Call to Order/Roll Call Mayor Flury called the meeting to order at 7:00 p.m. Present: Mayor: Patricia A. Flury Vice-Mayor: C. K. "Mac"McElyea Commissioners: Anne Castro Walter Duke Bobbie H. Grace City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Commissioner Grace gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals Addendum 3.3 Airport Advisory Board Recommendations — Marc LaFerrier, Interim Director, Community Development Bob Mikes, Vice-Chairman of the Airport Advisory Board, reviewed the three motions made by the Airport Advisory Board at their June 28t'meeting that were included in the backup materials. He noted that more recommendations would be coming at the next meeting. Commissioner Castro questioned if they envisioned a paid or voluntary position for the ombudsman, or a City staff person, which we already have in Interim Director of Community Development Marc LaFerrier. She felt the airport issue should have its own page on the City's website and explained why blogging may be a bigger challenge. She would like to review and talk to the City Attorney on these issues. Regarding the dredging material issue, there is language in the Interlocal Agreement that either prevents its use or provides for compensation if it is used; we will re-review that agreement. 3.1 Request for PILOT (Payment in Lieu of Taxes) Waiver from the Dania Beach Housing Authority—Rita Brown, Executive Director Commissioner Castro motioned to waive the PILOT for the Dania Beach Housing Authority for FYE 9/30/2011, FYE 9/30/2012, and FYE 9/30/2013; seconded by Commissioner Grace. The motion carried on the following 5-0 Roll Call vote: Commissioner Castro Yes Vice-Mayor McElyea Yes Commissioner Duke Yes Mayor Flury Yes Commissioner Grace Yes 3.2 Special Event request from the Broward Sheriffs Office Fire Department/Quarterdeck Restaurant for a "Car Wash" to benefit the American Cancer Society. The event will be held Saturday, July 28, 2012 from 10:00 a.m. - 3:00 p.m. in the Dania Beach Marina parking lot. The applicant is also requesting a special event permit fee waiver. Commissioner Grace motioned to approve the Special Event request and fee waiver for the BSO Fire Department/Quarterdeck Restaurant Car Wash; seconded by Commissioner Castro. Proclamations There were no proclamations at this meeting. 5. Citizen Comments George Jason, 4549 SW 37 h Avenue, advised of the passing of Griffith George. Kevin Schwartz, on behalf of Steve Paoletta, 701 Natures Cove Road, distributed a handout to the Commission and addressed the stop signs installed on 51h Avenue. He noted that Mr. Paoletta proposed alternative locations for the signs at 71h Street, which would be in front of areas where homes are not located and therefore alleviate noise problems. Mayor Flury noted that the City Manager and Director of Public Services would address the situation. Representative Elaine Schwartz introduced herself to the Commission and residents; she is our new representative due to the redistricting. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,July 24,2012—7:00 p.m. 6. Public Safety Reports Donn Peterson, BSO Chief of Police, congratulated Detective Holly Tucker as the Dania Beach District Employee of the Month for July for her efforts on the apprehension of chop shop operators. He invited everyone to National Night Out Against Crime, scheduled for August 7th at P.J. Meli Park. 7. City Attorney Ansbro read the title of Resolution#2012-083. Vice-Mayor McElyea thought we contracted out our service and questioned why we needed a mower. City Manager responded this is for areas other than medians and rights-of-way that are maintained by City staff. (FIRST READING) City Attorney Ansbro read the title of Ordinance#2012-015. Corinne Lajoie, Principal City Planner, reviewed the three areas of the zoning code pertaining to community gardens or urban farms, farmers markets, and public parking incentives that would be amended, and noted the requests were made by the Community Redevelopment Agency. Commissioner Grace questioned if the residents and schools would partner in the community garden. Director Earle responded the garden would be organic and the City would partner with the schools and City master gardeners. Mayor Flury opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Commissioner Duke motioned to adopt Ordinance #2012-015, on first reading; seconded by Commissioner Castro. He asked the Commission to disclose any communication they had on this matter. 9.2 RESOLUTION#2012-082 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN REQUEST SUBMITTED BY JODY OBERHOLTZER, MANAGING MEMBER OF GREEN OAKS LLC, FOR PROPERTY LOCATED AT 2960 SW 23 TERRACE IN THE CITY OF DANIA BEACH, FLORIDA;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2012-082. Corinne Lajoie, Principal City Planner, provided an overview of the request. Mayor Flury opened the Public Hearing. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,July 24,2012—7:00 p.m. Commissioner Castro motioned to adopt Resolution #2012-082, with staff recommendations; seconded by Commissioner Duke. Discussion and Possible Action 10.1 Discussion of business incentives and transfer of funds from City to CRA — Jeremy Earle, CRA Executive Director Director Earle noted this is a two-part discussion tonight. The first is for additional funding for the fagade and merchant assistance incentive programs, which was approved by the CRA Board at their last meeting. City Manager Baldwin noted funds would come from General Fund contingency. Commissioner Castro motioned to transfer $60,000.00 from City contingency to the CRA for the incentive programs; seconded by Commissioner Grace. The motion carried on the following 5-0 Roll Call vote: Commissioner Castro Yes Vice-Mayor McElyea Yes Commissioner Duke Yes Mayor Flury Yes Commissioner Grace Yes Director Earle advised the second discussion also relates to business incentives as there is a freight company considering moving to Dania Beach, bringing 85 jobs. They are negotiating a state incentive totaling $510,000.00 that requires a 20% local match, which would be split between Broward County and the City. The Dania Beach portion would be $51,000.00 over a four year period, amounting to approximately $12,750.00 per year. Director Earle noted direction is needed from the Commission as the company is ready to sign a lease on August 14a` and on that same date, a resolution will be brought to the Commission that if approved, will be taken to the Broward County Commission for approval of their portion. Commissioner Castro questioned the particulars of the jobs to be brought to the City. Director Earle responded the pay would average nearly $50,000.00 per year and residents would want to go for these jobs. City Manager Baldwin noted there is not an issue with the funding for four years. Commissioner Castro motioned to move forward with this incentive and to hold additional discussion about this program; seconded by Commissioner Grace. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,July 24,2012—7:00 p.m. Mayor Flury commented that while this is a great idea, we are too small of a City to provide incentives to bring companies to the City. In a case like this, the landlord will benefit more than the City. Our budget is getting tighter, no one wants to raise taxes, and she remains opposed to these kinds of incentives. Commissioner Grace asked if we could place a caveat for a job fair and ask that they hire Dania Beach residents. Ana Zeinieh, Economic Development Manager, responded we can propose that they look in Dania Beach first and she explained the Enterprise Zone, which is the bigger incentive to hire City residents. She spoke about companies also qualifying for a training grant that commits them to looking in the community first. Mayor Flury questioned if there is a way to determine the percentage of employees of these companies who actually live in Dania Beach. We should not be under the illusion that we are necessarily bringing jobs to the City. Commissioner Castro wants Dania Beach residents to get preference; however the key is to get people to work in our City and spend money here. The City's investment in this instant case is a small percentage of the overall incentive and she would like us to do this whenever we can. Commission Comments 11.1 Commissioner Castro Commissioner Castro distributed a packet to the Commissioners from the Florida League of Cities pertaining to amendments to the Charter and Bylaws to be voted on at the upcoming conference. As the voting delegate for the City, she requested opinions from the Commission on voting in favor of the amendments. Commissioner Castro noted there would likely be a Shade meeting held soon regarding the airport issue relative to the strategy going forward. Commissioner Castro addressed the lack of mowing and maintenance along the Griffin Road corridor, noting she wrote to Mayor Bober and Jim Wolfe and is awaiting responses. She asked the City Manager to set up a meeting and to provide a diagram depicting which agency is responsible for maintenance of which areas along the corridor. She also reached out to County Mayor Rodstrom relative to maintenance of the outside of the wall in Melaleuca Gardens. Commissioner Duke extended thoughts and prayers to Vice-Mayor McElyea's son, Tommy. 11.3 Commissioner Grace Commissioner Grace spoke about recent and upcoming community and social events. 11.4 Vice-Mayor McElyea Vice-Mayor McElyea expressed concern with the darkness on Dania beach, which is a danger to people walking in the evening, and felt something should be done to increase the lighting. Vice-Mayor McElyea complimented Dominic Orlando, Director of Public Services, on the drainage in the southeast section. Vice-Mayor McElyea commented on the southwest roundabouts on 2nd Avenue, noting because of their size, a rescue unit passing through will either run over it or run out onto the swale. There are things we can do better with a little planning. 11.5 Mayor Flury Mayor Flury commented that Boyd Gaming has signed an agreement with Sunrise Sports to open a casino in the Bank Atlantic Center area. They are hoping the portability issue gets approved by the legislature because nothing can happen unless the Dania Beach license gets transferred. We will oppose the portability issue as we do not want to lose our licenses. Mayor Flury advised that anyone delivering absentee ballots should take precautions due to past issues with recipients. 12. Appointments Commissioner Castro appointed Chris Johnston to the Airport Advisory Board. Commissioner Castro appointed Kyle Hannover to the Marine Advisory Board. Commissioner Grace motioned to approve the appointments; seconded by Vice-Mayor McElyea. The motion carried unanimously. 13. Commissioner Castro motioned that the Commission subject itself to the eight hours calendar year ethics training; seconded by Commissioner Duke. The motion carried unanimously. No. 1, Have it removed. I don't see a slow down in the traffic. it just stops it for a second.Two signs won't change the driving habits of the people using it as an expressway it just aggravates them and they become more aggressive. I'm seeing all the same issues with the passing and speeding .The only difference is its louder.Additionally,,because many people don't stop for what ever reason,whether they are in too much of a hurry or just not paying attention its just going to lead to accidents at the intersections. Aside from the 2X the increase in noise inside and outside my house. I believe its too dose to the North entry to Nature's Cove. The North bound stacking space maybe only 3 cars at the most.That's not much for a street with its current traffic count.The count is only going to go up or during season it's always higher. tt's going.to block the residents from entering and exiting into Natures Cove. The South bound issue is another concern. I was almost rear ended turning.South on 7th by a carthat failed to stop. it's too close. It's just not safel No. 2, If the City thinks its working then have it relocated. Place it at the intersection to the North of 7th Street which has no house on the East side and the West side has the large R0W., or place it 2 blocks to the South closer to Sheridan Street which is closer to the beginning of the linear park. Why put it in front of a house so dose to the street where there are other options with less impact Why should I have to be uncomfortable in my own house. i listen to thousands of cars and trucks day and night slamming on the gas producing sound levels from 45-90 dB. That's not pleasant at noon and Ws extremly unpleasant at 4 am.The delivery trucks are even worse. That is equivalent to and worse than someone starting a chainsaw outside my house. How will I be able to open my windows in the winter? Not only will the noise be ridiculous but what about the diesel and gas furnes? This street has issues. How about putting in 3 sets of"know your speed radar"devises.They slow down some people.What it needs most is police presence.
