DANIA BEACH CITY COMMISSION
TUESDAY, FEBRUARY 28, 2012 — 7:00 P.M.
1. Call to Order/Roll Call
Mayor Flury called the meeting to order at 7:00 p.m.

2. Invocation and Pledge of Allejaiance
Vice-Mayor Grace gave the invocation followed by the Pledge of Allegiance to the United States
Flag.
Mayor Flury asked Attorney Neal McAliley to address the response letter received from the
Federal Aviation Administration(FAA).
Neal McAliley, Special Counsel for Airport matters, spoke about the FAA response to Broward
County Aviation Department (BCAD). In their letter, the FAA did not say that Broward County
could not provide the residents the noise mitigation proposed by the City. They suggested that
all of the noise mitigation would not be eligible for federal grant money. He explained we need
to determine what funds can or cannot be used for the noise mitigation plan for the residents.
Attorney McAliley further noted that the FAA letter triggers our Settlement Agreement
"Voidability Option" period, where the City Commission has a 30-day period to void the
October 25, 2011 Interlocal Agreement, commencing March 9, 2012. We may need more time
to understand whether this is the FAA final answer or if there are any other funding sources
available to us. He stated that we are committed to get the Settlement Agreement that we all
agreed to, and that is what we want. If we are not successful, we will defend the City by all
means necessary.
Mayor Flury confirmed that Attorney McAliley expressed the thoughts of the entire Commission
and that we will continue to protect the interests of our residents.
3. Presentations and Special Event Approvals
3.1 Special Presentation to Dania Elementary— Science Fair—Commissioner Duke
Commissioner Duke presented Certificates of Appreciation to 3rd, 4th and 5th Graders from Dania
Elementary for their experiments in the Science Fair. He also recognized the Assistant Principal,
Science Director, and Principal of Dania Elementary.
Vice-Mayor Grace presented Certificates of Appreciation to the members of the City
Commission from the Greater Mt. Zion AME Community Church.
4. Proclamations
4.1 Relay for Life Days
Mayor Flury and the City Commission presented the proclamation to LouAnn Patallero,
Chairman of the 2012 Dania Beach Relay for Life, and other members of the committee.
4.2 Friends of the Dania Beach Paul DeMaio Library Day
Mayor Flury and the City Commission presented the proclamation to Ann Page and other
members of the Friends of the Dania Beach Library.
5. Citizen Comments
Linda Sacco, 4496 SW 34th Terrace, Chairman of the Dania Beach Airport Advisory Board,
requested that the City Commission motion to reject the response letter from the FAA. The
Board further recommended that the City Commission reject the entire Settlement Agreement
and return to the 1995 Interlocal Agreement with Broward County.
Bob Mikes, 601 NW 7`h Street, suggested that the 80 homeowners in the Mitigation Program be
provided with a copy of the FAA response letter. He asked the Commission to hold community
meetings before making a final decision on the Airport.
Victoria Payne, Executive Director, Dania Beach Chamber of Commerce, provided an update of
upcoming Chamber events.
Jim Moyer, Donor Program Manager, The Salvation Army, 1901 West Broward Boulevard, Ft.
Lauderdale, asked if the Salvation Army could place clothing donation boxes in the City of
Dania Beach with property owner approval.
Mayor Flury noted Mr. Moyer needs to work with the City Manager to insure compliance with
City codes.

Commissioner Castro noted that all boxes should be properly maintained.
Teddy Bohanan, 312 SW 151h Street, thanked the Sheriff's Department for the excellent job they
have done in the City during the past 5 weeks. She thanked Lisa Duke for cleaning up the
trailers and the drug dealers in her neighborhood.
Annette Hibbits, 26 SW 111h Street, asked why the appointment of Vice-Mayor is on the agenda.
City Attorney Ansbro responded that the Charter requires the selection of a new Vice-Mayor
after one year in office.
Vice-Mayor Grace commented that the Charter Review Board did a'fabulous job, and this is
something that will be done.
6. Public Safely'Reports

Donn Peterson, BSO Chief of Police, noted he and the City Manager have discussed vagrancy
and other issues of concern throughout the City. They came up with a comprehensive strategy,
and he has submitted a written action plan to the City Manager in order to address some of these
problems.
Commissioner Duke thanked BSO for taking care of the recent burglaries in the marine district.
Joe Fernandez, Deputy Fire Chief, BSO Fire Rescue, reported they will be present at the Dania
Beach Relay for Life.

City Attorney Ansbro read the title of Resolution#2012-027.
Mayor Flury requested clarification.
City Manager Baldwin responded this is a clarification of a previously approved Commission
action.

There were no proposals on this agenda.
9. Public Hearings and Site Plans
City Attorney Ansbro advised the remaining items were quasi-judicial hearings and swore-in
those who would speak. He asked the Commission to disclose any communication they had on
these matters.
Mayor Flury and the Commission noted they were contacted by an attorney representing
Luckey's Hotel, and refused to meet and talk to him.
9.1 RESOLUTION #2012-018

City Attorney Ansbro read the title of Resolution#2012-018.
Corinne Lajoie, AICP, Principal Planner, provided an overview of the subject property. She
advised that the applicant is requesting a parking variance to use an unpaved surface for off-
street parking on a vacant lot. Staff recommends approval with the condition that the ground is
stabilized with gravel and a street wall is provided.
Mayor Flury opened the Public Hearing.
Penny Warner, property owner, noted she wants to return to Dania Beach because it is up and
coming.
David Warner, property owner, noted he does not object to adding plants to the landscape. He
agrees with staff recommendations.
Commissioner Duke wants the CRA Director to weigh in on the plants selected.
Ms. Lajoie clarified the wall is not required provided there is landscaping, and a new site plan is
required to show that new gravel is brought in the back lot.
Seeing as there was no one else to speak in favor or opposition, Mayor Flury closed the Public
Hearing.
Commissioner Castro motioned to adopt Resolution #2012-018, provided the ground is
stabilized, and the landscape screening is provided and must be approved by the CRA
Director; seconded by Vice-Mayor Grace. The motion carried on the following 5-0 Roll

9.2 RESOLUTION #2012-019

SITE PLAN (SP-39-09) GRANTED BY RESOLUTION 2011-017 ON FEBRUARY 22, 2011, AND FOR THE
VARIANCE (VA-50-09) GRANTED BY RESOLUTION 2010-002 ON JANUARY 12, 2010, FOR PROPERTY
LOCATED AT 45 EAST SHERIDAN STREET IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING

City Attorney Ansbro read the title of Resolution#2012-019.
Commissioner Duke noted his wife consulted on this property a couple of years ago. He added
that even though the City Attorney said he could vote, he is recusing himself.

Corinne Lajoie, AICP, Principal Planner, noted the applicant is requesting a site plan extension
for the construction of an office building. She provided an overview of the request. Ms. Lajoie
advised that the applicant has found ways to cut down on costs and will be submitting a revised
plan. Staff recommends approval provided the outstanding comments are addressed prior to
permitting.
Mayor Flury opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition, she closed the Public Hearing.
Vice-Mayor Grace motioned to adopt Resolution #2012-019, with staff recommendations;
seconded by Commissioner Castro. The motion carried on the following 4-0 Roll Call vote:

9.3 RESOLUTION#2012-020

THE REQUEST FOR AMENDMENT TO THE VARIANCE REQUEST(VA-31-08)ORIGINALLY APPROVED
ON AUGUST 26, 2008 PURSUANT TO RESOLUTION 2008-140 AND EXTENDED ON AUGUST 25, 2009
PURSUANT TO RESOLUTION 2009-155, FOR PROPERTY LOCATED AT 205 NORTH FEDERAL
HIGHWAY IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution #2012-020 and Resolution #2012-021 because
they relate to the same property.
Corinne Lajoie, AICP, Principal Planner, advised the variance was previously approved, but now
requires reconsideration due to the roadway dedication for Federal Highway. A fee waiver is
also required for the variance and site plan modification. She explained this was an oversight on
everyone's part and noted staff recommends approval of all requested actions.
Mayor Flury opened the Public Hearing.
Courtney Crush, attorney representing the property owners, requested approval of the requests.
Seeing as there was no one else to speak in favor or opposition, Mayor Flury closed the Public
Hearing.

RESOLUTION 2009-078 AND AS EXTENDED ON MAY 25, 2010 PURSUANT TO RESOLUTION 2010-078,
FOR PROPERTY LOCATED AT 205 NORTH FEDERAL HIGHWAY IN THE CITY OF DANIA BEACH,

10. Discussion and Possible Action
10.1 Update relating to the City Owned Property Analysis summary package including
property appraisal information—Bob Daniels, Director of Community Development
Bob Daniels, Director of Community Development, noted that the summary package was
distributed to the Commission to allow them time to review it and provide any recommendations
or changes.
Vice-Mayor Grace noted the strip of land next to "Touch of Class" has always been maintained
by the property owner. She commented that she cannot rationalize the cost of the property.
Vice-Mayor Grace wants to sit down with Director Daniels and rationalize the values of the
properties in the NW and SW sections of the City.
Commissioner Castro questioned the appraisal process and if the adjoining property owners had
been notified.
City Attorney Ansbro noted the Commission will declare the property surplus at the next
meeting and a broker will be selected who will list the properties for sale. He added that the
properties must be sold for at least 90%of the appraised value.
10.2 Phase 1 Environmental Assessment for the FDOT owned property located at 1895

City Manager er Baldwin noted that both Commissioner Castro and he met with the Florida
Department of Transportation(FDOT) and they are agreeable on this issue.
Bob Daniels, Director of Community Development, noted Mr. Wolfe, FDOT District IV,
indicated their willingness to consider donating this property to the City and asked for a formal
letter submitting our request. He advised that the letter is ready for the Mayor's signature.
Commissioner Castro motioned for the Commission to be in agreement to acquire this
property from FDOT to erect a monument sign that reads "Welcome to Dania Beach", and
that DCOTA will maintain the property; seconded by Commissioner Duke. The motion
carried on the following 5-0 Roll Call vote:

10.3 City Stormwater Projects Update - Dominic Orlando, Director of Public Services
Dominic Orlando, Director of Public Services, noted we will be re-bidding the SE Stormwater
Improvements-Meadowbrook Pump Station Replacement, Phase I of the project. The engineer
will need to re-do the bid packet and the final document should be ready in about 2-3 weeks. He
provided a brief overview of all the various projects which information was included in the
agenda backup.
Commissioner Castro noted it is incumbent upon us to do this project because FDOT is willing
to pay 42% of the funding, and the residents out west have been waiting for a long time.
11. Commission Comments
11.1 Commissioner Castro
Commissioner Castro thanked FDOT and City staff for addressing the graffiti on the newly
painted wall at Melaleuca Gardens.
Commissioner Castro referred to some Code cases which have been pending for a long time.
She questioned whether we should look at another Amnesty Program or tighten up the process,
because people should not have to wait for two years for their neighbors to clean up their
properties.
Commissioner Castro noted our requests to add the name of Dania Beach to signage identifying
the Fort Lauderdale-Hollywood International Airport and for installation of stop signs in the City
are not yet on the County Commission agenda. She asked staff to let the Commission know if
they hear anything.

Commissioner Castro was pleased to report that there is an item on the County Commission
agenda regarding a grant to re-do the bus depot on Anglers Avenue.
Commissioner Castro noted residents have contacted her regarding the homelessness article in
the Sun Sentinel. She commented the City of Hollywood is having problems with Jubilee
Kitchen. Commissioner Castro asked Chief Peterson to reach out to Jubilee Kitchen requesting
their patrons behave and respect the surrounding residents.
Commissioner Castro spoke about the issue of portability of the gaming license in Tallahassee.
She contacted Matt Bryan, Special Counsel, and he advised he is watching this matter very
closely.
Commissioner Castro said the College Gardens and Dania Beach Heights projects are being
combined and a resolution will be required for CRA Board approval. She asked staff if this
process would delay the project.
City Attorney Ansbro responded this will not require Commission action and the project will not
be delayed.
Commissioner Castro noted she would like to review our policies in order to find an easier and
faster way to do things.
Commissioner Castro noted some projects are slowed down by Fire Inspections and Building
Inspections. She remarked that we need to use common sense and become more business
friendly. Commissioner Castro asked City Manager Baldwin and Community Development
Director Daniels to look into this issue.
11.2 Commissioner Duke
Commissioner Duke had no comments.
11.3 Commissioner McElyea
Commissioner McElyea said he heard we may outsource our Water Department, and he is
against it.
11.4 Vice-Mayor Grace
Vice-Mayor Grace agreed with Commissioner McElyea on the Water Department outsourcing.
Vice-Mayor Grace noted that Northwest Byrd Pointe in the Sun Garden Isles community is up
and running. She invited everyone to visit the area around IOth Court and 2nd Avenue to see all
the improvements.

11.5 Mayor Flury
Mayor Flury clarified that at the workshop meeting held last month we talked about the new
Nanofiltration Plant and that the people on the east side of the City will pay for it. She
commented that residents living west of Interstate 95 receive their water bills from Broward
County. Mayor Flury noted that the question is whether the residents can pay for it, and how
much more can they take. It was at this meeting that we discussed the possibility of outsourcing
the water plant. She stated that it is incumbent upon Director Orlando to tell his staff that we are
not doing anything, but that we need to look at what we can do to mitigate the cost of water.
Mayor Flury noted that the City Manager was directed to explore the possibility of the County
purchasing the Nanofiltration Plant.
City Manager Baldwin noted the rumors began when staff toured the Water Plant with
representatives from the County last week.
Commissioner Castro also noted that she requested the City Manager speak with Neal McAliley,
Special Counsel, for information on water re-use.
It was the consensus of the Commission to look into possibilities to be considered.
Mayor Flury pointed out she also gets frustrated with projects. She noted with all our projects,
we first have the City review, Commission approval and then it goes to the County for review.
Mayor Flury remarked that we need to look at our own process in order to be more efficient.
Mayor Flury noted there is one Commission appointment to the General Employees Pension
Board and asked Commissioner Duke if he was resigning.
Commissioner Duke noted he is not resigning; however, he is very busy and would request that
someone take this over. He said he will keep trying, but he cannot guarantee he can make it.
12. Appointments

Commissioner Duke will remain on the General Employees Pension Board.
12.4 Selection of Vice-Mayor for term beginning March 13, 2012

13. Administrative Reports
13.1 City Manager
CityManager Baldwin reported that we received our permit from the Florida Department of

Environmental Protection (FDEP) for the removal of the seagrapes, with a condition that we
must advertise the project and allow for public comment. He advised that staff is meeting on
Friday with some of the environmentalists who may oppose the project.
City Manager Baldwin stated that the homeless topic is a big problem. He noted he and Chief
Peterson are working on the issue to try to find a solution. City Manager Baldwin advised that
there is no zoning that would allow a homeless shelter in Dania Beach.
13.2 City Attorney
City Attorney Ansbro reported negotiations with the Quarterdeck are proceeding. Meetings will
be scheduled individually with each Commissioner when the final details have been put together.
City Attorney Ansbro noted there were difficulties with the company in charge of removing the
asbestos at the Dania Beach Hotel. He further advised that they have been terminated and a new
firm will finish the job, and the actual demolition should start within the next 10 days.
