HomeMy WebLinkAboutO-2012-018 Residence Inn Delegation Request ORDINANCE NO. 2012-018 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE DELEGATION REQUEST SUBMITTED BY LOU CAMPANILE, JR. OF McLAUGHLIN ENGINEERING COMPANY, ON BEHALF OF SUNBELT-RDF, LLC, TO AMEND THE NON- VEHICULAR ACCESS LINE AND CHANGE THE RESTRICTIVE NOTE ON THE PLAT KNOWN AS THE "SHOPS AT GRIFFIN SUBDIVISION", PREVIOUSLY RECORDED IN PLAT BOOK 178, PAGE 92, AND GENERALLY LOCATED AT 4801 ANGLERS AVENUE, DANIA BEACH; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the boundary plat known as "Shops of Griffin Subdivision" was approved by the Dania Beach City Commission on November 14, 2006, by Ordinance No. 2006-033, a copy of which plat is attached to this Ordinance as Exhibit"A"; and WHEREAS, Lou Campanile, Jr. of McLaughlin Engineering Company on behalf of Sunbelt-RDF, LLC, has applied for a delegation request to change the restrictive note on the Plat as follows: DR-23-12—Plat Note Amendment Replace Existing Language on Note: THIS PROPERTY IS RESTRICTED TO 48,000 SQUARE FEET OF COMMERCIAL USE. FREESTANDING BANKS AND DRIVE THRU BANK FACILITIES ARE NOT PERMITTED WITHOUT THE APPROVAL OF THE BOARD OF COUNTY COMMISSIONERS WHO SHALL REVIEW AND ADDRESS THESE USES FOR INCREASED IMPACTS. ANY STRUCTURE WITHIN THE PLAT MUST COMPLY WITH SECTION IV D.LF., DEVELOPMENT REVIEW REQUIREMENTS OF THE BROWARD COUNTY LAND USE PLAN, REGARDING HAZARDS TO AIR NAVIGATION. THIS NOTE IS REQUIRED BY CHAPTER 5, ARTICLE IX, BROWARD COUNTY CODE OF ORDINANCES, AND MAY BE AMENDED BY APPROVAL OF THE BROWARD COUNTY BOARD OF COUNTY COMMISSIONERS. THE NOTATION AND ANY AMENDMENTS THERETO ARE SOLELY INDICATING THE APPROVED DEVELOPMENT LEVEL FOR PROPERTY LOCATED WITHIN THE PLAT AND DO NOT OPERATE AS A RESTRICTION IN FAVOR OF PROPERTY OWNER INCLUDING ANY OWNER OR OWNERS OF PROPERTY WITHIN THIS PLAT WHO TOOK TITLE TO THE PROPERTY WITH REFERENCE TO THE PLAT. With Proposed Language on Note: THIS PROPERTY IS RESTRICTED TO 159 HOTEL ROOMS. THE NOTATION AND ANY AMENDMENTS THERETO ARE SOLELY INDICATING THE APPROVED DEVELOPMENT LEVEL FOR PROPERTY LOCATED WITHIN THE PLAT AND DO NOT OPERATE AS A RESTRICTION IN FAVOR OF PROPERTY OWNER INCLUDING ANY OWNER OR OWNERS OF PROPERTY WITHIN THIS PLAT WHO TOOK TITLE TO THE PROPERTY WITH REFERENCE TO THIS PLAT; and WHEREAS, Lou Campanile, Jr. of McLaughlin Engineering Company on behalf of Sunbelt-RDF, LLC, has applied for an amendment to the Non-Vehicle Access Line shown on the plat as shown in Exhibit`B"; and WHEREAS, on June 20, 2012, the Planning and Zoning Board recommended that the City Commission approve the delegation request DR-23-12; and WHEREAS, Broward County requires that the City Commission of the City of Dania Beach concur with this revision prior to a review by the Broward County Commission; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City of Dania Beach approves the proposed revision which amends the current non-vehicular access line and changes the restrictive note on the Plat to allow 159 hotel rooms on the "Shops of Griffin Subdivision", as previously recorded in Plat Book 178, Page 92. Section 2. That all ordinances or parts of ordinances in conflict with this Ordinance are repealed to the extent of such conflict. 2 ORDINANCE#2012-018 Section 3.
