DANIA BEACH CITY COMMISSION
TUESDAY, MARCH 12, 2013 — 7:00 P.M.
1. Call to Order/Roll Call
Mayor Duke called the meeting to order at 7:00 p.m.

2. Invocation and Pledge of Allegiance
Commissioner Grace gave the invocation followed by the Pledge of Allegiance to the United
States Flag.
3. Presentations and Special Event Approvals
3.1 Special Event request from The Field Irish Pub & Eatery for their annual "St.
Patrick's Day Celebration" to be held Saturday & Sunday, March 16-17, 2013, at The
Field Restaurant located at 3281 Griffin Road. The applicant is funding and
requesting permission for a 2 day road closure from FDOT, as well as a BSO detail
for this event.
Commissioner Flury and Vice-Mayor Jones expressed their concern with the lane closure on
Griffin Road.
Commissioner Grace motioned to approve the Special Event request for The Field Irish
Pub & Eatery's St. Patrick's Day Celebration; seconded by Commissioner Brandimarte.
The motion carried on the following 5-0 Roll Call vote:

3.2 Special Event request from the Ft. Lauderdale Rotary 1090 Foundation, Inc. for the
"U.S. Military 5K" to be held on Dania Beach on Sunday, May 5, 2013, from 7:30
a.m. - 1:00 p.m.
Shawn Stewart, 13873 SW 40th Street, Davie, Ft. Lauderdale Rotary, spoke briefly about the
event.
Commissioner Grace motioned to approve the Special Event request for the Ft. Lauderdale
Rotary 1090 Foundation's U.S. Military 5K; seconded by Vice-Mayor Jones. The motion
carried on the following 5-0 Roll Call vote:

3.3 Special Event request from the Community Redevelopment Agency for the "Dania
Beach Arts & Seafood Celebration" to be held on Saturday/Sunday, April 6&7, 2013,
from 10:00 a.m. - 7:00 p.m. at Frost Park. The applicant is requesting a road closure
on Fronton Boulevard and various fee waivers.
Jeremy Earle, CRA Executive Director, spoke briefly about the event.
Commissioner Grace motioned to approve the Special Event request for the Dania Beach
Arts & Seafood Celebration, including road closure and fee waivers; seconded by Vice-
Mayor Jones. The motion carried on the following 5-0 Roll Call vote:

3.4 City Center Development Project—CRA Director Earle
Mayor Duke invited the citizens in the audience to speak during this presentation.
Jeremy Earle, CRA Executive Director, presented the background leading up to, and overview
of, the proposed City Center development project, which is attached to and incorporated into
these minutes.
Commissioner Grace commented this is an excellent proposal and hopefully the project can be
done without putting a burden on the taxpayers.
Commissioner Brandimarte questioned if we would be paying for City Hall.
Director Earle responded that we have not negotiated with the developer; therefore, we do not
know at this time.

Dania Beach City Commission
Tuesday,March 12,2013—7:00 p.m.
Mimi Donly, 209 SE 3`d Terrace, questioned who would own the building. Director Earle
responded this would be a lease agreement where the City would own the land forever, but the
developer would maintain the property.
Ms. Donly spoke against the development.
Terry Hale Hicks, 331 SW 2nd Avenue, said the size of the proposed apartments is small and
questioned if there are similar ones available to view.
4. Proclamations
4.1 March for Meals Month
Mayor Duke presented the proclamation to Mark Adler, Executive Director of Broward Meals on
Wheels.
4.2 Viva Florida 500
Mayor Duke read the proclamation and noted it would be sent to the Viva Florida Committee.
4.3 Women's History Month
Vice-Mayor Jones read the proclamation.
5. Citizen Comments
Carolyn Jones, 722 SW 3`d Street, named and commented on the women pioneers in Dania
Beach who should be recognized during Women's History Month.
John Vazquez, Public Relations Officer, Post 304 American Legion, noted Fleet Week will
commence in late April and requested the City provide the transportation to pick up the
servicemen on May I". The Commission directed the City Manager to follow-up with this
request.
Ann Page, 38 SW 5th Street, President, Friends of the Library, provided an update on the
activities at the Library. She noted that in April,the Friends of the Library will celebrate History
Month, and asked if they could interview former Commissioner McElyea at City Hall sometime
during that month. She said the City should consider appointing an historian-in-residence every
year and perhaps present former Commissioner McElyea with this title at this same event.
Additionally, she would like to have an arts show during this time and noted Elizabeth
Wentworth is on board to provide assistance. Ms. Page felt the interview could be televised and
archived for future showings to school children. She asked for Vice Mayor Jones' help in
locating a black member of the community who she could interview.

The Commission supported the requests.
6. Public Safety Reports
Bruce Caruso, BSO Fire Rescue, EMS Division Chief, noted the City received a grant for six
AEDs and they have been installed in City facilities.

TRANSPORTATION SERVICES, WHICH SERVICES SHALL NOT EXCEED THE AMOUNT OF$184,000.00
PER YEAR;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution#2013-032.
Vice-Mayor Jones requested the status of establishing bus service in the College Gardens area.
Mark Felicetty, Director of Parks and Recreation, noted additional routes and stops were applied
for in November, but the County has not provided a response to date.
Commissioner Flury questioned if additional stops could be added, and paid for, by the City.
Vice-Mayor Jones motioned to adopt Resolution #2013-032; seconded by Commissioner

7.6 RESOLUTION#2013-033
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,
AUTHORIZING THE PROPER CITY OFFICIALS TO ENTER INTO AND EXECUTE A BANKING SERVICES
AGREEMENT AND RELATED DOCUMENTS WITH SUNTRUST BANK TO PROVIDE BANKING
SERVICES TO THE CITY OF DANIA BEACH TO BECOME EFFECTIVE ON MAY 1, 2013, WITHOUT
COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS BASED UPON NET SERVICE
PRICING EQUAL TO THE SEPTEMBER 19, 2011 BID AWARD AND AGREEMENT EXECUTED BY THE
CITY OF COCONUT CREEK; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution#2013-033.
Commissioner Brandimarte said the business should be given to a bank in Dania Beach to show
we are business-friendly to our own.
Mark Bates, Finance Director, explained the criteria for providing banking services, noting that
the banks in Dania Beach did not respond to our requests for proposals for the marina loan.
Vice-Mayor Jones questioned local banks meeting the qualifications and suggested we go out to
bid for banking services.
A brief discussion ensued regarding this item, past service providers, and going out to bid.
Vice-Mayor Jones motioned to go out to bid for banking services; seconded by Commissioner
Brandimarte.

Mayor Duke noted community banks often have a difficult time in meeting the needs of
municipalities.

City Attorney Ansbro noted SunTrust was easy to work with and agreeable to making changes to
the contract.

9. Public Hearings and Site Plans
There were no public hearings on this agenda.
10. Discussion and Possible Action
10.1 Schedule City Commission Summer Break
The Commission discussed the schedule for the budget public hearings and summer break.
The Commission set Thursday, September 12, 2013 at 5:00 p.m. as the date for the first Budget
Public Hearing, and Wednesday, September 25, 2013 at 5:00 p.m. as the date for the final
Budget Public Hearing date.
Commissioner Flury felt there should be a budget workshop in June to discuss the proposed
budget before it is presented to the Commission in July.
Mayor Duke asked the City Clerk to set a budget workshop date in June.

Vice-Mayor Jones motioned to cancel the July 9, 2013 City Commission meeting and the
July 18, 2013 Abatement Hearing; seconded by Commissioner Brandimarte. The motion

10.2 Reconsideration of a Special Exception request to locate a new communication tower
City Attorney Ansbro noted tonight's request is only for reconsideration of placing the Special
Exception item on a subsequent meeting agenda.
Gregory Balicki, P.E., Director of Engineering, Broward County Water and Wastewater
Services, addressed the benefits of the tower to the residents of Dania Beach. He noted the tower
will only be used for Broward County Water and Wastewater Services lift station
communications and would not be available for use by anyone else.
Vice-Mayor Jones asked if the County would object to a proviso that if the tower reverts to
telecommunication use,then the tower would go away.
City Attorney Ansbro responded the City could add a condition to the approval that would forbid
co-location(sharing with another user)without written approval of the Commission.
Vice-Mayor Jones motioned to reconsider the Special Exception request to locate a new
communication tower; seconded by Commissioner Brandimarte. The motion carried on

11. Commission Comments
11.1 Commissioner Brandimarte
Commissioner Brandimarte had no comments.
11.2 Commissioner Flury
• Gas station north of old laundry building is in bad shape; homeless people are living in a
shed at this location
• Monroe Udell Street looks bad; perhaps we could look at it and develop an improvement
plan for discussion at the budget workshop

• Thanked staff for the recent workshop
• After various discussions regarding airport issues and talking to Kent George, who will
be sending a letter to the City Manager, we are prepared to go back to the table for
mediation hearings;Neal McAliley will be meeting with Broward County attorneys to set
up the mediation and during these discussions, we will continue to proceed with the two
legal cases pending in court
11.3 Commissioner Grace
• Questioned measures being taken concerning erosion at the beach; perhaps we can
piggyback on Ft. Lauderdale's efforts
• Walgreens landscaping looks fantastic; the building across the street, where Memorial
Health Care is a tenant, is in need of work
• Dania Beach Relay for Life has reached the halfway mark of its pledge goal
11.4 Vice-Mayor Jones
• Was recently in Tallahassee for the Florida Hospital Association conference; lobbied for
extending health care coverage for low income families through Medicaid
• Spoke with City lobbyist Carol Duncanson
o The eminent domain bill is moving through the legislative committee process
o There will not be any casino legislation coming forth this year
• Questioned contact with our federal lobbyist; Mayor Duke noted he is going to
Washington April 10-11
• Wants heater for pool at Collins Elementary included in the upcoming budget; Mayor
Duke concurred and suggested looking into solar powered heat
11.5 Mayor Duke
• Regarding the appearance of downtown, the Commission is on board and staff
understands it; there are three weeks in which to clean up the public areas before the Arts
& Seafood Celebration
Commissioner Flury commented a "clean up our city program" needs to be developed, as many
other cities have done, for a more comprehensive plan.
Vice-Mayor Jones noted Hollywood has a"cash for trash"program and we need to look into it.
Commissioner Grace agreed, noting the trash cans at the parks contain a lot of recyclable cans
and bottles.

13. Administrative Reports
13.1 City Manager
City Manager Baldwin noted he has five meetings scheduled over the next two weeks with BSO
to discuss reducing public safety costs.
City Manager Baldwin advised that the County Commission voted today to allow rescission of
the original Municipal Services Taxing Unit (MSTU) vote and they will consider an option for
another MSTU at their next meeting. This will not solve our problems for regional
communications,but it will open the issue up for discussion.
City Manager Baldwin reported that Conehead termites have reappeared in Dania Beach and
eradication will begin tomorrow. Information regarding the eradication will be posted on the
City's website.
