Call to Order/Roll Call Mayor Duke called the meeting to order at 7:00 p.m. Present: Mayor: Walter B. Duke, III Vice-Mayor: Albert C. Jones Commissioners: Chickie Brandimarte Patricia A. Flury Bobbie H. Grace Assistant City Manager: Colin Donnelly City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Commissioner Grace gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Special Event request for the "2013 Relay for Life", to be held on Friday and Saturday, April 26-27, 2013, at Frost Park Recreational Complex. The applicant is requesting a special event permit fee waiver, as well as use of Frost Park, chairs, tables, and tents. BSO Detective Connie Bell, Chair of Relay for Life, requested a donation from the City of Dania Beach for Relay for Life. Vice-Mayor Jones motioned to approve the Special Event request for the 2013 Relay for Life, including the fee waiver and use of facilities; seconded by Commissioner Grace. The motion carried on the following 5-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Jones Yes Commissioner Flury Yes Mayor Duke Yes Commissioner Grace Yes 3.2 Recognition of Dania Beach Lifeguards—Mayor Duke Mayor Duke recognized the beach lifeguards for their outstanding service to the City of Dania Beach and presented them with certificates of appreciation. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Bob Mikes, 601 NW 7th Street, Chairman of the Airport Advisory Board, commented he thought it was wrong to appoint one commissioner as the point person for airport matters. He felt every commissioner should use the contacts they have with County officials and recommended having a staff committee that negotiates with the County. Peggy McKenna, 34 SE 1 Oth Terrace, clarified the Dania Beach Improvement Committee request for naming the entryway into City Hall as "Mac Way" in honor of Commissioner McElyea. She suggested the Commission initiate a Dania Beach Historic Society and make Mac the historian. Ms. McKenna requested a sign be placed for Mac's Way at City Hall. Mayor Duke requested that staff take care of the details and bring it back to the Commission; to that end, Ms. McKenna is to follow up with Assistant City Manager Donnelly. Commissioner Flury asked if the committee would approve the designation of C. K. "Mac" McElyea Plaza and Ms. McKenna responded in the affirmative. Carolyn Jones, 722 SW 3rd Street, thanked everyone for their assistance with and support of the MLK Jr. Parade and events, noting that all monies raised will go toward scholarships. She added that the committee has established an MLK corporation and is able to accept donations. Ms. Jones spoke about a recent article in Cahoots magazine regarding Commissioner Flury's residency. Ann Page, 38 SW 5th Street, President of Friends of the Library, asked the commissioners, who are all Friends of the Library, to commit to one hour per month to read to the children at Collins Elementary. She reminded everyone that Saturday is the 2nd Annual Walk for the Library. Vice-Mayor Jones suggested that the Friends also go to other schools to read to the children. 6. Public Safety Reports Major Donn Peterson, BSO Chief of Police, was available to answer questions and addressed the issue of construction traffic on Griffin Road due to the airport expansion. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,January 22,2013—7:00 p.m. Commissioner Grace would like BSO to work with Code Enforcement to address the situation with cars lining up on Griffin Road to access the Hess Station and jeopardizing the safety of school children at the nearby bus stop. Commissioner Brandimarte requested a representative from BSO attend the Seniors meetings, as has been done in the past. Bruce Caruso Division Chief BSO Fire Rescue was available to answer questions and commented on Fire Rescue's participation in the Library Walk event. 7. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,January 22,2013—7:00 p.m. Commissioner Grace motioned to adopt the Consent Agenda, with the exception of Items #7.2 and #7.6; seconded by Vice-Mayor Jones. Vice-Mayor Jones suggested training opportunities that are closer in proximity be pursued whenever possible. Commissioner Flury motioned to approve the request; seconded by Vice-Mayor Jones. The motion carried on the following 5-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Jones Yes Commissioner Flury Yes Mayor Duke Yes Commissioner Grace Yes 7.6 RESOLUTION#2013-014 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A CONSTRUCTION OVERSIGHT SERVICES AGREEMENT RELATING TO THE DANIA BEACH MUNICIPAL MARINA-PHASE II CONSTRUCTION PROJECT WITH CRAVEN THOMPSON AND ASSOCIATES, INC. IN AN AMOUNT NOT TO EXCEED FIVE HUNDRED FORTY FOUR THOUSAND EIGHT HUNDRED TEN DOLLARS ($544,810.00),PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2013-014. Commissioner Flury noted this item is for project management and she is concerned that the contract is for one year insofar as if it exceeds this period, we then pay an hourly rate, which could be an incentive for the project manager to delay the project. She said there seems to be no protection for the City and questioned what would happen if the project is delayed. City Attorney Ansbro responded the agreement could be reviewed and any issues modified or clarified. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,January 22,2013—7:00 p.m. Commissioner Flury was also concerned with what she felt was loosely constructed language about costs in the Scope of Services and about performance under Construction Requirements. City Attorney Ansbro explained this proposal would be attached to his standard agreement, the language in which provides protections to the City. Commissioner Flury motioned to adopt Resolution #2013-014; seconded by Commissioner Grace. Assistant City Manager Donnelly commented that there is flexibility in the contract to not use all of the budgeted funds in that the project manager's hours can be cut back if and when there is no need for a full-time basis. Further responding to Commissioner Flury, he noted any need for an increase in fees would be brought to the Commission. He noted that staff is requesting a continuance until the February 26, 2013 City Commission meeting at 7:00 p.m. Mayor Duke opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearing. Vice-Mayor Jones motioned to continue Ordinance #2013-001 until the February 26, 2013 City Commission meeting at 7:00 p.m.; seconded by Commissioner Grace. The motion carried on the following 5-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Jones Yes Commissioner Flury Yes Mayor Duke Yes Commissioner Grace Yes 9.2 RESOLUTION#2013-009 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE DELEGATION REQUEST SUBMITTED BY SCOTT BACKMAN, ON BEHALF OF TANJALI INVESTMENT, LLC, TO AMEND THE NON-VEHICULAR ACCESS LINE AND TO CHANGE THE RESTRICTIVE NOTE ON THE PLAT KNOWN AS THE "LETO PARK" PLAT, RECORDED IN PLAT BOOK 118, PAGE 39 IN THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA, AND LOCATED AT THE NORTHWEST CORNER OF STIRLING ROAD AND SOUTHWEST 19' COURT IN DANIA BEACH; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2013-009. Corinne Lajoie, Principal City Planner, provided an overview of the subject property and the delegation request. Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,January 22,2013—7:00 p.m. Mayor Duke noted he had been contacted by the petitioner. 9.3 RESOLUTION#2013-010 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN REQUEST (SP-49-12) AND VARIANCES (VA-63-12NA-64-12) SUBMITTED BY SYNALOVSKI, ROMANIK, 'SAYE, LLC, ON BEHALF OF NAUTICAL VENTURES FOR PROPERTY LOCATED AT 10 BRYAN ROAD IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2013-010. Corinne Lajoie, Principal City Planner, provided an overview of the property and requests. Commissioner Grace asked if this was compatible with what the neighborhoodY said the wanted. Ms. Lajoie responded in the affirmative, noting it is a marine business on the waterway and is compatible with the CRA's vision to maximize waterfront. In addition, it is not immediately adjacent to residential. Manny Synalovski, architect for the project, noted they agree with all of staffs recommendations. Commissioner Grace asked if this would help improve Dania Beach Boulevard. Mr. Synalovski said it would and he described the landscape material to be used on the north side of the property, which abuts Dania Beach Boulevard, and the four elevations of the building. Commissioner Flury questioned the proposed landscaping, particularly on the north side. Mr. Synalovski explained the overall landscaping plan and property improvements, noting there will be only heavy landscaping and no fencing on the north side. Vice-Mayor Jones asked how this would impact drainage in this area. Mr. Synalovski responded the site plan design is such that all of the water on the property would be handled onsite and would be eliminated from shedding onto Bryan Road as occurs presently. Mayor Duke opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearing. Discussion and Possible Action There were no discussion items on this agenda. 11. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte commented on the MLK dinner and parade. She noted no one from the businesses on US-1 came out to see the parade and complained about the hurricane shutters on these downtown businesses. She felt changes need to come soon to this area. 11.2 Commissioner Flury Commissioner Flury spoke about the MLK celebration. Commissioner Flury commented she serves on the Firefighters Pension Board and noted the $32,000.00 in interest that accrued when BSO did not make the payment is still unpaid. She said the issue will not go away and felt it is BSO's responsibility, but it needs to be addressed. Mayor Flury spoke about income from EMS transport decreasing from approximately $1 million in 2009 while fees and units of service have increased since then. The information she has asked for that was distributed to the Commission does not reflect an answer to this issue and apparently the problem stems from lack of documentation,perhaps due to a lack of training in the field. She remarked the Finance Department says the collection company is working with BSO, but there is no longer an incentive for the fire department to work with us to collect the money. Commissioner Flury felt it was a mistake to go to BSO for fire service insofar as the City is losing money and this problem needs to be resolved. Commissioner Flury questioned the Aging Accounts, in particular, whether outstanding invoices for Derektor are being addressed, as collection of monies owed to the City would help come budget time. Assistant City Manager Donnelly responded that staff has been meeting with Derektor and their attorneys to resolve the back debt. Commissioner Flury commented that there is currently a City position open and in light of the fact the Commission would like to see Dania Beach residents hired, she wants those residents who applied to be given the courtesy of an interview and every consideration possible. 11.3 Commissioner Grace Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,January 22,2013—7:00 p.m. Commissioner Grace asked that a request be relayed to CRA Director Earle to place a "save the date" for the Seafood Festival on the water bills for the next couple of months. Commissioner Grace thanked Parks & Recreation, BSO, and Public Works for cleaning up for the MLK celebration. Commissioner Grace noted the parking meters at the beach were not working on Sunday and stressed that we need to stay on top of this to avoid loss of revenue. 11.4 Vice-Mayor Jones Vice-Mayor Jones spoke about attending local events, including the opening of the Intermodal Container Transfer Center at Port Everglades, the Marina Mile Association breakfast and the g , MLK banquet and parade. 11.5 Mayor Duke Mayor Duke commented on upcoming events and the MLK celebration. P g Mayor Duke questioned the status of the Commission workshop and asked that a new date be set tomorrow. 12.
