A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH,FLORIDA,APPROVING THE SITE PLAN REQUEST(SP-49-12)AND
VARIANCES (VA-63-12/VA-64-12) SUBMITTED BY SYNALOVSKI,
ROMANIK, SAYE, LLC, ON BEHALF OF NAUTICAL VENTURES FOR
PROPERTY LOCATED AT 10 BRYAN ROAD IN THE CITY OF DANIA
BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS,Chapter 28, Section 635 of the Dania Beach Land Development Code,Part 6,
entitled "Development Review Procedures and Requirements", states that site plan approval is
required as a condition to the issuance of a building permit; and
WHEREAS, the Applicant, Synalovski, Romanik, Saye, LLC, on behalf of Nautical
Ventures is requesting site plan approval for the proposed construction of an
office/showroom/storage building to be located at 10 Bryan Road in the City of Dania Beach; and
WHEREAS,the Applicant is requesting a variance to allow a ten foot(10')front building
setback associated with the site plan; the Code requires a thirty-four foot (34') front setback, per
Section 215-90; and
WHEREAS,the Applicant is requesting a variance to allow an eleven foot(I I')interior side
setback for the accessory structure associated with the site plan;the Code requires a twenty foot(20')
interior side setback,per Section 215-90; and
WHEREAS,the Applicant is requesting a variance to allow a perimeter building landscape
buffer of two feet (2') at the smallest point; the Code requires an eight foot (8') landscape buffer
adjacent to the building,per Section 511-30(P); and
WHEREAS,the City Commission conducted a duly noticed public hearing in accordance
with Article 610 of the Dania Beach Land Development Code;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH,FLORIDA:
Section 1. That that certain application for site plan approval(SP-49-12)and variances'
approval(VA-63-12/VA-64-12);copies of which are attached as Exhibit"A",which is made a part
of and are incorporated into this Resolution by this reference,is approved. It is further noted that the
original site plan is maintained in the office of the Community Development Department of the City
of Dania Beach.
Section 2. That based upon the criteria set forth in Section 635 of the Dania Beach Land
Development Code, all site plan approvals shall automatically expire and become null and void
unless the applicant files a complete building permit application with construction drawings for all
improvements shown on the site plan within twelve (12)months from the date of this Resolution;
obtains a building permit(including payment of all fees)for all such improvements within eighteen
(18) months of the date of this Resolution; and that the permits remain valid until a certificate of
occupancy or its equivalent is issued for the improvements.
Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 4. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

SUBJECT: SP-48-12/VA-63-121VA-64-12 - The applicant, Synalovski, Romanik,
Saye, LLC., is requesting variances and site plan approval for the
construction of a 13,000 square foot office/showroom/storage building
located at 10 Bryan Road.
VARIANCE
1. To allow a 10 foot front setback, code requires 34 feet; per Section 215-90.
2. To allow an 11 foot interior side setback, code requires 20 feet; per Section 215-90.
3. To allow a perimeter building landscape buffer of 2 feet at the smallest point, code
requires 8 feet; per Section 511-30(P).
SITE PLAN
To allow the construction of a 13,000 square foot office/showroom/storage building.
PROPERTY INFORMATION
EXISTING ZONING: Industrial, Research, Office, Marine(IROM)
LAND USE DESIGNATION: Regional Activity Center(RAC)
The Nautical Ventures is a small boat and kayak sales facility currently located at 1880 Griffin
Road, in the City of Dania Beach. Broward County is in the process of purchasing their existing
facility for airport expansion efforts. As such, Nautical Ventures is looking to relocate their
business in Dania Beach at the proposed site on Bryan Road.
This property is located within the Community Redevelopment Agency and requires the
assignment of 1.16 acres of commercial land at .52 FAR from the RAC use tables, leaving 28.08
acres available. In addition there are 67.8 acres of commercial (7 FAR) and 6,356 square feet of
commercial remaining in the RAC use tables.
VARIANCE
1. FRONT BUILDING SETBACK
The property is located in the IROM zoning district, which is an industrial district. The code
requires a front setback of one (1) foot for every one (1) foot of building height. Therefore a
thirty-four (34) foot front setback is required. The applicant is proposing a ten (10) foot front
setback.
While the zoning of the property is industrial, the use is more similar to a heavy commercial
activity. As such, the wide industrial setbacks are not essential. Additionally, the applicant
indicates that access to the existing boat ramps on the east side of the property are essential.
Providing the required front setback would result in the building encroaching into the circulation
area required to utilize the boat ramps.
Staff is in support of this variance request.
2. INTERIOR SIDE SETBACK
The Unified Land Development Code requires a twenty (20) foot minimum interior side setback.
The applicant is providing an eleven (11)foot two (2) inch setback from the south property line to
the existing boat rack. The boat rack exists on the property today and will be utilized by the new
property owner in its existing location. Today's code requires accessory structures to meet the
same setbacks as the primary building.
In addition, the applicant has indicated that the property to the south is under contract for
purchase by Nautical Ventures and the two properties will be unified via a unity of title, at which
time the setback would no longer be an issue.
Staff is in support of this variance request.
PERIMETER BUILDING LANDSCAPE BUFFER
The applicant is requesting a variance to reduce the perimeter building landscape buffer. The
Unified Land Development Code requires an eight (8) foot landscape buffer immediately
adjacent to the building. The applicant is providing a landscape buffer in the range often (10)
feet on the west building fagade to as little a two (2) feet four (4) inches on the south fagade of
the building. It should be noted that the required landscape material for these areas has been
provided in other landscape areas on the site.
The applicant has stated that this variance is needed to maneuver marine vessels in the
vehicular traffic areas surrounding the building. Larger landscape areas would result in
inefficient use of the land as it relates to this use.
Staff is in support of this variance request.
Section 625-40 of the Land Development Code states, the city commission or planning and
zoning board, if applicable, shall hold its public hearing and, after consideration of the staff
recommendation and public input, if any, may deny, approve or approve with conditions the
application for variance, based upon its determination that:
(1) Special conditions and circumstances exist which are peculiar to the land, structure or
building involved and which are not applicable to other lands, structures or buildings
in the same zoning district;
(2) The special conditions and circumstances do not result from the actions of the
applicant;
(3) Granting the variance requested will not confer on the applicant any special privilege
that is denied by this code to other lands, buildings or structures in this same zoning
district;

terms of this code and would work unnecessary and undue hardship on the applicant;
(5) The variance granted is the minimum variance that will make possible the reasonable
use of the land, building or structure;
(6) The variance granted will be in harmony with the general intent and purpose of this
Land Development Code, and that such variance will not be injurious to the area
involved or otherwise detrimental to the public welfare.
SITE PLAN
Site plan approval is being requested to allow the construction of a new 13,000 square That
howroom/sta a building. As stated previously, the property owner will be utilizing the

existing boat ramps and boat racks. Signage for the property will be submitted and reviewed
separately, at the applicant's request.
The applicant has submitted a request to reduce the required parking from 26 spaces to 23
spaces by reducing the parking ration for the showroom from 1:400, which is required for
showroom uses, to 1:500, which is required for decorator showroom uses.
The applicant makes the following justification for use of the proposed alternative parking
standard:
1. Excess parking supply would result in inefficient use of the property and limit the
building area that is necessary for the scale of the products that occupy the
showroom. A kayak can be a long as fourteen (14) feet and a Hobie sail boat
dimensions can be eighteen (18) feet long by eight and a half(8.5)feet wide. Both of
which are sold by Nautical Ventures.
2. The sales of kayak, sail boats and accessories is more similar, in terms of space
require to display such items, as a decorator showroom which may display rolls of
carpet and cabinets.
3. Nautical Ventures current location has two buildings, each approximately 10,000
square feet in area. A total of 42 parking spaces are provided, a ratio of
approximately 1:500. The applicant has indicated that since the opening of the
existing business, the parking supply has never been a concern.
Section 265-60 (D) allows the City Commission to review and approve alternative parking
standards concurrent with approval of a site plan. Staff is in support of this request.
The site plan was reviewed by the Fire Marshal, Public Services, the City's landscape consultant
and the Planning Division. The applicant has addressed all of staffs comments.

SETBACKS VARIANCE REQUEST
SECTION 215-90
In lieu of IROM setback requirements of 34' in the front(building height)and 20' in the interior
side,the proposed development is providing setbacks as follows:
Front: 10'-10"
Interior Side: 1 V-4"
The proposed development is unique because it requires a specific relationship to the existing
"boat access"on site. Said element has been previously permitted by the South Florida Water
Management District that"owns"the easement to the C-10 canal that provides water access to
the property.
Because of said water access and the opportunity to place docks permitted by the Army Corp
of Engineers, the site was selected for the proposed use.
Particularly, the.proposed showroom has been "sited"for efficient"boat access"from building
to canal and vice versa. This requires the reduction in the building setback from 34'to 10'.
An existing"boat rack'along the south property line is 1 V-4"from said property line in lieu of
the required 20'.
Note that the referenced south property line is only temporary as the parcel to the south is under
contract by Nautical Ventures. In the near future, a"unity of title"will be completed removing
the existing south property line of the proposed development.
Ultimately, the goal of Nautical Ventures is to also purchase the property at the NE comer of
Bryan Road and Stirling Road and complete a"master planned"development of all three(3)
parcels.
Satisfying the front and interior side setback requirements would result in inefficient use of the
property as it relates to this very particular use.

In lieu of an 8' landscape area immediately around the building, the proposed development is
providing landscape areas as follows:
North Facade: 4'-6"
South Facade: 4'-4"
East Facade: 4'-6"
Nonetheless, note that the required landscape material for those areas has been provided in
other landscape areas throughout the site.
Because of the proposed use, the dimensions required to maneuver marine vessels in the
vehicular traffic areas surrounding the building are specifically in conflict with larger landscape

Trip Generation Calculation
Based upon the information provided,a boat sales center Is proposed to be
constructed at 10 Bryan Road in Dania Beach,Florida IQmley-Horn and
Associates has prepared a trip generation calculation to determine the volume of
peak hour trips anticipated to be generated by this use.
to calculate trip generation potential of development,data published by the
Institute of Transportation Engineers(ITE)in Trip Generation,Ninth Edition Is
typically used. Trip Generation does not Include data for a land use that directly
corresponds to the proposed use;therefore,for this determination,data published
fur Land Use 841 (Automobile Sales)was used. Table 1 prbvides a calculation of
peak hour trips using the number of employees anticipated to be employed at the
site as the Independent variable. Based upon the Information you provided,the
site is e)pected to have 8 employees.

approval of parking category#34 for designer showroom.
Attached please find correspondence from Kimley-Hom and Associates documenting that only
eight(8) peak hour trips will be generated by the proposed development. This trip generation
analysis reconciles the unique characteristics of the proposed use and confirms a lower parking
requirement.
Further, excess parking supply would result in inefficient use of the property and limit the
building area that is necessary for the"scale"of products that occupy the showroom.
Marine vessels and related products large and require greater viewing and placement area
compared to general showroom products.
Similarly, the vehicular traffic areas are"oversized"to allow the outdoor"maneuverability"of
these larger showroom products.
Note that currently, Nautical Ventures provides less parking at their existing facility for similar area
of showroom. Since opening for business, the parking supply at Nautical Ventures has never

2) The applicant, Synalovski, Romanik, Saye, LLC, is requesting variance and site plan
approvals (SP-49-12) for Nautical Ventures, for the construction of a 13,000 square foot
office/showroom/storage building located at 10 Bryan Road. The variances requested are as
follows:
1. To allow a 10 foot front setback,code requires 34 feet;per Section 215-90.
2. To allow an 11 foot interior side setback,code requires 20 feet;per Section 215-90.
3. To allow a perimeter building landscape buffer of 2 feet at the smallest point, code
requires 8 feet;per Section 511-30(P).
Legally Described as: PARCEL A of `CLARKE SUBDIVISION" according to the Plat
thereof recorded in plat book 101, page 32 of the public records of Broward County, Florida;
which is a portion of the NW 1/4 of the NW 1/4 of the SE 1/4 of the SE 1/4 of Section 33,
Township 50 South,Range 42 East. PARCEL B a parcel of land being located I the southeast
one-quarter (SE 1/4) of Section 33, Township 50 South, Range 42 East, being more
particularly described as follows: Commence at the Southeast(SE)corner of said Section 33;
thence North 01 17' 46"west along the east line of said section 33 for a distance of 1,340.78
feet; thence south 87 30 33"west for a distance of 1,118.51 feet to the northeast(NE) corner
of a parcel of land as described in official records book 8775, page 400 of the public records
of Broward county, Florida; Thence south 0126 53"east along the east line of said parcel for
a distance of 50.01 feet to the point of beginning; thence continue along aforesaid line for a
distance of 25.00 feet to the southeast (SE) comer of said parcel, (said point also being the
northeast corner of parcel A of"Clarke Subdivision"as recorded in plat book 101,page 32 of
the public records of Broward County, Florida thence south 87 30 33 west along the south
line of aforementioned parcel(said line also being the north line of said"Clarke Subdivision"
Plat) for a distance of 186.10 feet to the Northwest (NW) comer of parcel A of said plat;
Also thence north 42 30 48 east, a distance of 35.36 feet; thence north 87 30 33 east along a
line 25 feet north of and parallel with the north line of said" Clarke Subdivision" a distance
of 161.55 feet to the point of beginning. Said lands lying and situate in the City of Dania
Broward County Florida.
