Call to Order Mayor Flury called the meeting to order at 6:00 p.m. 2. Roll Call Present: Mayor: Patricia A. Flury Commissioners: Anne Castro Walter B. Duke III Bobbie H. Grace City Manager: Robert Baldwin City Attorney: Thomas J. Ansbro City Clerk: Louise Stilson Code Attorney: Tim Ryan Absent: Vice-Mayor: C.K. "Mac"McElyea 3. Abatement Requests 3.1 Consideration of the abatement request for Walgreen Company #03002, Tax Department, for property located at 202 S Federal Highway, Case #11-0209 (Folio #1203-02-0010) Attorney Ryan noted this case involved one violation for paving and asphalt repairs done without the required permit. The fine ran for 146 days for a total of$22,154.00, including recording and administration fees. The Special Magistrate recommended an abatement of$5,000.00. Commissioner Duke suggested that instead of the money being paid to the City, the abatement should be spent on landscaping to improve the appearance of the property. Rob Lewis, Attorney for Walgreen Company, clarified that Commissioner Duke is suggesting that they coordinate with City staff for installation of landscape improvements to the property in lieu of the dollar amount. Commissioner Duke motioned to continue the case until the January 17, 2013,Abatement Hearing; seconded by Commissioner Grace. The motion carried on the following 4-0 Roll Call vote: Commissioner Castro Yes Vice-Mayor McElyea Absent Commissioner Duke Yes Mayor Flury Yes Commissioner Grace Yes 3.2 Consideration of the abatement request for Jeff& Laura Clymer and Karen Derris, et al. for property located at 40 SE 7 Street Case#11-1520 Folio #1203-45-0030 P P Y � ( ) Attorney Ryan noted the case involved 3 violations: parking area in disrepair; vehicle on the property without a valid tag; and off-street parking area is not an approved parking area. The fine ran for 274 days for a total of$27,654.00, including recording and administrative fees. The Special Magistrate recommended an abatement of$5,000.00. Commissioner Grace motioned to abate the lien to $5 000.00 as recommended b the > > Y Special Magistrate,to be paid at closing of the Short Sale scheduled for November 30,2012, or no later than 90 days; seconded by Commissioner Duke. The motion carried on the following 4-0 Roll Call vote: Commissioner Castro Yes Vice-Mayor McElyea Absent Commissioner Duke Yes Mayor Flury Yes Commissioner Grace Yes 3.3 Approval of the settlement received for Nauman Akhtar for property located at 214 NE 5 Avenue, Case#10-1240(Folio#0235-06-0410) Attorney Ryan noted the City received $1,968.00 as settlement for the fines, $432.00 for nuisance abatement liens, and$100.00 in administrative fees, for a total of$2,500.00. Commissioner Grace motioned to approve the settlement agreement, as recommended by Attorney Ryan; seconded by Commissioner Duke. Ramirez for property located at 3341 SW 44 Street, Case#10-0801 (Folio#0230-01-0340) Attorney Ryan noted the City received $4,900.00 as settlement for the for the fines, $2,695.00 for nuisance abatement liens, and $100.00 in administrative fees, for a total of$7,695.00 Commissioner Duke motioned to approve the settlement agreement, as recommended by Attorney Ryan; seconded by Commissioner Grace. The motion carried on the following 4- 0 Roll Call vote: Commissioner Castro Yes Vice-Mayor McElyea Absent Minutes of Abatement Hearing 2 Dania Beach City Commission Thursday,November 15,2012—6:00 p.m. Commissioner Duke Yes Mayor Flury Yes Commissioner Grace Yes 3.5 Approval of the settlement received for Ana M. Marin for property located at 217 SW 3 Terrace, Case#10-0816 (Folio #1203-26-0480) Attorney Ryan noted the City received $5,500.00 as settlement for the fines plus $167.50 in administrative fees, for a total of$5,667.50. Commissioner Grace motioned to approve the settlement agreement, as recommended by Attorney Ryan; seconded by Commissioner Duke. The motion carried on the following 4-0 Roll Call vote: Commissioner Castro Yes Vice-Mayor McElyea Absent Commissioner Duke Yes Mayor Flury Yes Commissioner Grace Yes 3.6 Approval of the settlement received for Patrick Cezaire/HSBC Bank USA NA for property located at 720 SW 6 Street, Case #s 08-1391, 09-2282, and 11-0920 (Folio #1203-34-1010) Attorney Ryan noted the City received $19,844.10 as settlement for the fines, $2,201.39 for nuisance abatement liens, and $400.00 in administrative fees, for a total of$22,445.49. Commissioner Grace motioned to approve the settlement agreement, as recommended by Attorney Ryan; seconded by Commissioner Duke. The motion carried on the following 4-0 Roll Call vote: Commissioner Castro Yes Vice-Mayor McElyea Absent Commissioner Duke Yes Mayor Flury Yes Commissioner Grace Yes 4.
