DANIA BEACH CITY COMMISSION
TUESDAY, FEBRUARY 12, 2013 — 7:00 P.M.
1. Call to Order/Roll Call
Mayor
ayo Duke called the meeting to order at 7:04 p.m.

2. Invocation and Pledge of Alle 'glance
Reverend Gregory Pope, First Bethel Baptist Church of Dania, gave the invocation followed by
the Pledge of Allegiance to the United States Flag.
3. Presentations and Special Event Approvals
3.1 Special Event request from Al Behrendt Enterprises for the annual "Dania Beach
Marine Flea Market"to be held March 14-17,2013, in the Dania Jai Alai parking lot
Commissioner Grace motioned to approve the Special Event request for the Dania Beach
Marine Flea Market; seconded by Vice-Mayor Jones. The motion carried on the following
5-0 Roll Call vote:

3.2 Special Event request from Marine Industries Association of South Florida for the
"36U' Waterway Cleanup" to be held on Saturday, March 16, 2013, from 9:00 a.m. to
1:00 p.m. on Dania Beach. The applicant is requesting a special event fee waiver,
beach parking fee waiver and a dumpster to be supplied by the City.
Commissioner Grace motioned to approve the Special Event request for the 36th Waterway
Cleanup; seconded by Vice-Mayor Jones. The motion carried on the following 5-0 Roll
Call vote:

4. Proclamations
4.1 Black History Month
Commissioner Grace read the proclamation for Black History Month.

3.3 State of the City Presentation—Mayor Duke
The State of the City video was presented at this time. The video will be available on the City
website.
Mayor Duke thanked Frank and Phyllis Loconto for the production of the video.
5. Citizen Comments
Ann Page, 38 SW 5th Street, President of Friends of the Library, thanked everyone involved with
the 2nd Annual Walk for the Dania Beach Paul De Maio Library and noted $3,400.00 was raised.
Fay Bartelmes, 214 SW 2nd Terrace, questioned why there were no benches at the bus shelters.
Mayor Duke asked the City Manager to work with CRA Director Earle to get benches installed.
6. Public Safety Reports
City Manager Baldwin noted he appointed Lieutenant Kevin Granville as the new Police Chief.

7.3 RESOLUTION#2013-015
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,URGING THE
FLORIDA LEGISLATURE TO REPEAL CERTAIN SECTIONS OF FLORIDA STATUTES THAT PREVENT
LOCAL GOVERNMENTS FROM EXERCISING THEIR HOME RULE AUTHORITY TO REGULATE,
PROHIBIT OR BOTH, AS TO FIREARMS IN PUBLIC PARKS AND OTHER LOCAL GOVERNMENT
OWNED FACILITIES AND PROPERTY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
7.4 RESOLUTION#2013-016
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,
AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A MAINTENANCE MEMORANDUM OF
AGREEMENT WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION IN AN AMOUNT
NOT TO EXCEED FIFTEEN THOUSAND ONE HUNDRED SIXTEEN DOLLARS AND 50 CENTS
($15,116.50) TO UPDATE THE PROJECT WORK AND PROJECT COSTS FOR A PORTION OF STATE
ROAD 9 (1-95) AT STATE ROAD 848 (STIRLING ROAD) FOR THE INTERCHANGE NORTHWEST AND
NORTHEAST QUADRANTS(M.P.0.140 TO M.P. 0.237)LOCATED WITHIN THE CITY OF DANIA BEACH;
PROVIDING FOR FUNDING; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
7.5 RESOLUTION#2013-017
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,
AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE WORK ORDER NO. 18 FOR TECHNICAL
EXPERT CONSULTING SERVICES RELATING TO THE 2.0 MGD NANOFILTRATION WATER
TREATMENT PLANT TO BE PROVIDED BY CDM SMITH INC., A FOREIGN CORPORATION
AUTHORIZED TO CONDUCT BUSINESS IN THE STATE OF FLORIDA, AND WHICH WORK ORDER
WILL PROVIDE NANOFILTRATION OPERATIONS ASSISTANCE TO THE CITY IN AN AMOUNT NOT TO
EXCEED$34,876.00;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE.
Commissioner Grace motioned to adopt the Consent Agenda; seconded by Vice-Mayor
Jones. The motion carried on the following 5-0 Roll Call vote:

There were no public hearings on this agenda.
10. Discussion and Possible Action
10.1 Discussion to Create an Educational Advisory Board—Vice-Mayor Jones
Vice-Mayor Jones thought this board would be an added value in dealing with the school board
and would bring a needed commitment by the City and City Commission that we are going to be
there for our schools. He noted that he talked to the principals of each school and they agree that
an educational board is apropos for this community.
Commissioner Flury motioned that staff move forward with the structural development of
an Educational Advisory Board; seconded by Commissioner Grace. The motion carried on
the following 5-0 Roll Call vote:

11. Commission Comments
11.1 Commissioner Brandimarte
Commissioner Brandimarte noted that no members of the COPS program were present at the
three events held on January 26 and she urged the new sheriff to encourage the members to
attend community events.
11.2 Commissioner Flury
Commissioner Flury concurred that the COPS program is very important. She said it is apparent
that the program is not important to the new sheriff and this will be one of the issues to be
discussed with the new Chief.
Commissioner Flury spoke of the City Center project and requested the CRA make a
presentation at a future Commission meeting.
11.3 Commissioner Grace
Commissioner Grace spoke of the Black History Month events that are being held in the City of
Dania Beach.

Commissioner Grace questioned why community buses do not provide service to the SW section
and noted this area needs to be added to the schedule.
11.4 Vice-Mayor Jones
Vice-Mayor Jones presented a plaque from the County given to the City of Dania Beach for our
participation in the Go Solar Program.
Vice-Mayor Jones commented about Superintendent of Schools Runcie coming to his church to
speak last Sunday.
Vice-Mayor Jones spoke about a recent conference for the Hospital District he attended.
11.5 Mayor Duke
Mayor Duke noted residents have been reaching out to him regarding FPL sending letters
advising that they will cut their palm trees down. He asked that anyone who is contacted to
notify him, as there is a liaison at FPL to deal with such matters.
Commissioner Duke requested a date be set for the Commission workshop.

On behalf of Mayor Duke, Vice-Mayor Jones appointed Bettie H. Ellis
Commissioner Grace motioned to approve the appointments; seconded by Vice-Mayor
Jones. The motion carried on the following 5-0 Roll Call vote:

13. Administrative Reports
13.1 City Manager
City Manager Baldwin thanked the sheriffs office for 3 good candidates for the police chief
position. He commented about meetings held with the sheriff's office and noted he is working
with them to address the COPS program and other issues.

13.2 City Attorney
City Attorney Ansbro noted the Office of Inspector General has submitted a memorandum that
all commissioners need to report, by February 15, all ethics training received last year. He
advised he will provide a Safe Harbor opinion for the Commission tomorrow.
