Parker Dock Replacement RESOLUTION NO. 2012-045 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, ESTABLISHING A RANKING OF BIDS; RESCINDING THE AGREEMENT WITH JTB CONSTRUCTION CO. DUE TO INADEQUATE INSURANCE PROVISIONS AND AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN AGREEMENT WITH THE NEXT RANKED BIDDER, CENTURY BUILDING RESTORATION USA, INC. FOR THE I.T. PARKER DOCK REPLACEMENT PROJECT IN AN AMOUNT NOT TO EXCEED $54,260.00; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City advertised for bids for the I.T. Parker Dock Replacement project and three (3)bids were received by the City on January 6, 2012; and WHEREAS,the City's bid review committee proposed a ranking of bids as follows: • 1st JTB Construction Co. $46,700.00 • 2°a Century Building Restoration USA, Inc. $54,260.00, with a third bid submitted by American Marine Contractors being found as non-responsive; and WHEREAS, Resolution No. 2012-022, originally awarded the bid to J.T.B. Construction Co. for the I.T. Parker Dock Replacement Project, however, this company was subsequently unable to provide sufficient, timely insurance requirements to the City causing the Administration to recommend the Commission rescind the previous bid award with J.T.B. Construction Co., and to approve entering into an agreement with the next ranked firm, Century Building Restoration USA, Inc. in an amount not to exceed $54,260.00; and WHEREAS, this project funding was planned for an amount of $48,800.00 through a combination of Florida Inland Navigation District Assistance Program (F.I.N.D.) Grant award (approved August 23, 2011, consisting of $24,400.00 in grant funds and a required City matching appropriation of$24,400.00); and WHEREAS, an additional project appropriation of$5,460.00 is necessary for award of this bid which is available upon Commission approval through reduction and transfer of budget appropriations in the General Fund - Recreation Department operating budget# 001-7302-572- 34-10 into the I.T. Parker Dock capital project; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing findings are incorporated by reference and made a part of this Resolution. Section 2. That a transfer of existing General Fund—Recreation Department funding appropriation is approved in the amount of$5,460.00 from Recreation account number#001-72- 03-572-34-10 to the I.T. Parker Dock Capital Project#301-72-52-572-63-10. Section 3. That the Agreement for services with JTB Construction Co. is rescinded and proper City officials are authorized to execute an Agreement for the I.T. Parker Dock Replacement Project with the next ranked bidder, Century Building Restoration USA, Inc. in an amount not to exceed $54,260.00. Section 4. That the City Manager and City Attorney are authorized to make minor revisions to the terms of such Agreement as are deemed necessary and proper for the best interests of the City. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6.
