HomeMy WebLinkAboutO-2010-003 Amending Article II Chapter 6 - DENIED ORDINANCE NO. 2010-003—DENIED ON FIRST READING AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING ARTICLE II, "BEACH PARKING" OF CHAPTER 6 OF THE CITY CODE OF ORDINANCES (ENTITLED "BEACHES, PARKS AND RECREATION") TO CREATE CODE SECTION 6-33.2 TO PROHIBIT THE PARKING OF VEHICLES WITHIN THE BEACH PARKING LOT WHICH TRANSPORT MOTORIZED PARAGLIDING AND SIMILAR EQUIPMENT, AND ESTABLISHING A CORRESPONDING FINE; FURTHER, CREATING CODE SECTION 6-17.1, TO BE ENTITLED "MOTORIZED PARAGLIDING AND SIMILAR ACTIVITIES PROHIBITED"; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED, BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That Article II, "Beach Parking" of Chapter 6 of the City Code of Ordinances entitled"Beaches, Parks and Recreation" is amended to create Section 6-33.2 to read as follows: Section 6-33.2. Parking of vehicles with motorized paragliding and similar equipment— Prohibited; No person shall park any vehicle of any kind within the City beach parking lot, which contains or is used to transport motorized paragliding, parasailing, hang-gliding, power-gliding, kite-boarding, or similar motorized devices or equipment. Any vehicle found in violation of this section shall be liable for a fine of Thirty-Five Dollars ($35.00). Section 2. That Article I, "In General" of Chapter 6 is amended to create Section 6-17.1 to read as follows: Section 6-17.1. Paragliding and Similar Activities-Prohibited. No person shall be permitted to use, operate or launch from any portion of the City beach while equipped with motorized paragliding, parasailing, hang-gliding, power-gliding, kite- boarding, or any similar motorized device or equipment, nor to return to or land upon any portion of the beach,while in possession of such device or equipment. Section 3. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict with this Ordinance are repealed to the extent of such conflict. Section 4. That if any section, clause, sentence or phrase of this Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance. Section 5. That this Ordinance shall be effective on adoption on second reading. DENIED on first reading on February 9, 2010. PASSED AND ADOPTED on second reading on , 2010.
