RESOLUTION NO.2021-179 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN MODIFICATION (SP- 052-16MOD2), SUBMITTED BY DANIA BEACH RENTALS, LLC, FOR THE PROPERTY LOCATED AT 601 EAST DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO AND INCORPORATED BY REFERENCE INTO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Chapter 28, the "Land Development Code" (the "LDC"), Part 6, entitled "Development Review Procedures and Requirements," Article 635, entitled "Site Plans" of the City Code of Ordinances (the "City Code") provides that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, on February 14, 2017, the Dania Beach City Commission passed and adopted Resolution No. 2017-002, approving a Site Plan submitted by Dunay, Miskel & Backman, LLP on behalf of the owner, Calm Properties, LLC (the "Applicant"), for the proposed construction of a new fourteen (14) story (360 units) multifamily residential development, and sixty-nine hundred (6,900) square feet of commercial development (SP-52-16) for property located at 601 East Dania Beach Boulevard in the City of Dania Beach, Florida (the "Property"), as legally described in Exhibit "A", a copy of which is made a part of and incorporated into this Resolution by this reference; and WHEREAS, on October 28, 2019, the Dania Beach City Commission passed and adopted Resolution No. 2019-139, approving a Site Plan submitted by Calm Properties, LLC (the "Applicant"), for the proposed construction of a new thirteen (13) story (381 units) multifamily residential development, and two thousand (2,000) square feet of commercial development (SP- 51-16MOD) for property located at 601 East Dania Beach Boulevard in the City of Dania Beach, Florida (the "Property"), as legally described in Exhibit "A"; and WHEREAS, Dania Beach Rentals, LLC (the "Applicant") is requesting approval of a modified site plan for the proposed construction of a new 385-unit residential development (SP- 052-16MOD2) as referenced in Exhibit `B," a copy of which is made a part of and incorporated into this Resolution by this reference, for property located at the Property; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the revised Site Plan (SP- 052-16MOD2) is consistent with the City's Land Development Code and Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by this reference. Section 2 That pursuant to Chapter 28 "Land Development Regulations," Part 6 "Development Review Procedures and Requirements," Article 635 "Site Plans," the following Site Plan Modification (SP-052-16MOD2), attached as Exhibit `B," is approved subject to compliance with the following conditions which must be satisfied prior to issuance of a building permit unless a different timeframe is specified within a specific condition (references to Sections are to those in the LDC): 1. The FDOT Pre -Application letter and/or the Driveway Permit will be required to be submitted when received. (TRAFFIC) 2. Updated Traffic Statement trip generation table must be revised to include the deduction for the existing trips for both the previously approved uses and the proposed use. (TRAFFIC) 3. The revised landscape requirements data table on sheet L-200 indicates 178 trees are being provided in the landscape plan, but the plant list appears to indicate 343 trees are proposed for the project (not including the 8 newly added Coconut Palms which are considered a Category II invasive species and do not count towards landscape or mitigation requirements). Please revise the "provided" column in the landscape data table to indicate the actual total number of qualified trees being proposed for each code category, ensure the sum total adds up to the overall trees provided in row 9 of the table, and ensure the difference between these proposed trees and required trees is reflected as the mitigation trees in row 8 of the table. (LANDSCAPE) 4. The City's native tree requirements percentage (Sec. 275-60) does not exclude palm trees. Please revise the bottom row of the landscape requirements table to include palm trees in the total required and total provided calculations. (LANDSCAPE) 5. Update the mitigation calculations in sheet L-100 to reflect the revised disposition of specimen tree 76, and the modified landscape plan/surplus trees identified in the landscape data table. Additionally, this section identifies trees 81 and 82 as specimen trees but these royal palms do not meet specimen size criteria. Ensure the updated calculations are reflected correctly in the landscape data table (currently an incorrect subtotal canopy of 9,735 sq. ft. is shown). (LANDSCAPE) 6. Revised impervious design appears to create a conflict with Sec. 275-190(H) which established minimum spacing of trees from impervious areas and structures. Please adjust tree locations to satisfy applicable spacing requirements. (LANDSCAPE) 2 RESOLUTION #2021-179 7. Trees 5, 26-29, 50-56, 84, and 85 are Category 1 and 2 invasive species that do not require 150% canopy mitigation. Category 1 invasives only require 25% mitigation, and Category 2 invasives require 100% canopy mitigation. (LANDSCAPE) 8. The Landscape Data Table references street tree requirements per Sec. 507-20 of the City's code. This correct section should be referenced as 307-20. (LANDSCAPE) 9. The Landscape Plan uses letters to designate which code requirement is being satisfied by proposed trees, but many trees have no designation so staff cannot verify which requirement they are intended to contribute towards. (LANDSCAPE) 10. In order to allow the driveway along the west lot line, an NVAL amendment is needed. Submit a plat modification application in accordance with Article 640 prior to building permit. The replat will require approval by the City Commission. (PLANNING) 11. A recorded copy of the revised plat is required prior to issuance of a building permit. (PLANNING) 12. When submitting for building permits, include a narrative with responses to these conditions of approval. (PLANNING) 13. The corner element to the east is removed from the site plan. Revise 3-D rendering to reflect this change or remove graphic from plan sets. (PLANNING) 14. Provide the size of the new, last unit to the east, which may be no less than 500 SF; per Sec. 230-40.A. (PLANNING) 15. PHOTOMETRICS Provide a revised photometric plan which meets the requirements of Sec. 280-40. Light levels at the property lines, abutting residential properties cannot exceed 0.5 f.c. Please note that the sheet submitted with the building permit was not consistent with this code requirement. (PLANNING) 16. DUMPSTER: On site plan, identify dumpsters which shall be consistent with Article 290. (PLANNING) 17. Improve Gulfstream Road to rehabilitate the entire roadway width, including resurface, pavement markings, signage, new sidewalk and new right turn lane onto Dania Beach Boulevard and any necessary transitions, per Resolution No. 2017-002. Provide timeline and designs for review by staff. (PLANNING) 18. Provide a two foot (2') wide by forty foot (40') long paved bus landing pad (8' total expanded sidewalk) on Dania Beach Boulevard commencing 150 feet east of west plat limit & continuing east for forty feet (40'), per Broward County Development Review Report, per Resolution No. 2017-002. Provide designs and status. (PLANNING) 19. Prior to issuance of a certificate of occupancy, the Applicant shall construct a southbound left turn lane at the intersection of Gulfstream Rd and East Dania Beach Blvd and a northbound left turn lane at the site entrance on Gulfstream Rd; per Resolution No. 2017- 002 and conditions of approval by Traffic Consultant dated 1/17/20. (PLANNING) 20. OPEN SPACE IMPACT FEE: Per Resolution No. 2015-071, the total impact fee for Recreation and Open Space for this development is $525,140 (385 X $1,364). A total of $434,340 was received when permit #20-00001300 was issued. The balance of $90,800 will be due at time of building permit issuance. (PLANNING) 21. RAC TRAFFIC IMPACT MITIGATION: Per Resolution No. 2014-049, the RAC Traffic Impact Mitigation for the 385 units proposed is $2,444.9 ($21.26 per PM peak trip x 115 trips). The fee for the previous configuration of this project amounted to $2,507.50 (118 PM Peak trips x $21.26) and was received when permit #20-00001300 was issued. At 3 RESOLUTION #2021-179 building permit issuance, a credit in the amount of $62.60 will be issued to the developer. (PLANNING) 22. PUBLIC ART PROGRAM: At the time of issuance of permit number 2020-00001300, the applicant paid a total of $250,000 (0.5% of project cost) towards the Public Art Program and in accordance with Article 811. The final amount due for the Public Art Program will be determined when the revised building permit is issued. (PLANNING) Section 3 That pursuant to Section 635-100 "Expiration of Site Plans" of the Land Development Code, Site Plan (SP-052-16MOD2) approval shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen (18) months from the date of this Resolution. Section 4. That such application must be reviewed by the Broward County Aviation Department; the point of contact is William Castillo, Airport Planner, located at 220 SW 45 Street, Suite 101, Dania Beach, Florida 33312 (954) 359-6100. Section 5 That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7. The owner is seeking approval for a revised development program that comprises 385 high rise residential units. The proposed changes to the approved site plan will eliminate the retail use on the site and will increase the residential units from 381 to 385 units. All the proposed driveway connections to East Dania Beach Boulevard and Gulfstream Road will remain at the same locations as originally proposed. Attachment A includes the approved and proposed site plans. Trip Generation Analysis We performed a trip generation comparison between the proposed and approved development and found that the proposed development generates less traffic than the approved development. Table 1 summarizes the trip -generation comparison between the two development programs and shows that the proposed development will generate less traffic than the approved development. We prepared daily, morning peak hour and afternoon peak - hour vehicle trip estimates for the proposed and approved developments using the trip generation, pass -by and internalization equations from the 10th Edition of Institute of Transportation Engineers Trip Generation Manual. Attachment A contains a copy of the proposed site plan and the site plan from the approved study. Attachment B contains excerpts from the ITE Manual and trip -generation calculations for the development in the approved traffic study and the proposed development.
