DANIA BEACH CITY COMMISSION
TUESDAY, DECEMBER 119 2012 -7:00 P.M.
1. Call to Order/Roll Call
Mayor Duke called the meeting to order at 7:00 p.m.

2. Invocation and Pledge of Allegiance
Commissioner Bobbie Grace gave the invocation followed by the Pledge of Allegiance to the
United States Flag.
3. Presentations and Special Event Approvals
3.1 Special Event request for the Friends of the Library "2nd Annual Walk for the Paul
DeMaio Library" to be held at the Paul DeMaio Library, 1 Park Avenue East, on
Saturday, January 26, 2013 from 8:00 a.m. - 4:00 p.m. The applicant is requesting a
fee waiver, street closures, and BSO patrol assistance at no fee.
Ann Page, President of the Friends of the Library, noted the route for the walk has been changed
due to the Vintage Motorcycle Show. The Quarterdeck Restaurant will sponsor their t-shirts this
year and all of the artwork submitted for the t-shirt contest will be displayed for the entire month
of January at City Hall.
Commissioner Grace motioned to approve the Special Event request for the 2"d Annual
Walk for the Paul DeMaio Library, including the fee waivers and street closures; seconded
by Vice-Mayor Jones. The motion carried on the following 5-0 Roll Call vote:

4. Proclamations
There were no proclamations at this meeting.
5. Citizen Comments
George Jason, 4549 SW 37th Avenue, noted Dania Beach Neighborhoods United may no longer
be able to operate due to a lack of interest from the community. He encouraged participation in
the meeting scheduled for January and is looking for someone to be president of the
organization.
Jimmie Peterman, 717 SW 4th Terrace, questioned why there is no sidewalk on the west side of
the parking garage, and commented on the City's hiring practices insofar as he understands
Public Services jobs were promised to out of area people rather than to residents of Dania Beach.
Mr. Peterman remarked that the color of the SW Community Center should match the color of
other Parks & Recreation buildings and better signage is needed.
Mayor Duke addressed the concerns about the sidewalk and hiring practices, and noted the SW
Community Center needs to be staffed to accommodate such uses as after-school programs.
Commissioner Flury commented that very few jobs go to residents of Dania Beach and instead
of relying on electronic postings alone, job openings should be posted on a bulletin board for
residents to see.
Vice-Mayor Jones felt residents should be first hired and as such, churches and civic
organizations need to be made aware of job openings so that locals have an opportunity to apply.
Additionally, staff needs to come together when making selections so City residents can be hired.
He noted we might want to get together with the community to look at other colors for the SW
Community Center and suggested something should be done about the lack of a sidewalk on the
west side of the parking garage.
Commissioner Brandimarte noted she brought up at the last meeting that we should hire Dania
Beach residents, and there is a need for the sidewalk under discussion, as well as the need to
continue the existing sidewalk at Frost Park.
Rick Zapata, 2331 SW 45th Street, asked who could take down a pair of sneakers that were
thrown on the wires on the electric poles at SW 45th Street and SW 23`d Terrace.
Mayor Duke noted the Commission would follow up with FPL.
Donnie Coumbe, 2460 W State Road 84, representing the Red Carpet Inn, complained about a
party that was recently held at 2981 Ravenswood Road and questioned if having a permit for a
party exempts someone from complying with noise regulations. He noted the hotel had to issue
refunds for rooms, and the parties are happening more frequently and becoming a problem.

6. Public Safety Reports
Donn Peterson, BSO Chief of Police, discussed the party at the Ravenswood Road location,
noting it is a high end yacht company and the owner said he had permission to hold the party.
He noted this was brought to his attention today and BSO will investigate it completely. Chief
Peterson recognized Detective Abraham Cremidis as employee of the month for his resolution of
a serial burglar case.
City Manager Baldwin noted that our fire rating has improved from a Class IV to a Class II due
to our fire service and improvements to our water service.
Michael Cassano, Deputy Fire Chief of Operations, BSO Fire Rescue, explained the ISO ratings.

Mayor Duke passed the gavel and motioned to adopt Ordinance #2012-022, on second
reading. The motion failed for lack of a second.
9.2 ORDINANCE #2012-027

City Attorney Ansbro advised the remaining item was a quasi-judicial hearing and swore-in
those who would speak. He asked the Commission to disclose any communication they had on
this matter.
Mayor Duke noted he met with the petitioner and Community Development.
9.4 RESOLUTION#2012-164
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING
THE SITE PLAN REQUEST(SP-21-11)AND VARIANCE(VA43-12)SUBMITTED BY LUC THIBAULT, ON
BEHALF OF INTERMARINE, INC., FOR PROPERTY LOCATED AT 4550 RAVENSWOOD ROAD IN THE
CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution#2012-164.
Corinne Lajoie, Principal City Planner, provided an overview of the subject property, and the
variance and site plan requests.
Discussion ensued regarding the phasing of improvements, roof flags, and the gravel area.
Commissioner Brandimarte questioned what constitutes a hardship where approval of a variance
request should be given and the reason gravel is being requested.
City Attorney Ansbro explained a hardship stems from something that is unique or peculiar to a
particular property,that is not shared with others, and that is not self-created.
Ms. Lajoie noted gravel allows for additional percolation and drainage onsite.

10. Discussion and Possible Action
10.1 Discussion of Oasis Program—City Manager Baldwin
City Manager Baldwin reviewed the Oasis Program as provided in the agenda packet and noted
that if the Commission is agreeable during the coming budget deliberations, we will move
forward with other recommended projects.
Vice-Mayor Jones questioned the difference in the CDBG funds between the 38th and 39th years.
Colin Donnelly, Assistant City Manager, explained funding has been reduced by the federal
government.
Vice-Mayor Jones noted he would like some improvements made in the College Gardens area in
the future.
Commissioner Grace reiterated her previous request that the 2013/2014 Oasis project be
considered for the southwest and northwest sections.
Mayor Duke recommended discussion at the January workshop should look forward five to ten
years to chart streetscape improvements.
11. Commission Comments
11.1 Commissioner Brandimarte
Commissioner Brandimarte commented that the Dania Beach Improvement Committee worked
on Saturday from 8:00 a.m. to 11:00 a.m., collecting trash on Dania Beach Boulevard; 24 bags
were collected. She spoke about the Dania Beach Seniors holiday party which was held today at
Tropical Acres.

11.2 Commissioner Flury
Commissioner Flury asked the City Manager to prepare a letter for the Mayor's signature on
behalf of the entire Commission, thanking the Dania Beach Improvement Committee for all they
do for the City.
11.3 Commissioner Grace
Commissioner Grace suggested staff take a look at Mullikin Park for needed upgrades.
Commissioner Grace reported on the Community Garden and its first harvest crop, noting she
would like to move forward with a cookbook featuring recipes for the produce from the garden.
Commissioner Grace encouraged involvement in ensuring every child in Dania Beach and
throughout Broward County is taken care of during the holiday season.
11.4 Vice-Mayor Jones
Vice-Mayor Jones spoke about several events he recently attended, which included the Seniors
holiday party, the Gallery of Amazing Things, the Pearl Harbor Day of Remembrance, and a
conference focusing on black males at Attucks Middle School, where he met Robert Runcie,
Broward County School Board Superintendent. Mr. Runcie would like to get together to discuss
the black male task force that is underway and opportunities for the City to partner with Broward
County schools,the Children's Services Council, and others.
Vice-Mayor Jones remarked that street lights are out at the following locations:
• NW 8th Avenue and NW 3rd Street(has been out for over a year)
• NW 7th Avenue&NW lst Street
• NW 1 st Street & NW 10th Avenue, all the way to NW 14th Way (trees are blocking the
lights and need to be cut back)
• NW 2nd Street &NW 13th Avenue
Additional lights may need to be added as follows:
• NW 2nd Court&NW 14th near Mildred Jones Park(may need to add light along street)
• Small parks have no lighting and if there are problems there, we need to add lighting
11.5 Mayor Duke
Mayor Duke commented he attended School Board Superintendent Runcie's Meet the Mayors
Roundtable and felt that good things would be happening with Dania Beach schools.
Mayor Duke spoke about complaints from Melaleuca Gardens residents regarding dust and noise
due to the airport construction, and noted we will do everything that can be done to alleviate the
situation.

Mayor Duke referenced memos from Assistant City Manager Donnelly regarding beach erosion
and grants, and requested discussion of coastal erosion be placed on the next agenda in January.
Mayor Duke addressed beach parking complaints and issues, noting that City staff is on top of it.
He added that construction of the marina will likely begin in January or February.

13. Administrative Reports
13.1 City Manager

City Manager Baldwin commented that follow-up will continue with the grants list and beach re-
nourishment as discussed earlier in the meeting. The City webpage will be updated for easier
access to Commission meetings and displays for the artwork in the lobby are being worked on.
City Manager Baldwin noted airport complaints were addressed with BCAD and we were
assured they are doing everything they can. They indicated the dust is from the trucks traveling
up and down Griffin Road and not from the worksite; as such, they have increased watering and
sweeping on the road. Additionally, they promised directional signs for Dania Beach and
Hollywood would be installed quickly.
Vice-Mayor Jones commented that he would like to be the point person for airport issues in
dealing with BCAD.
Mayor Duke suggested placing this matter on the next agenda for discussion.
13.2 City Attorney
City Attorney Ansbro discussed the Casa Bella restaurant building and the application received
for a permit to demolish it. He noted the building was never listed as an historic building and is
not protected. The owners intend to demolish the building and market the property for sale.
Commissioner Flury commented the building has historical significance to Dania Beach and
questioned what options other than demolition might be available.
City Attorney Ansbro explained there is a long process that could be followed and would involve
a special meeting to hold a hearing where the property owner could challenge the proposed
designation. There would be a 30-day period to determine whether or not the City could try to
save it or move it; moving costs would be between $100,000.00 and $200,000.00. He further
detailed the process, noting the owner has several options for lawsuits against the City.
Commissioner Flury questioned whether there is an opportunity for the public to have a say and
if there is City property on which the building could be moved. She is uncertain how the process
works, but knows people in the community will be upset. Commissioner Flury noted we should
not spend a fortune trying to save the building, but she would like time for people to understand
what is happening.
Vice-Mayor Jones noted he would not object if there was somewhere to move the building to and
felt it would have to be moved, as property along Federal Highway is important for
redevelopment. He suggested a grant might be available for use towards relocation and the
public should be able to weigh in on the matter.
City Attorney Ansbro reiterated a special emergency meeting would have to be called since the
permit will be issued tomorrow and there are no grounds on which to deny it.
