HomeMy WebLinkAbout2013-04-09 Regular City Commission Meeting Minutes MINUTES OF REGULAR MEETING DANIA BEACH CITY COMMISSION TUESDAY, APRIL 9, 2013 — 7:00 P.M. 1. Call to Order/Roll Call Mayor Duke called the meeting to order at 7:00 p.m. Present: Mayor: Walter B. Duke, III Vice-Mayor: Albert C. Jones Commissioners: Chickie Brandimarte Patricia A. Flury Bobbie H. Grace City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Commissioner Grace gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Presentation by Captain Kevin Granville, BSO Chief of Police, to Deputy Randy Graham Captain Granville presented a plaque to Detective Randy Graham in appreciation for his 30 years of service to the Broward Sheriff s Office. Ayala Avroya, 5612 Park Road, said her community is in need of a park as well as lighting. Mayor Duke asked City Manager Baldwin to follow-up with staff. 3.2 Presentation by City Auditor, Keefe, McCullough & Co., of Comprehensive Annual Financial Report(CAFR) Cindy Calvert, Keefe, McCullough& Co., gave an overview of the results of the Comprehensive Annual Financial Report, which was included in the agenda packet. Commissioner Flury commented she does not agree with the amount of reserves the City maintains and feels it should be between $8-10 million because of issues associated with the City's age. She noted in the management letter, comments about problems with the water meters appear for the second year in a row and it is time to take significant action to resolve the issue. Commissioner Flury questioned how the $1.7 million in the CRA Reserve account can be used. Mark Bates, Finance Director, explained the $1.7 million is the remaining balance after CRA receipt and expenditure of County money, and transfers and funding from the General Fund. He noted that $1.2 million of this balance has been appropriated for specific capital projects and there is $550,000.00 remaining. Commissioner Flury remarked there is perhaps $10 million remaining in State Revolving Funds available to borrow and it might be time to think about doing a new water/sewer/wastewater plan to carry us through the next ten years. Commissioner Grace agreed we should have larger reserves. Vice-Mayor Jones questioned the gate arm system in the parking garage, in particular, the funding and whether the system is operable. Finance Director Bates responded County grant money is due to the City for funds that were expended and the gate arms are operable. City Manager Baldwin noted the request for the funds has been submitted to the County. Colin Donnelly, Assistant City Manager, said the County wants to do a field test, so arrangements will need to be made to turn the system on and make it operational in order to accommodate them. Mayor Duke commented there are five or six near-term financial landmines to be dealt with, including coastal erosion, pension and healthcare issues, water, regional emergency communications, and CRA grants triggering to loans. He asked if the auditors opined on these matters. Ms. Calvert responded these issues are not within the scope of the audit. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,April 9,2013—7:00 p.m. Jeffery Bennett, 9 NW 80' Avenue, Apt. #1, spoke of the Building Leaders of Communities (B.L.O.C.) Program that he initiated to help clean up the City. Their first event will be Family Fun Day at C.W. Thomas Park on May 18d'. Vice-Mayor Jones would like to see a citywide effort and suggested a cash incentive for the organizations that are cleaning up. Commissioner Brandimarte commented that Mr. Bennett wanted plants for C.W. Thomas Park and asked if it would be possible for Parks & Recreation to provide financial assistance. Mayor Duke responded in the affirmative, noting he had asked the City Manager to support this group and others like it. Commissioner Brandimarte added she will donate $100.00 for Mr. Bennett's planting efforts. Betty Sokol, 609 NW l Od' Street, noted the plants and flowers are now in at Melaleuca Gardens. Christine Douglas, 4665 SW 38d` Terrace, President of Davis Isles Homeowners Association, thanked the Commission and staff for the crime watch signs. Ann Page, 38 SW 5th Street, President, Friends of the Library, spoke about the Historical Interview on April 2nd and thanked everyone for their cooperation. 6. Public Safety Reports Captain Kevin Granville, BSO Chief of Police, noted an active shooter scenario is being conducted tonight at Olsen Middle School. Bruce Caruso, Division Chief, BSO Fire Rescue, noted BSO received interest from people attending the Arts & Seafood Celebration to join the CERT Team. 7. Commissioner Grace motioned to adopt the Consent Agenda, with the exception of Items #7.3 and #7.5; seconded by Vice-Mayor Jones. The motion carried on the following 5-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Jones Yes Commissioner Flury Yes Mayor Duke Yes Commissioner Grace Yes 7.3 RESOLUTION#2013-040 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO PURCHASE SECURITY STAFFING SERVICES FOR VARIOUS CITY FACILITIES AND LOCATIONS FROM PROFESSIONAL SECURITY & INVESTIGATIONS COMPANY IN AN AMOUNT NOT TO EXCEED THIRTY-FIVE THOUSAND DOLLARS ($35,000.00) FOR THE FISCAL YEAR 2012-2013, WITHOUT COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS;PROVIDING FOR CONFLICTS;FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2013-040. Vice-Mayor Jones requested an update on the status of the Park Ranger position. City Manager Baldwin gave a brief background of the Park Ranger position, noting it has been filled, and an overview of the position's intended function. Discussion ensued regarding the services to be provided by the security firm under consideration. Commissioner Grace motioned to adopt Resolution #2013-040; seconded by Vice-Mayor Jones. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,April 9,2013—7:00 p.m. City Attorney Ansbro read the title of Resolution#2013-042. Commissioner Flury noted cities generally change auditors every three to five years and asked how long this company has been providing services to Dania Beach. Mark Bates, Finance Director, responded the firm began in 2007. Commissioner Flury recommended that we go out to bid for auditing services due to the length of service of the current firm. Commissioner Flury motioned to go out to bid for auditing services; seconded by Vice- Mayor Jones. Finance Director Bates noted an audit selection committee is required pursuant to state statutes and discussed the acceptable make-up of the committee. Commissioner Flury added to the motion to include establishing the Commission as the selection committee. Bids and Requests for Proposals There were no proposals on this agenda. 9. Public Hearings and Site Plans There were no public hearings on this agenda. 10. Discussion and Possible Action 10.1 Discussion of Ordinance #2013-003 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, CONSENTING TO BE INCLUDED IN A MUNICIPAL SERVICES TAXING UNIT "MSTU" FOR A CONSOLIDATED REGIONAL E-911 COMMUNICATIONS SYSTEM CREATED BY BROWARD COUNTY ORDINANCE, FOR THE PERIOD OF TIME NOT TO EXCEED FIVE (5) YEARS; PROVIDING FOR Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,April 9,2013—7:00 p.m. CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING) City Attorney Ansbro read the title of Ordinance#2013-003. City Manager Baldwin gave an overview of the issue and recommended passing the ordinance on first reading in order to keep our options open. Vice-Mayor Jones expressed concerns about the County's direction, noting we are being pressured to make decisions without all of the information and he favors opting out. Commissioner Flury commented this is blackmail and she will not participate in it. City Manager Baldwin noted there will be a meeting tomorrow for all the cities to discuss and possibly decide what to do next. He advised there will not be an opportunity for the Commission to make a decision if this ordinance is not passed on first reading. Vice-Mayor Jones asked if we could put money in escrow, opt out, and wait to see what happens. City Attorney Ansbro responded he would like to see this go to a circuit judge for a declaratory judgment and asked City Manager Baldwin to discuss this tomorrow with the other cities. Commissioner Grace motioned to adopt Ordinance #2013-003, on first reading; seconded by Commissioner Brandimarte. Commission Comments 11.1 Commissioner Brandimarte • The Art & Seafood Celebration was a huge success; she would like us to consider holding it at the beach in future years • Stroller and handicap accessibility at the event also needs to be considered • Asked the City Manager to involve Chief Casano in the research of CERT funding 11.2 Commissioner Flury • The Art & Seafood Celebration was great; she would not want to move it to the beach due to parking issues 11.3 Commissioner Grace Minutes of Regular Meeting Dania Beach City Commission Tuesday,April 9,2013—7:00 p.m. • The Art& Seafood Celebration was fantastic; she thanked everyone involved • She would like the paintable fire truck that was at the festival for the Relay for Life event • Agreed the celebration should not be moved to the beach 11.4 Vice-Mayor Jones • The Arts& Seafood Celebration was great; he would love to see it at the beach one day • The eminent domain bill is dead for this year; he asked the City Manager to file for the coming year • Chief Granville and CRA Director Earle will meet to come up with crime deterrents within the City,possibly using CRA dollars to purchase a camera or video system • Clean-up efforts should be citywide; cash for trash or some other program needs to be put in place • He has asked for no-littering signs throughout the City of Dania Beach, followed up with enforcement 11.5 Mayor Duke • Attended Debbie Wasserman Schultz's roundtable on coastal erosion; his takeaway from the meeting is that not much has changed • The Arts and Seafood Celebration was done in a nice small-town way • He represented Dania Beach at the County Commission today during the Year of the Neighbor program • Thanked the community for attending Commission meetings 12. Appointments Broward Leajzue of Cities Director—Albert Jones Alternate—Bobbie Grace Vice-Mayor Jones motioned to approve the appointments; seconded by Commissioner Grace. The motion carried unanimously. 13. Administrative Reports 13.1 City Manager City Manager Baldwin commented about a recent meeting with Sheriff Israel and noted the Sheriff would not be willing to let another city dispatch BSO personnel. Additionally, the Sheriff gave assurances they are doing everything they can to control costs in order to help us on our police and fire contracts.
