Call to Order/Roll Call Mayor Duke called the meeting to order at 7:00 p.m. Present: Mayor: Walter B. Duke III Vice-Mayor: Albert C. Jones Commissioners: Chickie Brandimarte Patricia A. Flury Bobbie H. Grace City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Pastor Mario Cinelli, Lighthouse Community Church, gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Special Event request for the 7th Annual Dania Beach Vintage Motorcycle Show" to be held at Frost Park on Saturday, January 26, 2013 from 10:00 a.m. to 5:00 p.m. The applicant is also requesting road closures and assistance from the Parks and Recreation Department to prepare Frost Park for the event. Commissioner Grace motioned to approve the Special Event request for the 7th Annual Dania Beach Vintage Motorcycle Show; seconded by Vice-Mayor Jones. Proclamations 4.1 Rhonda Calhoun Day Mayor Duke noted the proclamation would be mailed to the Broward League of Cities. 5. Citizen Comments Ann Page, 38 SW 50' Street, President of Friends of the Library, advised the request for the Walk for the Library will be on the next agenda for Commission approval and asked the Commission if the Friends could have an art show at City Hall during January to display the submissions for their art contest. The Commission concurred with the request for the art display. George Jason, 4549 SW 37t' Avenue, congratulated Mayor Duke for receiving the most votes and is hopeful the Commission works with him. He also congratulated Vice-Mayor Jones and Commissioner Brandimarte on their election to the Commission, and thanked former Commissioner Castro for proclaiming November as George Jason Volunteer Month. He noted that the Dania Beach Neighborhoods United will be disbanded unless more people join. Carolyn W. Jones, 722 SW P Street, announced the schedule for the MLK Committee meetings and requested that the community participate in planning the event. Christine & Ron Douglas, 4665 SW 38ffi Terrace, congratulated the commission and thanked BSO for their quick response to the break-in at their home on the day before Thanksgiving. Linda Sacco, 4496 SW 34t' Terrace, congratulated the commission and addressed some of the major issues that face the City. She requested that the commission get along and work for the good of the residents of Dania Beach. 6. Public Safety Reports Michael Cassano, Assistant Chief of Operations, BSO Fire Rescue, advised of the 2-1-1 service that provides 24 hours, 7 days a week, 365 days a year access to counselors and services for those in despair, particularly at this time of year. He noted information on this program will be placed on the City website and cable channel; this is a national service and Broward County instituted it in 1995. Donn Peterson, BSO Chief of Police, noted the Dania Beach District received an unannounced inspection and passed with flying colors. Commissioner Grace questioned whether patrolling would be increased during the holiday season and if a flyer alerting of scams distributed last year would again be used. Chief Peterson responded there would be a holiday operational plan in effect and he would follow-up with crime prevention staff regarding scam alerts. City Attorney Ansbro read the title of Resolution#2012-154. Commissioner Flury questioned security coverage provided under the contract. Gary Groenewold, Vice-President of Westrec Marina Management, Inc., explained the roving patrol utilized after each 8-hour work day, seven days per week. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,November 27,2012—7:00 p.m. Commissioner Flury felt there should be full-time security coverage once Marina improvements are completed. Commissioner Flury motioned to adopt Resolution #2012-154; seconded by Commissioner Grace. City Attorney Ansbro read the title of Resolution #2012-102. He noted that a resolution for the agreement, which i c is included is also required, and requested a continuance until the January g � q q 8, 2013 City Commission meeting. Commissioner Grace questioned the specifics of this project and how many more delays there would be. City Attorney Ansbro explained a solution to many issues surrounding enlargement of the pump house was recently proposed and is being vetted, and a great deal of time has been spent on working out the details of the associated maintenance agreement. He emphasized that these sorts of details have taken a long time to resolve and because Meadowbrook is giving the City the easement, we have to make sure we accommodate them. Commissioner Brandimarte asked the City Attorney to advise her if she can vote on the matter in the future because she lives in Meadowbrook Phase 4. Vice-Mayor Jones motioned to continue Resolution #2012-102 until the January 8, 2013 City Commission meeting; seconded by Commissioner Grace. City Attorney Ansbro read the title of Resolution#2012-157. Commissioner Brandimarte suggested that the City hire employees who are residents of Dania Beach and not contract with an outside agency. Mayor Duke agreed on hiring Dania Beach residents, however, we are still in transition and he recommended approving this now and revisiting it in 12 months. City Manager Baldwin recommended it be discussed during the budget process. Vice-Mayor Jones concurred the budget has been set for this year and it is a great idea to consider in the future. Commissioner Flury asked if the Commission would be having a general workshop soon. City Manager Baldwin responded planning is underway for January. Commissioner Grace motioned to adopt Resolution #2012-157; seconded by Vice-Mayor Jones. The motion carried on the following 5-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Jones Yes Commissioner Flury Yes Mayor Duke Yes Commissioner Grace Yes 7.16 RESOLUTION#2012-161 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A FIRST AMENDMENT TO AN AGREEMENT EXISTING BETWEEN THE CITY OF DANIA BEACH AND BROWARD COUNTY RELATING TO WATER SAFETY INSTRUCTION/EDUCATION;PROVIDING FOR CONFLICTS;FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2012-161. Vice-Mayor Jones commented he does not have a particular problem with this item and reasoned that it is on the agenda because the contract is being renewed. City Manager Baldwin noted this amendment clarifies the language in the contract. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,November 27,2012—7:00 p.m. Vice-Mayor Jones expressed concern that there are no pool heaters at the parks, although installation of heaters was discussed when he served on a previous Commission, and he felt this should be done. He questioned why Swim Central is not being used for Collins Elementary as the children could walk next door to this pool instead of being bussed to Meli Park. Drowning statistics indicate that minorities cannot swim and to not utilize this pool in a neighborhood at risk is absurd. He noted he addressed this matter with the City Manager some time ago and it should be explored by the Commission. Mayor Duke suggested the City Manager and Parks& Recreation Director Felicetty look into the matter. Commissioner Grace concurred with Vice-Mayor Jones. Commissioner Flury noted there are specific requirements for teaching infants and toddlers how to swim, and the pool at C.W. Thomas Park does not meet those requirements. Mistakes with the construction of the pool at Meli Park resulted in building a kiddie pool in order to save the grant, so this is where toddlers must have their lessons. Vice-Mayor Jones motioned to adopt Resolution #2012-161; seconded by Commissioner Grace. Public Hearings and Site Plans 9.1 ORDINANCE#2012-026 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE EXPENDITURE OF CITY FUNDS EXCEEDING ONE MILLION DOLLARS ($1,000,000.00), TO REFUND THE CITY'S EXISTING SALES TAX REVENUE BOND; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (SECOND READING) City Attorney Ansbro read the title of Ordinance #2012-026. He noted the Commission must first approve the expenditure of funds before approving the bid award. Mayor Duke opened the Public Hearing. Seeing as there was no one to speak in favor or opposition,he closed the Public Hearing. Commissioner Flury questioned how a 7,000 square foot building could be constructed without a permit. Bill Rich, 4607 SW 44 h Avenue, indicated that Community Development assured them that they could get a building permit as long as steel sides were not installed on the building. Corinne Lajoie, AICP, Principal Planner, clarified the original design was going to be similar to a canopy, which was not considered a building, and did not require a site plan. Eventually, walls became necessary for additional support and therefore a site plan became required; regardless, a building permit was needed before walls were constructed. Mr. Rich further explained the ongoing issues regarding the building sides and building permit. In response to Mayor Duke's question regarding penalties levied for this non-compliant construction, Ms. Lajoie noted there are penalties associated with code violations and some fees are doubled for after-the-fact permits. Mr. Rich addressed the issue of additional code violations on this property, noting it is under a state moratorium and they have a long history with the City of clarifying what they are doing as well as showing what the state is requiring. He confirmed that with the property being in a catch 22 situation, they have not paid for any violations because they are waiting for approval. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte spoke about a CERT meeting she recently attended. 11.2 Commissioner Flury Commissioner Flury questioned the latest financial report, in particular, the outstanding balance for A to Z Video and the Reserves balance. 11.3 Commissioner Grace Commissioner Grace thanked everyone who helped with the 290 baskets and gift certificates given away for Thanksgiving. She hopes the giving trend will continue through the Christmas holiday, especially for the benefit of children. 11.4 Vice-Mayor Jones Vice-Mayor Jones noted there will be unity among this commission and he will do all that he can. Vice-Mayor Jones questioned the process for obtaining reusable and refurbished paint. Dominic Orlando, Director of Public Services, explained that residents call and staff checks to see if there is any paint in-house; if not, staff calls Broward County to get a supply. He noted that when the paint is in stock, residents are told to come in right away or to request it be set aside for later pickup in order to avoid it being given to someone else. Vice-Mayor Jones commented about residential parking lots in the northwest and southwest areas where cars are being parked in front yards. There is an area on SW 7 h Avenue that is especially problematic and this code issue needs to be addressed. Vice-Mayor Jones would like to see a coordination of charitable giving for Thanksgiving and Christmas insofar as some people get an overabundance, while others go without. Vice-Mayor Jones asked what happens to any monies remaining when the MLK Committee keeps expenditures low.
