pursuant to Resolution 2008-142, as submitted by property owner Jay Patel, for Luckey's Motel, Inc., relating to the demolition and construction of a 6 story 72 foot tall 75-room hotel located at 205 North Federal Highway, and WHEREAS,on May 12,2009,the City Commission approved the request for modifications to site plan SP-08-08 pursuant to Resolution 2009-078; and WHEREAS,on May 25,2010,the City Commission approved an extension to site plan SP- 08-08 pursuant to Resolution 2010-078; and WHEREAS, Courtney Crush, with the firm Courtney Crush Law, Inc., representing Luckey's Motel Inc., applied for modification to site plan SP-08-08, and amendment to the associated variance approved by application VA-31-08,to allow a four(4)foot rear setback(along the west property line), where Chapter 28, "Zoning", Article 21.20 "TOD Building Envelope," required a minimum rear setback of 20 feet; and WHEREAS, the City Commission finds that modification of the site plan approved by application SP-08-08 pursuant to Resolution 2008-142 is in the City's best interest. NOW, THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. Recitals. The above recitals are true and correct and incorporated into this Resolution by this reference. Section 2. That the application for modification to the site plan (SP-08-08) approved pursuant to Resolution 2008-142,copies of which are attached and made a part of this Resolution as Exhibit"A," are approved for Luckey's Motel, Inc., located at 205 North Federal Highway, Dania Beach, Florida. Section 3. That pursuant to Section 635-100 ofthe Code,this site plan modification shall automatically expire and become null and void unless the applicant files a complete building permit application with construction drawings for all improvements shown on the site plan within twelve (12) months from the date of this Resolution, obtains a building permit (including payment of all fees) for all such improvements within eighteen(18)months from the date of this Resolution and that the permits remain valid until a certificate of occupancy or its equivalent is issued for the improvements. Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. 2 RESOLUTION#2012-021 Section 5.
