A RESOLUTION OF THE CITY OF DANIA BEACH,FLORIDA,APPROVING
THE VARIANCE REQUEST SUBMITTED BY KEVIN HERRING, FROM
CHAPTER 28,"ZONING",FOR PROPERTY GENERALLY LOCATED NORTH
OF STIRLING ROAD ON SW 5TH COURT (LOT 8, BLOCK 1, PARADISE
MANOR), IN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS;
FURTHER,PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 4,
"District Regulations" and Article 5 "Supplementary Lot Regulations" set the lot, yard and bulk
regulations for the City of Dania Beach; and
WHEREAS,Kevin Herring,has applied for a variance(VA-11-06)to allow the following:
1. Minimum lot size required= 10,000 s.f. and 3,280 s.f is to be provided
2. Minimum lot width required=75' and 40' is to be provided
3. Minimum lot depth required= 100' and 82' is to be provided
4. Minimum front setback required=25' and 19' is to be provided
5. Minimum side setback required= 10' and 5' is to be provided
6. Minimum rear setback required= 15' and 10' is to be provided
7. Maximum building coverage=35%or 1,148s.f.and 43%coverage or 1,410 s.f.is being
provided
8. Minimum pervious area require=40% and 37% is to be provided
9. Assignment of 1 residential Flex unit
for property generally located north of Stirling Road on SW 5th Court (Lot 8, Block 1 of Paradise
Manor Subdivision), Dania Beach; and
WHEREAS,the Planning&Zoning Board on March 15,2006,recommended that the City
Commission grant variance requests or VA-11-06,based upon the criteria set forth in section 10.13
of Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH,FLORIDA:
Section 1. That that certain application VA-11-06, for the variances described above from
