HomeMy WebLinkAboutR-2012-128 - Approved Plat Note Amendment Request by Craven Thompson & Associates, Inc. to change plat known as Harbour Towne Marina Plat located at 801-901 NE 3 Street RESOLUTION NO. 2012-128 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE PLAT NOTE AMENDMENT REQUEST SUBMITTED BY CRAVEN THOMPSON AND ASSOCIATES, INC., ON BEHALF OF THE CITY OF DANIA BEACH TO CHANGE THE RESTRICTIVE NOTE ON THE PLAT KNOWN AS THE "HARBOUR TOWNE MARINA" PLAT, PREVIOUSLY RECORDED IN PLAT BOOK 118, PAGE 34, FOR PROPERTY LOCATED AT 801-901 NE 3`d STREET IN DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the boundary plat known as the "Harbour Towne Marina" Plat was approved by the Dania Beach City Commission on November 11, 1980, by Ordinance No. 250, a copy of which is attached to this Resolution as Exhibit"A"; and WHEREAS, Craven Thompson & Associates, Inc., on behalf of the City of Dania Beach, has applied for a plat note amendment request to change the restrictive note on the Plat as follows: PL-34-12—Plat Note Amendment Replace Existing Note: Parcel "A" is restricted to a 186 boat-slip marina, 5 boat-launch ramps, and an 8,000 sq. ft. community center. Parcel `B" is restricted to commercial use only(restaurant). The restaurant building will be constructed entirely with Parcel`B". With Proposed Note: This plat is restricted to a marina with 45,359 sq. ft. of boat storage for 232 dry boat slips, 97 wet boat slips, a 9,200 sq. ft. community center, 28,256 sq. ft. of general industrial use (existing), 5,000 sq. ft. of general industrial use (proposed), and 17,085 sq. ft. of office use(existing); and WHEREAS, Broward County requires that the City Commission of the City of Dania Beach concur with this proposed Plat Note revision prior to a review by the Broward County Commission; NOW,THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the City of Dania Beach approves the proposed revision which changes the restrictive note on the Plat to allow a marina with 45,359 sq. ft. of boat storage for 232 dry boat slips, 97 wet boat slips, a 9,200 sq. ft. community center, 28,256 sq. ft. of general industrial use (existing), 5,000 sq. ft. of general industrial use (proposed), and 17,085 sq. ft. of office use (existing) on the "Harbour Towne Marina" Plat, as previously recorded in Plat Book 118, Page 34. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3. That the Plat of Harbour Towne Marina, same I being a parcel of land lying in Section 35, Township 50 South, Range 42 East, more particularly described as follows: Commencing at the Northwest corner of said Section 35, thence run due South for 1291.28'; thence run North 89018149" East for 2089.631; thence i run South 0007124" West for 8.95' more or less to the mean high water line and the point of beginning; thence continue South 0007-24" West for 663.98' more or less; thence run South 89014120" West for 425.051; thence run South 0007124" West for 613.481; thence run North 89009149" East for 997.121; thence run North 0011152" i East for 1389.57' more or less to the mean high water line of the Dania Cut-Off Canal; thence run South 70053150" West along said M.H.W. line for 178.82' more or less; thence run South 81013'47" West along said M.H.W. line for 409.87' more or less I to the point of beginning, said land situate in the City of Dania, Broward County, Florida, containing 23.4109 acres, more or less, is hereby accepted and approved. With respect thereto, City of Dania consents and agrees that such plat may be recorded in the Public Records of Broward County, Florida, upon further approval of all agencies of Broward County, Florida, having jurisdiction in the matter. Section 2. That the dedication for public use of all i streets, highways and alleys, as shown on the plat of said Harbour Towne Marina, is hereby accepted by the City of Dania, Florida. i Section 3. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 4. That this ordinance shall be in force and take effect immediately upon its passage and adoption. PASSED and ADOPTED on First Reading on the 28th day of Oetobeh 1980.
