HomeMy WebLinkAboutR-2013-057 Executed an Interlocal Agreement between the City of Hollywood and City of Dania Beach for Maintenance of Medians RESOLUTION NO. 2013-057 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF HOLLYWOOD AND THE CITY OF DANIA BEACH, FOR MAINTENANCE OF MEDIANS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the City of Hollywood generally maintains streetscapes, including medians, in various areas that are in Hollywood's jurisdiction and may be adjacent to the City of Dania Beach; and WHEREAS, the City of Dania Beach generally maintains all streetscapes, including medians throughout its City; and WHEREAS, both municipalities also have FDOT maintenance agreements which require each City to maintain various streetscapes and medians under their agreements with the FDOT; and WHEREAS, the Cities of Hollywood and Dania Beach have been reviewing their maintenance responsibilities for the maintenance of medians within both cities and have determined that certain medians are not contiguous to the jurisdiction of either City which creates overlaps and sometimes interruptions of median maintenance services due to the locations of the center medians; and WHEREAS, the Public Services Director has determined that it is ineffective for both cities to provide maintenance of medians and responsibilities should be simplified in order to ensure that maintenance is provided in a consistent manner; and WHEREAS, the Public Services Director has negotiated an agreement for the City of Dania Beach to assume all responsibilities and liabilities for the landscaping maintenance for the medians from Gulfstream and Dania Beach Boulevard east, to include the circle and two triangle medians as depicted on the map attached as Exhibit"A"; and WHEREAS, the agreement also provides that the City of Hollywood shall assume all responsibilities and liabilities for the landscaping maintenance for the six (6) medians on Griffin Road from State Road 7 to SW 35 Avenue, also depicted on the map attached as Exhibit"A"; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. That the proper City officials are authorized to execute an Interlocal Agreement with the City of Hollywood for landscape maintenance of medians as referenced on the attached Exhibit "A", which is made a part of and incorporated into this Resolution by this reference. Section 3. That the City of Dania Beach will not incur and shall not pay any increased, additional costs or maintenance impact fees related to the requirements of the Interlocal Agreement for the maintenance of such medians, since the purpose and intent of the Agreement is to more effectively define areas of maintenance between the cities. Section 4. That all resolutions or parts of resolutions in conflict with this Resolution shall be repealed to the extent of such conflict. Section 5.
