Call to Order/Roll Call Mayor Duke called the meeting to order at 7:00 p.m. Present: Mayor: Walter B. Duke, III Vice-Mayor: Albert C. Jones Commissioners: Chickie Brandimarte Patricia A. Invocation and Pledge of Allegiance Commissioner Grace gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Special Event request from Neptune Fireworks for a "Fireworks Sale" to be held at 768 East Dania Beach Boulevard, from 9:00 a.m. — 9:00 p.m. on June 6 — July 12, 2013 Commissioner Grace motioned to approve the Special Event request for Neptune Fireworks; seconded by Vice-Mayor Jones. The motion carried on the following 5-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Jones Yes Commissioner Flury Yes Mayor Duke Yes Commissioner Grace Yes 3.2 Special Event request from Divers Cove for a "Pier Clean-up" to be held under the Dania Beach Pier on June 30, 2013 from 9:00 a.m. — 12:00 p.m. Commissioner Grace motioned to approve the Special Event request for Divers Cove; seconded by Vice-Mayor Jones. Parker Community Center fee waiver of $600.00 for Collins Elementary School Awards Banquet on May 23, 2013 Commissioner Grace motioned to approve the I.T. Parker Community Center fee waiver for the Collins Elementary School Awards Banquet; seconded by Vice-Mayor Jones. Parker Community Center fee waiver of$1,400.00 for the Dania Beach Chamber of Commerce Fishing Tournament to be held on June 28-30, 2013 Mark Felicetty, Director of Parks and Recreation, noted the Chamber of Commerce has requested a waiver of all fees, which was approved by the Parks, Recreation and Community Affairs Advisory Board. Commissioner Flury thought the Chamber should pay for the cleanup. Vice-Mayor Jones motioned to approve the I.T. Parker Community Center fee waiver for the Dania Beach Chamber of Commerce Fishing Tournament; seconded by Commissioner Grace. Proclamations 4.1 Just Drive Month Vice-Mayor Jones presented the proclamation to Ronnie Medina of Big Brothers Big Sisters of Broward County, Leadership Broward Foundation Inc., and Leadership Broward Class XXXI. Commissioner Grace requested that Mr. Medina provide the City with stickers and information materials. 4.2 National Public Works Week Mayor Duke presented the proclamation to Dominic Orlando, Director of Public Services. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,May 14,2013—7:00 p.m. 4.3 Water Reuse Week Mayor Duke noted the proclamation would be forwarded to the South Florida Water Management District. 5. Citizen Comments Rae Sandler, 1433 Argonaut Isle, criticized the Mayor and his wife for Facebook and Twitter attacks on a citizen relating to: the airport expansion issue, exaggeration of a demonstration of voter fraud and stalking, as well as for condoning stalking by Patrick Phipps of Commissioner Flury and the resulting intimidation of the citizenry. Teddy Bohanan, SW 14t' Street, commended Code Compliance for enforcement in her neighborhood. Lincoln Pasteur, 1520 NE 4th Place, Ft. Lauderdale, Principal of Collins Elementary, and Gayle Doyle, Special Needs Teacher, requested the City heat the pool at CW Thomas Park in order to avoid busing the children to PJ Meli pool. Additionally, they would like the Swim Central program extended to the whole school, as opposed to only pre-K students; if this is done, the students could simply walk across the street to the pool. Ann Page, 38 SW 5t` Street, President, Friends of the Library, noted she has copies of the interview with Mac McElyea for $10.00, which will benefit the Friends of the Library. She added that the library's external speakers should be installed within the next ten days. 6. Public Safety Reports Captain Kevin Granville, BSO Chief of Police, warned of scams and fraud against the elderly happening in Broward County. Vice-Mayor Jones questioned bringing back the Are You Okay program for seniors. Chief Granville responded he will look into it. Commissioner Flury asked Chief Granville to address the crime in the SE section. He responded an operational plan is currently in place and reiterated the importance of residents reporting suspicious activity. 7. Bids and Requests for Proposals There were no proposals on this agenda. 9. Public Hearings and Site Plans 9.1 RESOLUTION#2013-053 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUEST MADE BY GILLES GRENIER, ON BEHALF OF SKYLAND PLAZA, LLC, FOR EXTENSIONS TO THE VARIANCE (VA-08-12) APPROVED BY RESOLUTION NO. 2012-034 AND SITE PLAN WITH ASSOCIATED DESIGN VARIATION (SP-40-11) APPROVED BY RESOLUTION NO. 2012-035 ON MARCH 27,2012, FOR PROPERTY LOCATED AT 118 NORTH FEDERAL HIGHWAY IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2013-053. He advised this item was a quasi- judicial hearing and swore-in those who would speak. He asked the Commission to disclose any communication they had on this matter. Corinne Lajoie, Principal City Planner, provided an overview of the Dairy Belle proposal. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,May 14,2013—7:00 p.m. Mayor Duke opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearing. Commissioner Grace motioned to adopt Resolution #2013-053; seconded by Vice-Mayor Jones. The motion carried on the following 5-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Jones Yes Commissioner Flury Yes Mayor Duke Yes Commissioner Grace Yes 10. Discussion and Possible Action 10.1 C.W. Thomas Pool Heating—Vice-Mayor Albert C. Jones Vice-Mayor Jones recapped previous discussions regarding this item, and requested that the Commission approve the purchase and installation of a pool heater in an amount of$15,000.00 during this fiscal year. How the pool will be used and staffed can be discussed during an upcoming budget workshop. Commissioner Flury motioned to purchase the pool heater for C.W. Thomas Park; seconded by Commissioner Grace. Mayor Duke noted he would like to discuss the following items during the budget workshop: covering the playgrounds and skate park; installation of turf at CW Thomas Park; and money for staffing the SW Community Center. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte had no comments. 11.2 Commissioner Flury Commissioner Flury addressed some of the issues regarding the airport expansion, including the two legal cases that are still pending, the awaiting of a ruling on the case against the Army Corps of Engineers, and the pending case against the County regarding the 1995 interlocal agreement. She spoke of the ongoing desire to mitigate the impacts to Dania Beach; last year's agreement Minutes of Regular Meeting Dania Beach City Commission Tuesday,May 14,2013—7:00 p.m. with the County, which the FAA opposed; and the voluntary covenants and release program. At this point, everyone has agreed to sit down and talk on June 6 to determine if there is a mutual interest to go forward with more serious talks. If the County agrees to give what is felt to be fair to the residents and to the City, something would be put together for the Commission to discuss and to share with the residents. She noted there are no secret issues or agendas and we will have to wait to see what happens. Commissioner Flury asked the Mayor to respect his colleagues and the positions they hold. She addressed comments that are posted on his Facebook and Twitter accounts, and questioned why he would allow her stalker to post to his account. She asked him to stop using her as the centerpiece of his Twitter trash. 11.3 Commissioner Grace Commissioner Grace had no comments, but asked Alma Wright to come to the podium and speak about a program at CW Thomas. Ms. Wright, 117 SW 5d' Court,noted the girls in her program will graduate May 23`d, and invited the Commissioners to attend and support them. 11.4 Vice-Mayor Jones Vice-Mayor Jones thanked the CRA and Public Services for removing and replacing the dead Cabbage Palms at CW Thomas Park; however, there is still a dead tree across from Commissioner Grace's house. Vice-Mayor Jones noted the solar lighting policy is in place, but the flaw lies in the implementation insofar as the City Manager is not in the mix, as he should be. Future lighting projects will go to him first and then to the Commission. Vice-Mayor Jones commented on a meeting of the Coastal Ocean Task Force where beach renourishment was discussed, noting there is a policy flaw with the Army Corps of Engineers and how money is being appropriated. He described a policy initiative underway to deal with this issue that involves projects that would allow for partnership agreements. Vice-Mayor Jones spoke about a consortium of Education Advisory Boards he attended, noting they want a resolution dealing with high stake testing, to be possibly adopted by cities. Additionally, 2012/2013 grades 5 and 8 students will be required to re-register for the 2013/2014 school year and provide documentation verifying their address. Vice-Mayor Jones commented that he attended a town hall meeting at Mt. Zion AME Church, where Superintendent of Schools Runcie was present, and they want to know what is happening with Collins Elementary with respect to it possibly being closed. Superintendent Runcie told the group that there have been no such decisions made regarding Collins or Attucks Middle School. Vice-Mayor Jones noted the Education Advisory Board will start meeting in June. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,May 14,2013—7:00 p.m. 11.5 Mayor Duke Mayor Duke noted he supports social media; however, he does not recall any of the comments mentioned tonight. His wife, as a bona fide resident and concerned citizen, has a right to make any comments she wants. Mayor Duke said in regard to the residency of Commissioner Flury, he had asked the City Attorney for an opinion and he opined that Commissioner Flury met the requirements of the Charter. According to the Charter, the Commission has the final say on the issue, but he feels they should focus on handling their business and let an outside source handle any resident's issues with Commissioner Flury's residency. If there are still concerns, the matter should be taken to the Inspector General. 12. Lauderdale Airport litigation on Tuesday, May 28, 2013 at 5:00 p.m. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,May 14,2013—7:00 p.m. City Attorney Ansbro noted Jai Alai is set to close on their partnership deal on May 22. The existing development agreement may change; if so, it will come before the Commission.
