A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH,FLORIDA,APPROVING THE REQUEST BY CHARLES GUSMANO,
PRESIDENT OF BCA HOLDING CORPORATION, A FLORIDA
CORPORATION, AND GENERAL PARTNER OF SOUTHERN WASTE
SYSTEMS LTD.,A FLORIDA LIMITED PARTNERSHIP,FOR APPROVAL OF
A MODIFICATION OF RESTRICTIVE COVENANT FOR PROPERTY
LOCATED AT THE 3200 BLOCK OF SOUTHWEST 26TH TERRACE, DANIA
BEACH, FLORIDA. PROVIDING FOR CONFLICTS; FURTHER, PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, on January 28,2002,a restrictive covenant("Covenant")was entered into by
the City of Dania Beach,Florida,and Southern Waste Systems LTD, a Florida Limited Partnership
("the owner"), for property located at the 3200 block of Southwest 26th Terrace, Dania Beach,
Florida("the site")and recorded as Instrument#101649474,in Official Records Book 32697 at Page
0850 on January 29, 2002, in Broward County, Florida; and
WHEREAS,the Construction and Demolition Debris Recycling Facility("Facility")located
at the site continues to be improved and operated in accordance with the terms and conditions of the
approved development approval and Covenant; and
WHEREAS,the owner has applied to the City for permits to construct a storage building on
the site that will be used solely for the storage of vehicles and equipment related to the operation of
the facility;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the proper City officials are authorized to execute the"Modification of
Restrictive Covenant" relating to modification of paragraph 8 of the restrictive covenant, in
substantial form, attached as Exhibit"A".
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
