HomeMy WebLinkAboutR-2010-069 Walgreens Alcohol Variance-DENIED RESOLUTION NO. 2010-069—DENIED 5/25/2010 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,APPROVING THE VARIANCE REQUEST SUBMITTED BY WALGREENS COMPANY FROM CHAPTER 28, "ZONING",ARTICLE 4.201, "PROXIMITY OF BEVERAGE ESTABLISHMENTS TO CHURCHES, SCHOOLS",FOR PROPERTY LOCATED AT 501 EAST SHERIDAN STREET IN DANIA BEACH,PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 4.201, "Proximity of Beverage Establishments to Churches, Schools", prescribes the separation requirements for the sale of alcohol for businesses located within the City of Dania Beach; and WHEREAS,Walgreens Company is requesting a variance(VA-14-10)to allow the sale of alcohol less than 1,000 feet from a school for property located at 501 East Sheridan Street(The City Code of Ordinances Chapter 28,"Zoning",Article 4.201),"Proximity of beverage establishments to churches, schools", requires a 1,000 foot distance separation), for property located at 501 East Sheridan Street in the City of Dania Beach; and WHEREAS,the Planning&Zoning Board on April 21,2010,recommended approval of the variance request, based upon the criteria set forth in Section 10.13 of Article 10, of Chapter 28, "Zoning", of the Code of Ordinances; NOW, THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That that certain application referenced as VA-14-10 from requirements in Chapter 28,"Zoning",Article 4.201,"Proximity of beverage establishments to churches,schools"of the City Code of Ordinances is approved. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3. That this Resolution shall be in force and take effect immediately upon its passage and adoption. DENIED on May 25, 2010. C. K.
