Call to Order/Roll Call Mayor Flury called the meeting to order at 7:00 p.m. Present: Mayor: Patricia A. Flury Vice-Mayor: C. K. "Mac"McElyea Commissioners: Anne Castro Walter Duke Bobbie H. Invocation and Pledge of Allegiance Father Roger Holoubek, St. Maurice Catholic Church, gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.2 Special Event request for the annual "St. Maurice Country Fair", to be held at St. Maurice Catholic Church, 2851 Stirling Road on November 1-4, 2012 Commissioner Grace motioned to approve the Special Event request for the annual St. Maurice Country Fair; seconded by Commissioner Castro. The motion carried on the following 5-0 Roll Call vote: Commissioner Castro Yes Vice-Mayor McElyea Yes Commissioner Duke Yes Mayor Flury Yes Commissioner Grace Yes 3.3 Special Event request from Commissioner Bobbie Grace to host a "Making Strides for Breast Cancer" fundraiser in the City Hall Atrium on Thursday, October 18, 2012, from 5:50 p.m. —7:30 p.m. Vice-Mayor McElyea motioned to approve the Special Event request for Commissioner Bobbie Grace to use the City Hall Atrium for the "Making Strides for Breast Cancer" fundraiser; seconded by Commissioner Castro. The motion carried on the following 5-0 Roll Call vote: Commissioner Castro Yes Vice-Mayor McElyea Yes Commissioner Duke Yes Mayor Flury Yes Commissioner Grace Yes 3.4 The Parks, Recreation and Community Affairs Advisory Board is recommending the following fee waivers for the rental of I.T. Parker Community Center: Ladies Let's Go Fishing Event in April, 2013-2018, and Chef Wayne Whitthall's Memorial Service on October 13, 2012. They are also recommending a fee waiver for the rental of C.W. Thomas Park for The Wells Foundation Inc., event time and date to be announced. Commissioner Castro motioned to approve the recommendations of the Park, Recreation and Community Affairs Advisory Board to waive the rental fees for the Ladies Let's Go Fishing Event in April 2013-2018, Chef Wayne Whitthall's Memorial Service on October 13, 2012, and for The Wells Foundation, Inc. event to be held at an unannounced time and date; seconded by Commissioner Grace. Commissioner Castro motioned to approve the Special Event request for the "Livelong for Livestrong" charity bicycle ride; seconded by Vice-Mayor McElyea. Citizen Comments Ruth White, 143 NW 7" Avenue, spoke about the Laps for the Cure event to be held on October 27, 2012, and noted a voter rally will also be held on this same day at Lauderhill Mall with Al Sharpton as one of the special guests. Rae Sandler, 810 NW 70' Avenue, addressed the issue of the polling place for Precinct S009 being moved several times and asked the Mayor, Commissioners, or City staff to request that the precinct voting be moved to City Hall. Ann Page, 38 SW 5 h Street, President of Friends of the Library, advised that they will be hosting a Candidate Forum on Tuesday, October 30, 2012 from 7:00 p.m. — 9:00 p.m. at City Hall. She thanked the CRA for the improvements on 2"d Avenue. Teddy Bohanan, SW 15'h Street, spoke about her displeasure with the CRA Director. 4. Proclamations 4.1 National Domestic Violence Awareness Month Mayor Flury presented the proclamation to Marcia Barry-Smith, Board Member of Women in Distress. 3.1 Presentation by Women in Distress of Broward County for National Domestic Violence Awareness Month—Marcia Barry-Smith, Board Member Marcia Barry-Smith, Board Member of Women in Distress, thanked the Commission for their support. 6. Consent Agenda Items removed from Consent Agenda: #7.4 Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,October 9,2012—7:00 p.m. 7.1 Minutes: Approve minutes of September 20, 2012 Abatement Hearing Approve minutes of September 25, 2012 Final Budget Public Hearing Approve minutes of September 25, 2012 City Commission Meeting 7.2 Travel Requests: None Resolutions 7.3 RESOLUTION #2012-136 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, CONCERNING AMENDMENT 4 TO THE FLORIDA CONSTITUTION, WHICH, IF ADOPTED, WOULD CREATE ADDITIONAL INEQUITIES IN FLORIDA'S TAX SYSTEM BY GRANTING CERTAIN TAX BREAKS TO SOME TAXPAYERS AT THE EXPENSE OF OTHER TAXPAYERS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. 7.5 RESOLUTION #2012-138 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO PURCHASE FLOOD INSURANCE FROM AMERICAN BANKERS INSURANCE COMPANY OF FLORIDA IN AN AMOUNT NOT TO EXCEED $32,997.00 FOR THE PERIOD EXTENDING FROM OCTOBER 1, 2012 THROUGH SEPTEMBER 30, 2013; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. 7.6 RESOLUTION #2012-139 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A MEMORANDUM OF UNDERSTANDING (MOU) WITH THE BROWARD SHERIFF'S OFFICE AND WITH EIGHTEEN CITIES IN BROWARD COUNTY IN CONNECTION WITH THE 2012 BYRNE JUSTICE ASSISTANCE LOCAL SOLICITATION GRANT PROGRAM (JALSG); PROVIDING FOR CONFLICTS;FURTHER, PROVIDING FOR AN EFFECTIVE DATE. Commissioner Grace motioned to adopt the Consent Agenda, with the exception of Item #7.4; seconded by Commissioner Castro. The motion carried on the following 5-0 Roll Call vote: Commissioner Castro Yes Vice-Mayor McElyea Yes Commissioner Duke Yes Mayor Flury Yes Commissioner Grace Yes 7.4 RESOLUTION #2012-137 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, EXPRESSING THE CITY'S SUPPORT FOR THE ADOPTION OF A PLAN FOR COOPERATIVE COUNTYWIDE CONSOLIDATION OF E-911 COMMUNICATIONS AND DISPATCH TO BE WHOLLY FUNDED THROUGH COUNTY AD VALOREM TAXES; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday, October 9,2012—7:00 p.m. City Attorney Ansbro read the title of Resolution#2012-137. Commissioner Castro spoke briefly about the history of this matter and the issue of who should pay the costs. She noted the County Commission voted to move the 911 services out of the Broward Sheriff's office and put it under Broward County, which will result in a fee included on the TRIM notice to pay for this service. This Resolution seeks to ensure this fee is on the County portion since they will be operating the service. Commissioner Castro motioned to adopt Resolution #2012-137; seconded by Commissioner Grace. (SECOND READING) Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,October 9,2012—7:00 p.m. City Attorney Ansbro read the title of Ordinance#2012-025. Corinne Lajoie, Principal City Planner, presented an overview of the changes that were made after the first reading, noting that staff eliminated the Payment in Lieu of Park Dedication amendment. Additionally, regarding Tree Removal Replacement, duplexes were removed so that this provision would apply only to single family homes, specimen trees were excluded, and a maximum of two trees could be removed without replacing the lost canopy. Mayor Flury opened the Public Hearing. Teddy Bohanan, SW 15t' Street, questioned if duplexes are required to have a certain amount of landscaping. Corinne Lajoie, AICP, Principal Planner, responded there are minimum landscape standards that apply and noted she would provide Ms. Bohanan with the regulations. Seeing as there was no one else to speak in favor or opposition, Mayor Flury closed the Public Hearing. Commissioner Grace motioned to adopt Ordinance #2012-025, on second reading; seconded by Commissioner Castro. Discussion and Possible Action There were no discussion items on this agenda. 11. Commission Comments 11.1 Commissioner Castro Commissioner Castro noted the League of Cities is looking for appointments to committees, specifically, the Seven-50 Committee and the Coastal Ocean Task Force. She felt in light of the upcoming municipal election, these appointments should be postponed until November, and asked the City Clerk to recommend to the League that they wait until after the election for Dania Beach's appointments to be made. Commissioner Castro commended Public Services for covering the graffiti on the Melaleuca wall, noting that the rest of the wall needs to be painted, and for the median maintenance. The I- 95 ramp areas at Griffin Road are still in need of work, and she asked the City Manager to go to FDOT to pursue leasing their land in order for the City to landscape and maintain it. Minutes of Regular Meeting Dania Beach City Commission Tuesday,October 9,2012—7:00 p.m. Commissioner Castro suggested a memo addressing the status of the airport issues be provided to the Commission and perhaps a Shade meeting should be held before the election so that her responsibilities as the point person for this matter can be turned over to another Commissioner prior to her leaving office. 11.2 Commissioner Duke Commissioner Duke noted improvement should be seen in the way the new landscape company maintains the public areas and entryways. Commissioner Duke said Quarterdeck should open at the end of the month. Commissioner Duke advised that EDSA will roll out three concepts based on community input at the Waterfront Revitalization workshop scheduled for October 11 ffi. Commissioner Duke noted the US-1 Landscape Improvements Phase II is officially underway and spoke about the improvements to be made. 11.3 Commissioner Grace Commissioner Grace spoke about the Annual Chocolate Extravaganza scheduled for October 20t'. Commissioner Grace commented about the Together We Serve volunteer challenge through the Broward League of Cities. Commissioner Grace spoke about Operation B!Y Vote and the first rally held on October 6t', noting the next rally is scheduled for October 23` . 11.4 Vice-Mayor McElyea Vice-Mayor McElyea addressed the alley behind his house and those in other areas needing to be cleaned up, as well as houses needing to have soffits repaired. 11.5 Mayor Flury Mayor Flury questioned the landscaping at Melaleuca Gardens and whether a landscaper could be hired in order to expedite the work. Dominic Orlando, Director of Public Services, noted the landscape supervisor was out and returned to work yesterday. The project will now resume and there is $60,000.00-$80,000.00 budgeted. Mayor Flury spoke about her visit to the Museum of Amazing Things, located at the old Graves Museum, and noted she is not sure when it will open. Dania Beach is fortunate to have this Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,October 9,2012—7:00 p.m. museum, which will draw from all over the world, along with the other sophisticated attractions in the City. Mayor Flury suggested waiting until after the election to hold the Shade meeting regarding the airport issue. Commissioner Castro offered to meet with the new Commission appointee to discuss this issue. 12. Appointments There were no appointments at this meeting. 13. Administrative Reports 13.1 City Manager City Manager Baldwin spoke about the meeting with Kent George regarding airport construction issues, and noted new signage directing drivers to Dania Beach and Hollywood will be erected. Provisions for making U-turns in order to go south on US-1 have been made and within a year, they will try to make a southbound connection near the ramps; however, the detour will be for approximately two years. Additionally, they have agreed to try to change the staging of the construction to reduce noise levels. Commissioner Castro asked if taxi fares were addressed.
