HomeMy WebLinkAboutR-2013-053 Approved Request by Gilles Grenier for Skyland Plaza, LLC for Extensions to Variance (VA-08-12) and Site Plan for Property located at 118 N Federal Highway RESOLUTION NO. 2013-053 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUEST MADE BY GILLES GRENIER, ON BEHALF OF SKYLAND PLAZA, LLC, FOR EXTENSIONS TO THE VARIANCE (VA-08-12) APPROVED BY RESOLUTION NO. 2012-034 AND SITE PLAN WITH ASSOCIATED DESIGN VARIATION (SP-40-11) APPROVED BY RESOLUTION NO. 2012-035 ON MARCH 27, 2012, FOR PROPERTY LOCATED AT 118 NORTH FEDERAL HIGHWAY IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,Part 6,"Development Review Procedures and Requirements,"Article 635 of the City of Dania Beach,Florida Land Development Code("Code")states that the City Commission may grant a site plan extension if the applicant can demonstrate good cause for the delay; and WHEREAS,on March 27, 2012,the City Commission approved a variance request (VA- 08-12)to not require a landscape island in a row of parking,where otherwise required by Chapter 28, Section 275-100(C)(1), by Resolution Number 2012-034,which expired on March 26, 2013; and WHEREAS,on March 27,2012,the City Commission approved a request for a site plan and associated design variation (SP-40-11) to allow for the construction of two (2) buildings totaling approximately 11,000 square feet of commercial space and eight (8)residential units for property located at 118 N.Federal Highway,by Resolution Number 2012-035,which also expired on March 26, 2013; and WHEREAS,Gilles Grenier,on behalf of Skyland Plaza,LLC,is requesting an extension of the variance, site plan and associated design variation for six(6)months,until September 26,2013; NOW,THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the request to extend the expiration date for the approvals of the variance (VA-08-12), site plan and associated design variation (SP-40-11) until September 26, 2013, is approved. Section 2. That such approval is also subject to the conditions previously approved by the City Commission. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4.
