HomeMy WebLinkAboutR-2012-127 - Issued Notice to Proceed to Green Construction Technologies, Inc. for US-1/SR-5/A1A Rights-of-Way Landscape Improvements-Phase II Project not to exceed $1,171,631.60 RESOLUTION NO. 2012-127 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO ISSUE A NOTICE TO PROCEED TO GREEN CONSTRUCTION TECHNOLOGIES, INC., IN CONNECTION WITH AN EXISTING MAY 8, 2012 AGREEMENT WITH THAT COMPANY, TO INCLUDE BOTH LANDSCAPE IMPROVEMENTS AND UTILITY REALIGNMENT FOR THE US-1/SR-5/AlA RIGHTS-OF-WAY LANDSCAPE IMPROVEMENTS—PHASE II PROJECT, IN AN AMOUNT NOT TO EXCEED $1,171,631.60; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City approved and appropriated $1,300,000.00 for the US-1/SR-5/AlA Rights-of-Way Landscape Improvements-Phase II Project; and WHEREAS, the City approved a bid award for the Project to, and executed an Agreement with, Green Construction Technologies, Inc. for the Project, subject to review by the City Commission of the results of"soft dig" examinations of the planned construction area to determine the scope and cost estimates of underground utility impacts; and WHEREAS, a City purchase order in the amount of $80,135.00 was issued for an examination of"soft dig" sites in the planned construction area, leaving a remaining available Project appropriation balance of$1,219,865.00; and WHEREAS, the "soft dig" examination has been completed and cost estimates have been provided for underground utility impacts of the Project and the work is ready to proceed; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the proper City officials are authorized to issue a Notice to Proceed to Green Construction Technologies, Inc., to include both the landscape improvements and utility realignment for the US-1/SR-5/AlA Rights-of-Way Landscape Improvements-Phase II Project, in an amount not to exceed $1,171,631.60. Section 2. That the City Manager and City Attorney are authorized to make minor revisions to such Notice as are deemed necessary and proper for the best interests of the City. Section 3. That remaining Project funds in an amount of$1,219,865.00 are available for this Agreement within the City Capital Project Fund — US-1/SR-5/AlA Rights-of-Way Landscape Improvements-Phase II Project. i Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 5.
