MINUTES OF REGULAR MEETING DANIA BEACH CITY COMMISSION TUESDAY, MAY 8, 2012— 7:00 P.M. 1. Call to Order/Roll Call Mayor Flury called the meeting to order at 7:00 p.m. Present: Mayor: Patricia A. Flury Vice-Mayor: C. K. "Mac"McElyea Commissioners: Anne Castro Walter Duke Bobbie H. Grace City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Commissioner Anne Castro gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals Neal McAliley, Special Counsel for Airport Matters, provided an overview of the meeting held with the Federal Aviation Administration (FAA) on May 3. He advised that we have now received a written response from the FAA stating they do not currently see the Early Benefit Program as being eligible for Federal Aviation grant funding. It seems that they are not willing to approve the transfer of plats 7 and 8. They also addressed the Voluntary Night Closure issue. Attorney McAliley indicated that the Commission has 60 days to vote on voiding the Settlement Agreement, beginning May 7. He recommended giving ourselves a short period of time to work with Broward County and the FAA, to see if we can turn this around, or if the County wants to put something else on the table. Attorney McAliley further suggested deferring this item for two weeks until the next Commission meeting; if we are unable to come to a resolution, he will recommend to void the Agreement. He added that the goal of the City and the Commission is to protect the residents and two more weeks will not make a big difference. 3.4 Presentation by Chair and members of Airport Advisory Board regarding Settlement Agreement Linda Sacco, 4496 SW 34th Terrace, Chairman of the Dania Beach Airport Advisory Board, advised that the Airport Advisory Board recommended that the Settlement Agreement be rejected and the 1995 Interlocal Agreement should be returned. She noted the Board's recommendations are: 1) Give FAA and Broward County no more than two weeks to work out the differences; the City should then void the Settlement Agreement and revert to the 1995 Interlocal Agreement. The Board further urges the Commission to go forward with legal procedures to ensure its ability to challenge permitting actions regarding the expansion of the south runway. 2) Request a list of condemnation lawyers to be created by the Board and posted on the City website. Commissioner Castro commended the Airport Advisory Board for their work on this matter. Addendum 10.3 Consideration of Voidability Option Pursuant to Paragraph 6 of City-County Airport Settlement Agreement City Attorney requested a motion to continue this item until the May 22, 2012 City Commission meeting,preceded by an Attorney/Client Session on the same matter at 6:00 p.m. Commissioner Castro motioned to continue Item #10.3 until the May 22, 2012 City Commission meeting at 7:00 p.m., with an Attorney/Client Session at 6:00 p.m.; seconded by Commissioner Grace. The motion carried on the following 5-0 Roll Call vote: Commissioner Castro Yes Vice-Mayor McElyea Yes Commissioner Duke Yes Mayor Flury Yes Commissioner Grace Yes 3.1 Presentation to Kristen Jones—Mayor Flury Mayor Flury commended Kristen Jones on her accomplishments as Director of Parks and Recreation. 3.2 Boyette Strategic Advisors—Economic Development Strategic Plan Ana Zeinieh, Economic Development Director, noted the importance of the input received from all the interested parties involved in the preparation of the Economic Development Strategic Plan. Tracy Sharp, Boyette Strategic Advisors, noted this community has a great potential from an economic development perspective and the City is on the right track. She presented a PowerPoint overview of their blueprint, which was included in the agenda packet. Ms. Sharp noted the blueprint they developed is meant to provide direction to Dania Beach in their economic development efforts over the next five years. Commissioner Castro asked whether Boyette would provide a list of recommendations of places in the City that the Commission should contact. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,May 8,2012—7:00 p.m. Ms. Sharp advised that they included some recommendations for the City to focus on having more staffing devoted to retail, as well as information that should be posted to the City website supporting the retail argument. Commissioner Duke noted Boyette's recommendations were very valuable, although some of them in the funding area are out of our hands. He further commented that the City has a lot of natural assets and questioned what mistakes we should learn from, in terms of redevelopment. Ms. Sharp noted it could be lack of involvement from the community during the good economic years. Commissioner Castro noted the community believed differently than what the local government thought at the time, although they were ready for a change. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Betty Sokol, 609 NW 10th Street, thanked everyone for their condolences and support on the loss of her husband. Victoria Payne, Executive Director, Dania Beach Chamber of Commerce, provided an update of Chamber events. Patricia Tyra, 2912 SW 54th Street, noted May 6-12 is American Nurses Week, an opportunity to recognize the contributions of the nurses in our nation and the important role they play in America's healthcare system. Teddy Bohanan, 312 SW 15th Street, noted we have been trying for years to clean the SW area from drug dealers. She stated she is against letting landlords who do not live in the City, bid on the properties which are currently closed. Ms. Bohanan remarked the community should have the opportunity to participate in the selection of the prospective buyers. Lastly, she urged the Commission to draft a resolution preventing this type of people from buying these houses. Commissioner Castro noted she is willing to work with the City Attorney to prepare a resolution for Commission consideration. 6. Public Safety Reports Donn Peterson, BSO Chief of Police, noted Mr. Udell's ice cream truck was stolen and they are working on the case. He also reiterated his love and support to Betty Sokol. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,May 8,2012—7:00 p.m. Commissioner Castro thanked BSO for taking care of the issues in Melaleuca Gardens as well as the NE area. She further read into the record a letter she wrote to Sheriff Al Lamberti, which is attached to and incorporated into these minutes. The letter relates to the death of Dick Sokol and commends Commander Michael Grimm for his integrity,honesty and humanity. Charles Raiken Deputy Fire Chief of Administration, B o , SO Fire Rescue advised that the p Y , Sheriff's Community Day would be held at Bass Pro Shops on Saturday, May 12, from 10:00 a.m. to 3:00 p.m. He noted he is retiring at the end of May, after 34 years of service. 7. City Attorney Ansbro read the title of Resolution#2012-055. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,May 8,2012—7:00 p.m. Commissioner Duke noted this is a concept that he likes and supports; however, he is concerned that this resolution provides for eminent domain, and it is too risky. He pointed out that if we lose this case, it could cost the City millions of dollars in legal fees. Commissioner Duke further suggested we negotiate with the property owner, or let the Cynergie Group negotiate a deal to purchase the property. Lastly, he remarked that he cannot support this resolution as written. Commissioner Castro noted this resolution sets the groundwork as to why we need the roadway. We do not know if there will be a lawsuit; furthermore, she does not want to purchase the owners' entire property because the City does not need it. She stated that this resolution does not start an action of eminent domain and she will support it. Vice-Mayor McElyea does not believe in eminent domain. He thought it was not necessary for the City to do that. Mayor Flury stated that without that roadway, we do not have a City Center. She further noted she does not want us to be frightened. Commissioner Grace motioned to deny Resolution #2012-055; seconded by Commissioner Duke. City Attorney Ansbro read the title of Resolution#2012-056. Commissioner Castro thanked Elizabeth Wentworth, Wentworth Creative Management, Inc., for her expertise and cooperation in this process. She noted we wanted to bring in every element of the City to make it a citywide community effort. Commissioner Castro motioned to adopt Resolution #2012-056; seconded by Commissioner Grace. (Continued from April 10 and April 24, 2012) City Attorney Ansbro read the title of Resolution#2012-046. Commissioner Castro noted they only received the document electronically at 4:30 p.m. today. She reviewed some of the items on the lease agreement. City Attorney Ansbro noted that there is a list of certain items that the City needs to address to prepare the building for their use. Commissioner Castro motioned to adopt Resolution #2012-046; seconded by Commissioner Duke. She advised that Footnote #25 should be struck from the ordinance. Ms. Lajoie indicated that both the Planning and Zoning Board and staff recommend approval of the text amendments. Mayor Flury opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Patricia Tyra, 2912 SW 54th Street, questioned the setbacks for storage units which relate to mobile homes. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,May 8,2012—7:00 p.m. Ms. Lajoie clarified that PODS are considered temporary storage facilities and this ordinance refers to permanent storage containers. Commissioner Castro motioned to adopt Ordinance #2012-008, without Footnote #25, on second reading; seconded by Commissioner Grace. Discussion and Possible Action 10.1 Beach Improvements—City Manager Baldwin City Manager Baldwin provided an overview of his memo that was included in the agenda packet. Mayor Flury confirmed with City Manager Baldwin that the Public Services Department will be responsible for beach maintenance. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,May 8,2012—7:00 p.m. Commissioner Duke clarified that there is no commercialization on this plan; we are just cleaning our beach. He spoke about coastal erosion and requested that the City Manager look into the Broward County Beach sand by-pass project. Commissioner Duke also noted that Florida Atlantic University(FAU) may do some cuts on their funding and he would like the City to consider whether we still want FAU there or if there are any other options we should consider. Mayor Flury noted that FAU has a 99-year lease with the City. She thought these were items we could discuss during budget time. Commissioner Grace requested that BSO increase their patrols at the beach. Commissioner Castro pointed out that it is important for people using the beach to clean-up after themselves, although we may want to discuss making some adjustments for beach maintenance during budget time. She further spoke about beach re-nourishment and provided an update of related meetings during her recent visit to Washington DC. Commissioner Castro suggested this item should also be included in the budget process. Lastly, she advised that Joshua Gaboton, Alcalde and Fay, and Assistant City Manager Donnelly have both been working on this matter. Justin Freedman, Metric Engineering, presented a PowerPoint overview of the dune revegetation project which is attached to and incorporated into these minutes. 10.2 Decorative Solar Street Lights—Assistant City Manager Donnelly Mayor Flury noted she would like to see a recommendation; not black and white pictures. Oscar Bello, Chen Moore and Associates, referred to the pictures included in the agenda backup. He noted they recommend the 3rd fixture for the conventional roadways, which would be more efficient, cheaper and also meets the Florida Building Code requirements. Mr. Bello further advised that the 1" fixture could be incorporated into the walkway areas in the neighborhood Oasis program. Commissioner Castro asked Mr. Bello how long it would take for the manufacturer to provide the parts for defective solar lights. Mr. Bello advised that it would take 3-4 weeks to receive the parts. He added that they have told the manufacturer this is not acceptable and asked them to furnish them in advance. 11. Commission Comments 11.1 Commissioner Castro Commissioner Castro noted Jim Silvernale requested a proclamation to celebrate the Lions Club anniversary in July. Commissioner Castro thanked all those involved in the"Take your Child to work day". Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,May 8,2012—7:00 p.m. Commissioner Castro thanked Henry Sniezek of the Broward County Planning Council for all his help during his tenure as Executive Director. Commissioner Castro noted the community events citywide. Commissioner Castro spoke about the Airport litigation issue. She explained that the Airport authorities do not want to use eminent domain because if a public entity takes a property for private use, not for public purposes, they have to keep it for five years,per the statute. She asked for Commission consensus to work with Carol Duncanson, our lobbyist, to allow FAA noise exception to the statute,which would help the homeowners. The Commission agreed to Commissioner Castro's request. 11.2 Commissioner Duke Commissioner Duke thanked the Commission for approving the Quarterdeck lease tonight. He thought it is a very good deal for the City. Commissioner Duke asked the City Manager where we were at with the RFP for cleaning-up the common areas in the City. 11.3 Commissioner Grace Commissioner Grace noted the community events she attended. Commissioner Grace noted CW Thomas Park looks great with the laser grade and re-sod work recently completed. Commissioner Grace would like the Oasis project implemented in the Byrd Point area. Commissioner Grace thanked those involved in the cleaning of CW Thomas Park and Frost Park. 11.4 Vice-Mayor McElyea Vice-Mayor McElyea had no comments. 11.5 Mayor Flury Mayor Flury had no comments. 12. Appointments Commissioner Grace appointed Annette Hibbitts and Kathryn Philpart to the Airport Advisory Board. Commissioner Castro appointed Bo Donley to the Arts Council. Commissioner Grace appointed Myrtle Corbin to the Arts Council. Commissioner Duke appointed Jeff Hanson to the Arts Council. Vice-Mayor McElyea appointed Chickie Brandimarte to the Arts Council. Commissioner Castro motioned to approve the appointments; seconded by Commissioner Duke. The motion carried unanimously. 13. Administrative Reports 13.1 City Manager City Manager Baldwin had no comments. 13.2 City Attorney City Attorney Ansbro had no comments. 13.3 City Clerk - Reminders City Clerk Stilson reminded everyone interested in running for City Commission that qualifying begins at noon on Monday, June 4 and ends at noon on Friday, June 8. As you may be aware, the Dania Beach community recently lost one of our finest residents and friends, Richard "Dick" Sokol. Dick and his lovely wife, Betty, have volunteered countless hours in our community and unconditionally helped others. This service included hundreds of hours in the COP program, maintaining and driving a patrol vehicle, training others, and serving as the eyes and ears for BSO's patrol deputies. In addition, they cared for their neighbors and volunteered countless hours for their homeowners association. They were members of the CERT program and were active in their church. Betty and Dick always served with a smile, wink and in such a positive manner, they had a positive effect on everyone with whom they came into contact. When Dick passed, you can only imagine the devastating impact on his wife Betty, their family, friends and community. While we were all struggling with our grief, we searched for some meaning and strength in Dick's death. Well, during Dick's memorial service, we found it. It came in the humanity of Commander Grimm. Since Mike lives in Dania Beach and was even a neighbor of Dick and Betty's, he not only was able to convey the feelings of the agency, but also personal feelings about Dick (and Betty), that moved and touched us all. It helped the entire community cope with this loss of a dear friend and asset to our city. Commander Grimm represented BSO in the most brilliant manner with integrity, honesty and humanity. It was absolutely incredible. He is a huge asset to your organization and the city of Dania Beach and he really made us all proud. We wanted you to know that. I would also respectfully request this letter be added to Commander Grimm's personnel file as this type of leadership under duress should be noted!
