HomeMy WebLinkAboutR-2012-042 Authorized an Agreement with Florida Inland Navigation District that provides Funding & Administration of the Waterways Assistance Program Grant for $2,500,000.00 RESOLUTION NO. 2012-042 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN AGREEMENT WITH THE FLORIDA INLAND NAVIGATION DISTRICT THAT PROVIDES FOR FUNDING AND ADMINISTRATION OF A WATERWAYS ASSISTANCE PROGRAM GRANT IN THE AMOUNT OF $2,500,000.00; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach is interested in carrying out the following described project for the enjoyment of the citizenry of the City of Dania Beach and the State of p Jm'Y tY Florida: Project Title: Dania Beach Municipal Marina Renovation Project Phase II. Total Estimated Cost: $5,000,000.00 (50% Grant and 50% City matching funds) Brief Description of Project: The Dania Beach Marina will be redesigned and rebuilt, which will include 120 slips, a new sea wall, and upland improvement, a harbor master office, laundry, fish cleaning station, pump out facilities, security kiosks and hardscape improvements; and WHEREAS, Florida Inland Navigation District ("F.I.N.D.", or "District") financial assistance is required for the program funding mentioned above; and WHEREAS, the City of Dania Beach hereby appropriates an equal amount of required matching funds for this Marina Phase II Project from available General Fund, Unassigned Fund Balance in an amount not to exceed $2,500,000.00; and WHEREAS, the City of Dania Beach has applied for and anticipates approval of a separate BBIP Grant for this Project in the amount of$1,367,400.00 that will be used toward and reduce the City's direct matching funds of up to $2,500,000.00 required for FIND grant match funding once the BBIP grant is actually awarded to the City; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the proper City officials of the City of Dania Beach are authorized to submit an application to the Florida Inland Navigation District in the amount of 50% of the actual cost of the project on behalf of the City of Dania Beach. Section 2. The City of Dania Beach certifies the following: 1. That it will accept the terms and conditions set forth in F.I.N.D. Rule 66B-2 F.A.C., which will be a part of the Project Agreement for any assistance awarded under the attached proposal. 2. That it is in complete accord with the attached proposal and that it will carry out the Program in the manner described in the proposal and any plans and specifications attached to it unless prior approval for any change has been received from the District. 3. That it has the ability and intention to finance its share of the cost of the project and that the project will be operated and maintained at the expense of the City of Dania Beach for public use. 4. That it will not discriminate against any person on the basis of race, color or national origin in the use of any property or facility acquired or developed pursuant to this proposal, and it shall comply with the terms and intent of the Title VI of the Civil Rights Act of 1964, P. L. 88-352 (1964) and design and construct all facilities to comply fully with statutes relating to accessibility by disabled persons as well as other federal, state and local laws, rules and requirements. 5. That it will maintain adequate financial records relating to the proposed project to substantiate claims for reimbursement. 6. That it will make available to FIND if requested, a post-audit of expenses incurred on the project prior to, or in conjunction with, request for the final 10% of the funding agreed to by FIND. Section 3. That the Commission hereby provides an appropriation of required matching funds for this Marina Phase II Project through appropriation and transfer of available General Fund, Unassigned Fund Balance in an amount not to exceed $2,500,000.00 to the Capital Project Fund — Marina Renovation Phase II, and also providing for substitution and replacement of these City matching funds by the future City award of BBIP grant monies for this project, if any. Section 4. That the proper City officials are authorized to execute an Agreement between the Florida Inland Navigation District and the City of Dania Beach for Waterway RESOLUTION#2012-042 Assistance Program grant funding for the purpose of the Dania Beach Municipal Marina Renovation Phase II Project. Section 5. That the City Commission authorizes and directs creation of appropriate Grant Fund accounts and the appropriation of funds received under the grant. The required 50% cash match for this grant is hereby appropriated in the Capital Project Fund as provided in Section 3, above. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7.
