Call to Order/Roll Call Mayor Flury called the meeting to order at 7:00 p.m. Present: Mayor: Patricia A. Flury Vice-Mayor: C. K. "Mac"McElyea Commissioners: Anne Castro Walter Duke Bobbie H. Invocation and Pledge of Allegiance Reverend Gregory Pope, Bethel Missionary Baptist Church, gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Warner Galleries—Business Tax Receipt Application for Auctioneer Commissioner Grace motioned to approve the Auctioneer License for Warner Galleries; seconded by Commissioner Castro. The motion carried on the following 5-0 Roll Call vote: Commissioner Castro Yes Vice-Mayor McElyea Yes Commissioner Duke Yes Mayor Flury Yes Commissioner Grace Yes 3.2 Request for an I.T. Parker Community Center fee reduction for $1,200.00, with a $500.00 security deposit, for the Southern Handcraft Society on September 26-29, 2012, as recommended by the Parks, Recreation and-Community Affairs Advisory Board Commissioner Grace motioned to approve the I.T. Parker Community Center fee reduction for the Southern Handcraft Society; seconded by Commissioner Castro. The motion carried unanimously. 3.3 Special Event request from Kristen Jones, Director of Parks and Recreation, for a "Retirement Party" on Saturday, June 2, 2012, to be held on Dania Beach from 6:00 P.M. to 10:00 P.M. Commissioner Castro motioned to approve the Special Event request for Kristen Jones' Retirement Party; seconded by Commissioner Grace. The motion carried unanimously. 3.4 Special Event request from the Ft. Lauderdale Rotary U.S. Military for a "Military 5k Run", to be held at the Dania Beach Grill on Sunday, April 29, 2012 from 7:00 a.m. to 8:00 a.m. Ray Williams, 715 Cordova Road, Ft. Lauderdale, Shawn Stewart, 13873 SW 40t' Street, Davie, and Robert Easton Jr., FARO, 1560 E Oakland Park Boulevard, President of the Ft. Lauderdale Rotary Club, provided an overview of the event and requested approval. Commissioner Castro motioned to approve the Special Event request for the Military 5k Run; seconded by Commissioner Grace. The motion carried unanimously. 3.5 Special Event request for the City of Dania Beach Green Advisory Board to hold a "Tree Giveaway" on Saturday, April 21, 2012, in the Dania Beach City Center. The applicant is also requesting the City to provide tables and chairs for their event, to have access to City Hall for restrooms use between the hours of 10:00 a.m. to 12:00 p.m., and for the Mayor or Commissioners to welcome residents. Commissioner Castro motioned to approve the Special Event request for the Green Advisory Board Tree Giveaway; seconded by Commissioner Duke. The motion carried unanimously. 3.6 Special Event request for the Marine Industries Association of South Florida's "16th Annual Plywood Regatta" to be held on April 21-22, 2012, at 101 North Beach Road. The applicant is requesting a waiver of fees, including parking fees for members and volunteer organizers. In addition, they are also requesting the use of both sections of the parking lot along the marina side. Commissioner Castro motioned to approve the Special Event request for the 16t6 Annual Plywood Regatta, including waiver of fees; seconded by Commissioner Duke. The motion carried unanimously. 3.7 Special Event request for the First Bethel Missionary Baptist Church "Youth Christian Day", to be held April 28, 2012, at 6 SW 6th Avenue from 10:00 a.m. to 6:00 p.m. Commissioner Grace noted they also need a fee waiver of$150.00. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,April 10,2012—7:00 p.m. Commissioner Castro motioned to approve the Special Event request for Youth Christian Day, including the $150.00 fee waiver; seconded by Commissioner Duke. The motion carried unanimously. 3.8 Special Event request for the Broward Sheriffs Office/Fire Department's "3rd Annual James Malcolm ALS Competition" to be held at Bass Pro Shops, 200 Gulfstream Way, on Friday, May 11, 2012, from 7:00 a.m. to 5:00 p.m. The applicant is also requesting a permit fee waiver. Commissioner Grace motioned to approve the Special Event request for the 3`d Annual James Malcolm ALS Competition, including permit fee waiver; secon ded b Commissioner P � gP Y Castro. The motion carried unanimously. 3.9 Special Event requested for Broward Sheriffs Office/Fire Department's "Broward Invitational Extrication Competition", to be held on May 12-13, 2012, from 8:00 a.m. - 5:00 p.m. at Bass Pro Shops Outdoor World, 200 Gulfstream Way. The applicant is also requesting a fee waiver. Commissioner Castro motioned to approve the Special Event request for the Broward Invitational Extrication Competition, including the fee waiver; seconded by Commissioner Duke. The motion carried unanimously. 3.10 Special Event request for the Holocaust Documentation and Education Center's "HDEC Museum Fundraiser", to be held on Tuesday, April 24, 2012, from 6:00 p.m. to 10:00 p.m. at the Holocaust Center, 303 North Federal Highway. The applicant is also requesting a late fee waiver. Mayor Flury noted there is a change of venue for this event and no action is required by the Commission. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Joan Richardson, 5300 Washington Street, Hollywood, Dania Beach Kiwanis Club, invited the Commissioners to sponsor or attend the 25th Annual Golf Tournament on Saturday, April 21, 2012 at the Hollywood Beach Country Club. George Jason, 4549 SW 371h Avenue, noted free phones for hearing impaired people will be given away on Thursday, May 3, 2012 at I.T. Parker Community Center. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,April 10,2012—7:00 p.m. Betty Sokol, 609 NW I01h Street, requested the City install plants along the Melaleuca Gardens Wall. Commissioner Castro noted the issue was determining when the plants should be planted due to the construction at the Ft. Lauderdale-Hollywood International Airport. Victoria Payne, Executive Director, Dania Beach Chamber of Commerce, provided an update of Chamber events. Mayor Flury asked Ms. Payne to relay a message to the board in reference to an article in �, i Beach. She noted that the Cahoots regarding the renaming of the Airport, to include Dania g g g rP Chamber needs to be careful not to bite the hand that feeds them. Mayor Flury stated that this newspaper is very negative and all it does is insult individuals and cities. She understands that the publisher of the newspaper sits on the Chamber board. Mayor Flury wants to remind the board that this Commission by vote, several years ago, allowed the Chamber to use the Nyberg- Swanson House, and they are there rent free. Furthermore, the City Commission approves up to $20,000.00 per year for the Chamber; but for their board to have a member that disgraces the City is hard to swallow. Lastly, she indicated she would not be opposed to ask the Commission to remove the Chamber from the Nyberg-Swanson House, if they allow someone like that to be on their board. Commissioner Castro thanked the Mayor for coming to her defense, but she does not care if anyone parodies her. She does agree with the Mayor's point. Commissioner Castro noted the article in "Cahoots" was insulting to Hispanics. She further pointed out we have worked hard to improve our image and we need to stand together in that mission. 6. Public Safety Reports Bruce Caruso, Division Chief, BSO Fire Rescue, invited the Commission to attend the ALS and Extrication Competitions. He reported on the severe weather from last Friday and some of the areas in the City that were affected. Chief Caruso also noted that,BSO Fire Chief De Jesus' father passed away and funeral arrangements will be made available to interested parties. Donn Peterson, BSO Chief of Police, reminded the residents of Fleet Week, on April 25-29. He also advised that the Law Enforcement Torch Run will be held in Dania Beach on April 26. Chief Peterson noted that on Thursday, May 3, there will be a National Day of Prayer at the First Baptist Church in Fort Lauderdale, to include a survivors' breakfast for a $20.00 fee. The proceeds will benefit the Sheriff s Foundation of Broward County Memorial Fund. 7. Bids and Requests for Proposals 8.1 RESOLUTION#2012-045 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, ESTABLISHING A RANKING OF BIDS; RESCINDING THE AGREEMENT WITH JTB CONSTRUCTION CO. DUE TO INADEQUATE INSURANCE PROVISIONS AND AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN AGREEMENT WITH THE NEXT RANKED BIDDER, CENTURY BUILDING RESTORATION USA, INC. FOR THE I.T. PARKER DOCK REPLACEMENT PROJECT IN AN AMOUNT NOT TO EXCEED $54,260.00; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2012-045. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,April 10,2012—7:00 p.m. Commissioner Castro suggested we look for grant funds or any other type of reimbursement program that could be available to us. Mayor Flury noted she would like this project to start as soon as possible, considering the docks are in very bad conditions. Commissioner Castro motioned to adopt Resolution #2012-045; seconded by Commissioner Duke. The motion carried on the following 5-0 Roll Call vote: Commissioner Castro Yes Vice-Mayor McElyea Yes Commissioner Duke Yes Mayor Flury Yes Commissioner Grace Yes 8.2 RESOLUTION#2012-046 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A LEASE AGREEMENT FOR THE CITY FISHING PIER RESTAURANT WITH DANIA BEACH QUARTERDECK, LLC; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution #2012-046. City Attorney Ansbro noted that changes are still being made to the lease agreement and requested a continuance until the April 24 Commission meeting. Commissioner Castro motioned to continue Resolution #2012-046 until the April 24, 2012 City Commission meeting; seconded by Commissioner Grace. Public Hearings and Site Plans There were no public hearings at this meeting. 10. Discussion and Possible Action 10.1 Schedule Ethics Training Workshop for April 24, 2012 at 6:00 p.m. City Attorney Ansbro advised an Attorney/Client Session is needed on April 24 at 6:00 p.m. to discuss the Airport litigation issue. He noted the Ethics Training would be reset for another date. Commissioner Duke suggested the workshop be held for one hour on another date other than prior to a Commission meeting. Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,April 10,2012—7:00 p.m. Commissioner Castro questioned if a meeting to discuss the Airport issue had been scheduled between May 3-8. City Attorney Ansbro suggested that Commissioner Grace could call in if possible, and we could still have the meeting on May 4, to decide whether or not we are going to terminate the Airport Settlement Agreement. Commissioner Grace said she is not sure if her cellphone will be operable; she will do her best. Mayor Flury suggested the Commission vote on April 24 pending the outcome of the meeting with the Federal Aviation Administration(FAA) on May 3. Commissioner Castro will speak to Attorney Neil McAliley and Broward County suggesting we void the Interlocal Agreement and re-adopt it if all goes well. 10.2 Schedule City Commission Summer Break Commissioner Duke thinks we are too busy to take a break. Mayor Flury suggested the first part of July. It was the consensus of the Commission to break during the first two weeks in July. 11. Commission Comments 11.1 Commissioner Castro Commissioner Castro noted the delay on the creation of the Arts Council is due to some re- wording of the enabling ordinance. She advised she is working with City Attorney Ansbro and Elizabeth Wentworth to bring the final document for Commission approval. Commissioner Castro remarked the importance of the Arts Council and the involvement of people from inside and outside Dania Beach. Commissioner Castro noted that Broward County has written a letter to the FAA regarding their comments on the Interlocal Agreement. She advised that there will be a meeting at the FAA Headquarters in Washington DC on May 3, and Kent George, Director of the Broward County Aviation Department, suggested she should attend. Commissioner Castro referred to the $700,000.00 funds originally available to us from the Broward County Capital Redevelopment Fund. She noted that the City could not meet the deadline for the projects that we were looking at, therefore this money will be lost. However, she wanted to thank Bertha Henry and Cynthia Chambers and other officers at the County, as well as Attorney Michael Moskowitz and City staff for their hard work. Commissioner Castro further provided a history of the allocation of funds to the City. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,April 10,2012—7:00 p.m. Castro asked City Manager Baldwin to follow u on the stop signs on Griffin Commissionerty g p p g Road and I-95. Commissioner Castro spoke about the boat ramp on Davis Isles. She noted it is a dangerous angle and the City needs to take a closer look at it and try to pursue some grant funds. Commissioner Castro advised that the Florida Department of Transportation (FDOT) is having meetings on the East/West Corridor at IGFA on Wednesday, April 18. She encouraged our residents to attend and participate. Commissioner Castro thanked Vice-Mayor McElyea for the new clock for our City Center. 11.2 Commissioner Duke Commissioner Duke advised the Community Development Department will be having their first public meeting regarding the Waterfront Revitalization Plan at 6:00 p.m. on Thursday, April 12, at I.T. Parker Community Center. He invited everyone to attend this important meeting because the residents' input is very valuable to us. Commissioner Duke noted that the American Legion Post 304 will hold an honorary reception for the Military on Saturday, April 28 at 6:30 p.m. Commissioner Duke invited everyone to attend the Grand Opening of the Precious Paws Dog Park on Saturday, April 21 at 10:00 a.m. at P.J. Meli Park. Commissioner Duke reminded everyone of the importance of cultivating our young people and promoting good programs for our youth. 11.3 Commissioner Grace Commissioner Grace noted the March honoring Trayvon Martin, shot on February 26 was well attended. She thanked everyone who participated. Commissioner Grace noted the Women Fishing Tournament will be held on April 20-23. Commissioner Grace further provided an update of past and upcoming community events in the City. 11.4 Vice-Mayor McElyea Vice-Mayor McElyea noted the clock has been installed in the City Center. 11.5 Mayor Flury Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,April 10,2012—7:00 p.m. Mayor Flury thanked Vice-Mayor McElyea and the Dania Beach Improvement Committee for the installation of the clock. 12. Appointments There were no appointments at this meeting. 13. Administrative Reports 13.1 City Manager City Manager Baldwin reported that as a result of new policies and management practices that have been implemented, some of our revenues have gone up at the Marina, Fishing Pier, Beach Parking and Building Fund. 13.2 City Attorney City Attorney Ansbro addressed the US-1 Entryway acquisition and the tentative valuation of the property, which cannot be discussed publicly. He further asked the Commission to motion for a Public Necessity Study and he will report back in two weeks. Commissioner Duke motioned for the City Attorney to conduct a Public Necessity Study; seconded by Commissioner Grace. The motion carried on the following 4-1 Roll Call vote: Commissioner Castro No Vice-Mayor McElyea Yes Commissioner Duke Yes Mayor Flury Yes Commissioner Grace Yes City Attorney Ansbro noted that at the March 27 Regular Meeting, the Commission approved the contract with Green Construction Technologies (GCT) for the US-1 Right-of-Way Landscape Phase 2 project, based on the successful soft digs for $12,000.00, for a maximum bid amount of $1.2M. He advised that Patrick Erwin from GCT is here to provide the Commission with two options to achieve the soft digs operations. They are suggesting Option 2 because most of the aspects of this operation are called for and priced in the contract. City Attorney Ansbro recommended the Commission approve Option 2 for $80,135.00,with an allowance of$8,000.00 for unavoidable damage to adjacent concrete, and a limited Notice to Proceed with the soft digs; ultimately returning to the Commission with results. Commissioner Castro motioned to move forward with the recommendation of the City Attorney; seconded by Commissioner Duke. She said don't crowd them, because the Commission will have changes and comments to make on the budget and they need time to discuss them. 14.
