HomeMy WebLinkAboutR-2012-072 - Requested Advance Approval from Commission to Advertise for Bids for Dania Beach Marine Project RESOLUTION NO. 2012-072 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, REQUESTING ADVANCE APPROVAL FROM THE CITY COMMISSION OF THE CITY OF DANIA BEACH FOR ADVERTISEMENT OF THE CAPITAL PROJECT KNOWN AS THE DANIA BEACH MARINA PROJECT, WHERE BIDDING IS EXPECTED TO BE SOUGHT BY THE OFFICE OF THE CITY MANAGER; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on September 27, 2011, the City Commission adopted Ordinance No. 2011-032, which created Section 2-16 of the City Code of Ordinances, and that Section provides that the CRA and all City Departments, Divisions and City Staff, prior to placing an item on a City Commission Agenda for formal City Commission approval for competitive bidding or for waiver of bidding, shall obtain advance City Commission conceptual approval by Resolution of any proposed capital project or capital purchase appropriated in the City Budget approved by the City Commission when bidding would otherwise be required and the Resolution shall also identify all sources of planned funding including appropriations of available cash balances, loans and grants; and WHEREAS, this project is planned to be funded from an array of sources including the following: • Broward County Marine Advisory Board $1.3 million pending • Florida Inland Navigation District $2.5 million pending • Florida Dept. of Environmental Protection $ .5 million pending • City General Fund—Project Grant Match appropriations $2.5 million approved ■ Estimated total funding $6.8 million; and WHEREAS, the City Administration recommends seeking bids for this project at this time while acknowledging and agreeing that no bid shall be awarded on this project until and unless funding sources for the award have been identified, approved and appropriated by the City Commission; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the Office of the City Manager is authorized to proceed with the bidding of the capital project known as the Dania Beach Marina Improvement Project. Section 2. That the City acknowledges award of this project bid is planned and dependent on funding approval from a variety of sources including grant applications and City cash appropriations and therefore, the Administration acknowledges and agrees that no bid shall be awarded on this project until and unless funding sources for the award have been identified, approved and appropriated by the City Commission. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4.
