DANIA BEACH CITY COMMISSION
TUESDAY, MAY 28, 2013 - 7:00 P.M.
1. Call to Order/Roll Call
Mayor Duke called the meeting to order at 7:00 p.m.
Present:

2. Invocation and Pledge of Allegiance
Vice-Mayor Jones gave the invocation followed by the Pledge of Allegiance to the United States
Flag.
3. Presentations and Special Event Approvals
3.1 Broward County Sheriff Scott Israel
Broward County Sheriff Scott Israel presented an overview of his first 120 days in office. He
noted he will be meeting with City officials tomorrow to discuss Dania Beach's contract and, as
with all BSO contracts with the various cities, the goal is to ensure it is revenue neutral and fair
to everyone involved.
Commissioner Grace would like some type of program to help children in Dania Beach, such as
a Boys or Girls Club, to be funded with items confiscated in the City. She felt there should also
be additional programs to protect seniors.
Sheriff Israel responded there was only $131,000.00 in LETF Funds when he came into office;
time is needed to recoup funds, which will be spent on the type of projects suggested.
Commissioner Brandimarte asked for the Sheriff's continued support of the COP program.
Vice-Mayor Jones commented he would like a program to benefit juvenile delinquents that
would work in unison with the COP program. Additionally, he would like to utilize the
JAG/Byrne Grants in furtherance of providing safe pathways for our children to walk to school.
Commissioner Flury expressed appreciation for Sheriff Israel's commitment to work with us.
Mayor Duke said the feedback from the communities regarding law enforcement has been

extremely positive.
3.2 Recognition of Dania Elementary Teachers, Staff, Students and Volunteers — Lowe's
Landscaping Grant—Mayor Duke
Mayor Duke presented a Certificate of Recognition to Dania Elementary Staff and Volunteers
for their efforts in obtaining a $2,500.00 Lowe's Landscaping Grant, which was used to re-
landscape the front of the school.
Mayor Duke asked the new owners of Dania Jai Alai to come forward and introduce themselves.
Louis Birdman, Dania Entertainment Holdings, and Federico, representing the Casino Club in
Argentina, partners in Dania Entertainment Center, noted they are going to move forward with
renovations as soon as possible. This is the first project in Florida and they anticipate hiring 600-
700 people for the operation.
3.3 Special Presentations by Commissioner Bobbie Grace
Commissioner Grace recognized the supporters and sponsors of the Dania Beach Relay for Life,
including the City Commission; Deputy Vic Thompson; Jeffrey, student volunteer for City
cleanup; the Dania Beach Lions Club; and the contributors/sponsors of the Dania Beach Bears,
the volunteer cleanup effort, and the summer program at CW Thomas Park.
3.6 Certificate of Appreciation to Marine Industries Association of South Florida
(MIASF) for the 2013 Plywood Regatta—Mayor Duke
Mayor Duke presented a Certificate of Appreciation to the Marine Industries Association of
South Florida (MIASF) for organizing the 17t' Annual Plywood Regatta, and for their
continuous support of scholarship programs that encourage marine education and the
development of students' interest in the marine industry.
3.4 Grant Advisory Board Workshop, June 8, 2013, 9:30 a.m. — 12:00 p.m. — David
Clark, Chairman
David Clark, Chairman of the Grant Advisory Board, announced that the Board would host a
Workshop on Saturday, June 8, 2013 at 9:30 a.m., on the requirements of establishing a 501(c)3
organization. FAU Professor Dr. Ronald Nyhan will be the guest speaker, and the workshop is
open to the public.

3.5 Special Event request from Fireworks Lady & Co., LLC for a "0' of July State
Approved Sparkler Sale", to be held at 1901 South Federal Highway, on June 26 -
July 4, 2013
Neil Robertson, Partner at Daniels Kashtan Attorneys, 4000 Ponce De Leon Boulevard, Coral
Gables, Florida, appeared on behalf of the applicant and commented as follows: the bulk of
people shop on the 4th of July; his client sells sparklers, not fireworks; they expect 10-15 cars per
day; they have agreed to all of the conditions requested by the City except for the hours of
operation, police services, and the 50-foot setback; they would like to remain open until 9:00
p.m. on four days, which will require lighting for only the last half hour of operation; the noise
concerns are unjustified as there will be no music, loudspeakers, or product demonstration; the
50' buffer requirement is not compatible with their reconfiguration of the site plan that switches
the entrance to the north side and the exit to the south side, which will prevent traffic backups;
they do not need police because there are no traffic issues; Dania Beach is the only city that has
requested police Xresence; since this is the first time operating here, they are agreeable to having
police on the 4 of July and they plan to have a parking attendant on this day. Attorney
Robertson asked to continue the permit for future years if this request is approved tonight.
City Attorney Ansbro noted this is the first such request that has come before the Commission,
and therefore was given a lot of scrutiny and conditions by staff. After working with all parties
involved, a fair compromise on how to proceed has been reached and he is confident this event
can be done without causing problems to the community. He felt perhaps the BSO detail may
not be required as often as requested by staff and noted the Commission cannot provide future
approvals to the applicant.
Lesley Hamilton, 27 SE 13th Street, spoke in opposition to the sale of fireworks on this site,
noting the residents feel it is not safe for their community. The subject property is adjacent to
their homes, there are three gas stations in the neighborhood, and there will be an increase in
traffic. She remarked there is already enough at the intersection for drivers to deal with and
requested the Commission decline the request.
Mayor Duke noted the petition received from the residents contains 18 signatures,which he gave
to the City Clerk to include with the minutes of this meeting.
Commissioner Grace felt the hours should be limited to 7:00 p.m. and an officer should check on
the premises every day. She added the City tries to protect the residents, but also wants to attract
good businesses.
Commissioner Brandimarte questioned Chief Granville's sanction of police presence on only
July 4th.
Chief Granville noted, due to his concern for the traffic issues and the impact on the
neighborhood, he recommended two deputy detail officers to be on duty every day from 4:00
p.m. to closing, except for July 4th and the weekend preceding, which would be from opening to
closing.

Commissioner Flury commented she had many concerns and there were several inconsistencies
in what was presented. Her main concern is the traffic in the neighborhoods and she is going to
vote no on everything,whether it is the individual components or the overall request.
Vice-Mayor Jones felt there are many unknowns relative to traffic issues and potential problems
associated with this event. He noted he does not want to be told how to do something in his City,
particularly when the Commission is trying to ensure the residents' safety, and out of
cautiousness, he will not vote for this.
Attorney Robertson noted this is entirely different from Neptune Fireworks and because this is
the first time for such a request in Dania Beach, they wanted to present what other cities have
allowed.
City Attorney Ansbro stated he is comfortable that the applicant has met the requirements
requested and staff supports the request.
Commissioner Grace motioned to approve the Special Event request with the conditions of
a 7:00 p.m. closing time and two police details every day; seconded by Vice-Mayor Jones.

4. Proclamations
4.1 Not 1 Forgotten Men's Cancer Awareness Month — Requested by the Broward
League of Cities
Vice-Mayor Jones read the proclamation for Men's Cancer Awareness Month.
5. Citizen Comments
Patricia Tyra, Estates of Ft. Lauderdale, 2850 SW 54ffi Street, addressed issues of. solar lights
not working; continued flooding on West Marina Drive and Harbor Lane; the damaged building
on the beach and fences needing repair; funding needed from the County, State, and Federal
governments to help with beach re-nourishment; and the need to get the bus bench signs up so
that monies from the ads goes to non-profits, as is the policy.
Vice-Mayor Jones addressed the issue of beach re-nourishment funding.
Commissioner Flury noted that several years ago, the Commission dropped the policy of putting
aside the bus bench money for non-profits and instead allocated a certain amount for that
purpose; she will bring the matter up during budget discussions.

Mayor Duke spoke of beach re-nourishment and improvements.
Fay and Bob Bartelmes, 214 SW 2"d Terrace, members of the COP Program, commented about
there being no sidewalk along Old Griffin Road from the Sheraton Hotel to US-1 and requested
consideration be given to constructing one.
Carolyn Jones, 722 SW 3`d Street, addressed the beautification of Dania Beach and noted she is
concerned with using minors on Sunday to help clean up the City. Additionally, there were
minors attending the last three City Commission meetings and she felt they should have been
studying for the FCAT.
Pat Wright, 4391 SW 34 Lane, addressed previous discussion regarding drinking on Dania
Beach. She questioned the legal ramifications to the City if someone gets hurt by someone
drinking on the beach and said whatever can be done to minimize this problem needs to be done.
Clive Taylor, 642 NE 3`d Street, noted the U.S. Power Squadron will be providing a basic boater
training course in Dania Beach for eight hours at Frost Park on Saturday.
6. Public Safety Reports
Captain Kevin Granville, BSO Chief of Police, highlighted the work being done by the selective
enforcement team on vice, narcotics, and burglary-type operations complaints.
Mayor Duke asked Chief Granville to step up enforcement against public drinking on the beach.
In response to Vice-Mayor Jones, Chief Granville provided an update on some of the prostitution
issues on Federal Highway.
Bruce Caruso, Division Chief, BSO Fire Rescue, warned of the start of hurricane season on June
1st and reminded everyone that now is the time to prepare. The Comprehensive Emergency
Management Plan(CEMP)will be presented at the next Commission meeting.

Commissioner Brandimarte had no comments.
11.2 Commissioner Flury

Dania Beach City Commission
Tuesday,May 28,2013—7:00 p.m.
Commissioner Flury questioned an issue that had arisen with boat launching at Harbour Towne
and noted people cannot be charged for launching or parking.
Assistant City Manager Donnelly responded that the Broward County Boating Improvement
Program does not want to see a launch charge there, although one somehow crept in. Westrec
was spoken to about this and the contract will be reviewed to see if there is provision for parking
fees.
Commissioner Flury addressed the City travel policy, noting staff does not go to Palm Beach
County because they are not reimbursed for per diem or mileage. She felt the policy should be
changed to reflect no reimbursement for only Broward and Dade Counties retroactive to May 1.

The Commission concurred to change the policy retroactive to May 1, 2013.
11.3 Commissioner Grace
Commissioner Grace spoke of community events she recently attended.
11.4 Vice-Mayor Jones
Vice-Mayor Jones' comments included:
• The Education Advisory Board will have a kickoff meeting in June.
• He was the keynote speaker at Olsen Middle School matriculation event.
• Thanked staff for trash cans in his community
• Asked City Administration to have staff install flashers and warnings when there is going
to be flooding
• Asked about the status of adding College Gardens to the shuttle bus route
• He asked some time ago for a mast arm and light to be placed on Federal Highway near
1 P Street; the lighting needs to be done as soon as possible
• Staff is doing a great job
11.5 Mayor Duke
Mayor Duke commented he does not see an issue arising with kids assisting in the cleanup of
downtown since the number participating is minimal.
Mayor Duke noted he has not knowingly seen anyone drinking on the beach; if he did, he would
report it.
Mayor Duke commented that the economic recovery is underway and should mean an increase in
ad valorem revenues coming to the City next year, which is good news since the City is facing a
lot of expense and costs.

13. Administrative Reports
13.1 City Manager
City Manager Baldwin commented that the Oasis projects will be awarded at the next meeting.
City Manager Baldwin noted Jay Scott's showroom is closing and the company would like to
donate artificial plants valued at $11,859.00 to the City. The consensus of the Commission was
not to accept the donation.
City Manager Baldwin said the MLK committee is requesting the balance of funds budgeted by
the Commission for them (approximately $7,100.00) be used for administrative costs to set up a
501(c)3 organization and for donation for scholarships.
After a brief discussion, the consensus was to add this matter to the next agenda for Commission
discussion.
13.2 City Attorney
City Attorney Ansbro had no additional comments.

Commissioner Grace said Lauderdale Lakes would be having a controversial discussion item
tonight regarding residency of City Commissioners. She suggested we should look at our
Charter and have the City Attorney provide clarification of what it states to make sure we are on
target.

We the undersigned residents wish to object to the above proposal which we understand
is scheduled for the weeks preceding July 4`h, 2013. This land is in the middle of a
residential area with families and children nearby. We believe the proximity of three gas
stations(Shell, 711 and SUNOCO)makes for a potentially dangerous situation for our
families and our property.
In addition,we value the considerable time,effort and money that you,our
Commissioners,are now investing in the development and branding of Dania Beach; we
see real results. We believe that this particular kind of commercial activity so close to a
residential area does not fit with the image of our city.
That is why we request that you do not permit the land to be used for this purpose.
