HomeMy WebLinkAboutR-2013-009 Approved Delegation Request for Plat known as Leto Park located at the NW Corner of Stirling Road & SW 19 Court for Tanjali Investment, LLC to Amend Non-Vehicular Access Line RESOLUTION NO. 2013-009 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE DELEGATION REQUEST SUBMITTED BY SCOTT BACKMAN, ON BEHALF OF TANJALI INVESTMENT, LLC, TO AMEND THE NON-VEHICULAR ACCESS LINE AND TO CHANGE THE RESTRICTIVE NOTE ON THE PLAT KNOWN AS THE "LETO PARK" PLAT, RECORDED IN PLAT BOOK 118, PAGE 39 IN THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA, AND LOCATED AT THE NORTHWEST CORNER OF STIRLING ROAD AND SOUTHWEST 19TH COURT IN DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the boundary Plat known as the "Leto Park" Plat was approved by the Dania Beach City Commission on April 27, 1982, by Ordinance No. 285; a copy of the Plat is attached as Exhibit "A", and it is made a part of and is incorporated into this Resolution by this reference; and WHEREAS, Scott Backman, Esq., on behalf of Tanjah Investments, LLC, as the Applicant has applied for a delegation request to change the Restrictive Note on the Plat as follows: DR-57-12—Plat Note Amendment Replace Existing Language on Note From: The south 278.66 feet of development is restricted to 96,873 square feet of self-storage use and 3,473 square feet of retail use. To Proposed Language on Note: The south 278.66 feet of development is restricted to a one hundred (100) room hotel; and WHEREAS, the Applicant has also applied for an amendment to the Non-Vehicular Access Line as shown on the Plat attached as Exhibit"B"; it is made a part of and is incorporated into this Resolution by this reference; and WHEREAS, Broward County requires that the City Commission of the City of Dania Beach concur with this revision prior to a review by the Broward County Commission; NOW,THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the City Commission approves the proposed revision which amends the current Non-Vehicular Access Line and changes the Restrictive Note on the Plat to allow one hundred (100) hotel rooms on the "Leto Park" Plat, as recorded in Plat Book 118, Page 39 in the Public Records of Broward County, Florida. Section 2. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3.
