HomeMy WebLinkAboutMinutes of Meeting - October 23, 2012 MINUTES OF REGULAR MEETING DANIA BEACH CITY COMMISSION TUESDAY, OCTOBER 23, 2012 — 7:00 P.M. 1. Call to Order/Roll Call Mayor Flury called the meeting to order at 7:00 p.m. Present: Mayor: Patricia A. Flury Vice-Mayor: C. K. "Mac" McElyea Commissioners: Anne Castro Walter Duke Bobbie H. Grace City Manager: Robert Baldwin City Attorney: Thomas Ansbro Deputy City Clerk: Tom Schneider 2. Invocation and Pledge of Allegiance Commissioner Castro gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Municipal Marina Presentation— Colin Donnelly, Assistant City Manager, and Mark Bates, Finance Director Colin Donnelly, Assistant City Manager, gave a PowerPoint presentation, a copy of which is attached to and incorporated in these minutes. Mark Bates, Finance Director, continued the presentation with a discussion of proposed financing of the Municipal Marina Project. Commissioner Grace asked how much funding is presently available and how much more is needed, and about the timeline for the grants. Assistant City Manager Donnelly responded that the City to date has obligated $2.5 million and, if approved by the Commission, will borrow $2.2 million from the General Fund. This amount would be returned to the General Fund through conversion into a bank loan within 120 days. He explained FIND's guarantee of a first-year grant and that they allow multi-year project funding requests. Commissioner Castro questioned the certainty of the bank loan, the solidity of projected user fees in making a bank feel this is doable, and whether marina revenues would also be used for future maintenance issues. Damon Adams, Dunlap & Associates Financial Advisors, noted this is an ideal size loan that would be appropriate for a bank and felt the RFP process would produce several proposals. A financing enhancement such as a covenant to budget and appropriate the difference if the user fees fall short may be required. Assistant City Manager Donnelly noted the business plan has an annual contingency for maintenance. Commissioner Duke thanked staff for efforts to acquire grants, FIND's multi-year accommodation, and the Marine Advisory Board for their input. This is going to be a spectacular amenity for the City as well as provide a financial return to the taxpayers. Mayor Flury felt the 10% management fee on a one-year project is somewhat high. She clarified the financing plan for the public, noting Dania Beach is a small city with a relatively small revenue base and cannot afford a $7 million marina; therefore, thanks to staff s efforts, the City will pay approximately $3 million and grant funds will come in at approximately $4 million. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Linda Sacco, 4496 SW 34 Terrace, read from a voting rights timeline taken from the American Civil Liberties Union website and from an article in the Miami New Times regarding collection of absentee ballots, noting new laws in Miami Dade limit the number of ballots a person can turn into the Supervisor of Elections in order to stem voting fraud. Terry Hale-Hicks, 331 SW 2nd Avenue, spoke about the CRA project underway in her neighborhood, noting residents feel they are not being listened to regarding trees replacing parking in the swale, the quality of the trees being installed, mature trees that were cut down, and the size of the traffic circles along with the multiple signs around them. Mayor Flury suggested CRA Director Jeremy Earle should be contacted and asked City Manager Baldwin to follow-up with Mr. Earle about meeting with Ms. Hale-Hicks. Teddy Bohanan, SW 15d' Street, spoke about the improvements made in her neighborhood and others, and felt residents should appreciate the City's and CRA's efforts. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,October 23,2012—7:00 p.m. 6. Public Safety Reports Bruce Caruso, BSO Fire Rescue, spoke about the forecast for Tropical Storm Sandy, Life Safety educators visiting schools for Fire Safety Month, and Halloween safety tips. Donn Peterson, BSO Chief of Police, addressed residents' concerns about recent car break-ins and noted BSO takes these incidents very seriously. He encouraged residents to report anything that looks suspicious. 7. L., AS BOND COUNSEL IN CONNECTION WITH THE BANK QUALIFIED LOAN FINANCING OF THE MARINA IMPROVEMENT PROJECT; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. 7.6 RESOLUTION #2012-143 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE APPROPRIATION, USE AND TRANSFER OF $2,253,000.00 FROM AVAILABLE CITY GENERAL FUND UNASSIGNED FUND BALANCE FUNDS TO THE CAPITAL PROJECTS FUND TO PROVIDE TEMPORARY LOAN FUNDING FOR THE MARINA IMPROVEMENT PROJECT CONSTRUCTION; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. 7.7 RESOLUTION 42012-144 Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,October 23,2012—7:00 p.m. A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO ISSUE PAYMENT TO INTERCOUNTY ENGINEERING, INC., PERTAINING TO COSTS ASSOCIATED WITH EMERGENCY WORK RELATED TO LIFT STATION NO. 7 DUE TO FLOODING, IN AN AMOUNT NOT TO EXCEED $48,458.49; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. Commissioner Grace motioned to adopt the Consent Agenda, with the exception of Item #7.3; seconded by Commissioner Castro. The motion carried on the following 5-0 Roll Call vote: Commissioner Castro Yes Vice-Mayor McElyea Yes Commissioner Duke Yes Mayor Flury Yes Commissioner Grace Yes 7.3 RESOLUTION #2012-140 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, INCREASING THE SCOPE OF WORK TO BE PERFORMED BY LAWN WIZARD USA, INC., IN THE AMOUNT OF $19,500.00 FOR ADDITIONAL LANDSCAPE WORK FOR GROUNDS AND RIGHT-OF-WAY MAINTENANCE ON US-1 FROM GRIFFIN ROAD TO STIRLING ROAD; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2012-140. Commissioner Castro confirmed that maintenance for US-1 Phase II is not included in this year's budget. She questioned whether the I-95 ramp areas at Stirling and Griffin Road are included on the maintenance schedule, and noted trash is an issue in these areas as well. Commissioner Castro motioned to adopt Resolution #2012-140; seconded by Commissioner Duke. City Attorney Ansbro read the title of Resolution#2012-145. Mayor Flury opened the Public Hearing. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,October 23,2012—7:00 p.m. Albert C. Jones, 722 SW 3rd Street, asked about provisions for handicap access. Mayor Flury responded handicap access, as required by law, is included in the detailed plans which are available for review with Assistant City Manager Donnelly. Seeing as there was no one else to speak in favor or opposition, Mayor Flury closed the Public Hearing. Commissioner Castro motioned to adopt Resolution #2012-145; seconded by Commissioner Duke. Since the value of the contract is$6.2 million, an increase in the$5 million orginal application, the City will be able to apply for additional funding for this project in amount$620,000. G:Wgenda\PUBLIC SPEAKING FORM.doc Final Comments from Commissioner Anne Castro Dania Beach City Commission Meeting October 23, 2012 As many of you know, there is an election around the corner and I am termed out as a member of the Dania Beach City Commission. As this is my last meeting, I wanted to thank and recognize some people that I have had the fortunate opportunity to work with. When I graduated from law school, I adopted the quote, "Success is not a destination, it is a journey" and in keeping with that, I have learned over the past 7 % years that "it's not only the journey, but who you travel with as well" - and I have been able to travel with some immensely talented people. I have worked with so many, but there are a few with whom I was fortunate to work directly with and I could not step down without giving them the credit they deserve for their contributions to our city and making the lives better for our residents. My first few months in office, I worked with a local business owner by the name of Clare Vickery. We had received an invitation from the City of Fort Lauderdale to become part of their enterprise zone. Clare worked tirelessly on statistics and convinced the State of Florida, based on an analysis she created, that we should be approved for an enterprise zone. Clare also created the first Arts & Antique festival. Over 3,000 people attended the first year and it showed what was possible. I want to recognize Joe Van Eron. He challenged me as a candidate and as an elected official on cleaning up his neighborhood, including the Urban Infill Study, and then later starting the Dania Beach Tourism Council. He like Clare has worked tirelessly on creating entities greater than themselves and that benefit the entire City. 1 I also want to thank Rae Sandler. But for her walking the entire city with me, I would not have been elected. She then took the helm of the Melalueca Gardens Homeowners Association, serving on the airport advisory board meeting as well as Broward ANAC and through her representation, she has keep all that are affected by the runway expansion the NE to the Western part of Dania Beach. I want to thank Chickie Brandimarte. She has been tireless in representing the seniors and preventing crime trough the COPS program. I want to thank George Jason, who we had a proclamation for earlier. It goes without saying; he has been a tireless servant for the residents of our city. There are so many others as well, Pat Tyra, Ruth White, Linda Sacco, Dick and Betty Sokol, Gloria Black, Teddy Bohannan, Jimmy and Janice Peterman, and of course Bob and Faye....and so many more. I would like to acknowledge some staff members; First, Corrine Lajoie and Lou Ann Patellaro. They have been a constant working through three Community Development Directors and never missing a beat. I have never heard a negative word about Corrine from anyone who has had dealings with her. As a matter of fact, she is willing to go outside the box as they say, and find solutions that work for everyone. Lou Ann can et a very complex request and she will always rY 9 rY P q Y find a way to pull, filter and analyze data to get the right answers as fast as possible, and always with a cheerful laughl I also appreciate the work of HR Manager Jackie Beauzil. She is always ready to assist and always in a manner that is professional, courteous and with compassion. 2 Then there is Chris Loftier and Kathleen Weeks. Both serve many masters relative to administrative support and they do so cheerfully and again with a level of professionalism! They have both made my service easier! I also had the pleasure of working with three different Community Development Directors; LarryLeeds Bob Daniels and Mark Lafarrier. The allowed me to participate Y P P in their work and processes and they strategically used me to accomplish when necessary at the County, State, or wherever so that I was able to assist in some small ways to achieve their goals and for that I am grateful! From the One Code, LAC's, RAC s, to comprehensive plans include consumptive use permits for water. For instance, it was Herculean effort by Bob Daniels, Public Services and others to resolve the CUP permit with the South Florida Water Management District and the State of Florida. We ended up partnering with the County for the final solution. Those were some tough discussions, but they got it done! Other accomplishments included the One Code, reduction of right away on US1, adding incentives to our zoning to allow for incentives based on green and aesthetics components, creating smarter building designs and more design friendly for our residents. They have individually worked hard on behalf of our residents, but they also continued one from the other to get good things for our city. It has been a pleasure to serve with them. It was because of these gentlemen, that I chose to serve on such boards as the Broward Planning Council, Water Resource Task Force and the Climate Change task force to name a few. For instance, the Planning Council has assisted our city in many ways that allowed us to move forward on things more efficiently and effectively. Some incredible professionals that I had the privileged to work with include Dr. Nancy Gassman, Dr. Jennifer Jurado, two of the best scientific minds I have encountered, as 3 well has Henry Sniezek, who by far is one of most professional, fair, and polite public servants I have ever met. He follows process the same for everyone and treats all the same! They are all a credit to the County. I worked with two terrific Assistant City Managers in Bonnie Temchuk and Colin Donnelly. Both are always assigned the stuff no one else wants and it is an eclectic group of tasks and assignments and they have both worked hard, always with the best interest of all in mind. We have had and have such talented people that a few have reputations that easily exceed boundaries of Dania Beach. Bob Daniels, former Community Development Director, is known around the State. His reputation as a subject matter expert, for professionalism and being a gentleman, is known far and wide! Everyone says the same things. They also say he is genuinely one of the nicest people who would never say anything derogatory about anyone! I am going to add to that list and next speak about Chief Peterson. In my first meeting with Chief Peterson, I had the audacity to advise him that he needed to be more politically sensitive. Well, I was wrong and he is right just the way he is. His reputation amongst his peers is stellar. His supervisor says he bleeds green and gold and lives to serve the public. One of his peers, who has known him for many years, says he is one of the best tacticians they've ever worked with. Team members in Dania Beach, one of whom has been a deputy for 24 years, said the best part of his career is the last 4 % working for Chief Peterson. He used to command the SWAT team and he always brought resources to our city! I remember when I was first elected, how much more crime, especially prostitution and drug dealing occurred in our communities. Even 4 though crime will always be a problem, even in this economy, it is a better place now that it was 8 years ago! Jeremy Earle. I am not even sure where to start with Jeremy. He had an impossible task. He had to pick up an out of compliance plan, make it legal by creating a real implemental plan that would have an impact. I remember when we first spoke of landscaping US 1. Who knew some trees would make such a difference. From the Merchant Assistance Program, to the fagade program, to obtaining approval to utilize the County Capital Redevelopment funds, he has met every challenge. His team has brought in jobs, created a brand, and put Dania Beach on the map as a city that is moving forward. My only regret, I did not vote for him. I want to thank Mayor Flury for breaking the tie! Jeremy is about to be installed as President Elect for a statewide organization known as the Florida Redevelopment Association. This is a high honor for him and for our City! It is also a stamp of approval from the highest level of peers in his profession! Louise Stilson. I can be at a league of cities meeting in Orlando, meet someone from the smallest town in the farthest reaches of the panhandle, and they know our Clerk. Louise's reputation amongst her peers is the bomb! She is above reproach, and she has said no to me probably more than any other department head. She is fair and treats everyone and every situation the same. She is always serving one master— us, the residents of Dania Beach! I have also had the opportunity to work with two City Managers, with two totally different styles. Both have been wonderful to work with. Ivan Pato and Bob Baldwin have put me to work) Like Jeremy Earle, they have all provided me unique 5 opportunities to utilize relationships, process, skills sets that I would not otherwise had a chance to use in my life time. I have met incredible people during these times. Whether it was working with Ivan to secure the library funding from the County, or the Capital Redevelopment funds, then working back to change the use of those funds with Jeremy Earle, to expanding the CRA with Jeremy to ensure these wonderful projects could be done in College Gardens, Dania Heights and Triangle as well as Sun Garden Isles that resulted from the CRA expansion to more recently working with Mr. Baldwin on issues with FDOT, to recently helping find resolution with the Sheriffs Fire Department relative to the pension plan payments. They have afforded me unique opportunities to make great things happen for our city and I am grateful. I have also had the privilege to work with many incredible people up here on this dais. John Bertino taught me Robert's Rules strategy. Al Jones taught me faith and his wife Carolyn, to laugh as it is good for the soul. Mac has taught me about business and I have never met someone who loves this city more than Mac! Mayor Flury taught me to ask the hard questions and do your research and be prepared. Bob Anton —taught me how to let go of a loss, be patient, and on occasion, you may have to growl or even bite to get something done! Bob Anton and his wife Dottie i are the people responsible for bringing me to this dance and giving me the ride of a 6 lifetime! I count them as dear friends now and will always be grateful for their unconditional support, counsel and advice. I want to thank my husband Oscar, who has supported me in every endeavor I have taken on from going to law school to running for office. I thank my son Jimmy, who has also indulged me and cheered me on and has stepped up to defend me. I thank my mom Virginia McManus, who has been with me since I am four, but knows me better than anyone and she is the wisest person I know. Finally, I thank all of you, the residents of Dania Beach. You are what makes this work worthwhile and you're incredible. Over the years I have had cheers, and a few jeers. I try to learn from them all. I have received some of the nicest notes from residents who are part of the "quiet majority" and with God's providence; they have always come at opportune times when a note of support was really needed. So I thank all of you! It has been my honor and privilege to serve you. I hope I have done so in a professional and positive manner, and have never brought embarrassment to our city!
