Call to Order/Roll Call Mayor Duke called the meeting to order at 7:00 p.m. Present: Mayor: Walter B. Duke, III Vice-Mayor: Albert C. Jones Commissioners: Chickie Brandimarte Patricia A. Invocation and Pledge of Allegiance Commissioner Grace gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Legislative Report—Senator Eleanor Sobel Senator Eleanor Sobel provided an update of the recent legislative session, which included the issues of eminent domain, gaming, healthcare and the Affordable Health Care Act, and election reform. 3.2 Broward Boating Improvement Program check presentation for the Marina Renovation, Phase I Project Broward Marine Advisory Committee Chairman Dan Yaffe, Dania Beach business owner and resident Chris Barile, and Dania Beach Marine Advisory Chairman Clive Taylor presented the City Commission with a check for$94,807.28 for the Dania Beach Marina Renovation Project. 3.3 Recognition of Barbara Clark, Parks and Recreation Assistant, for 18 years of dedicated service Mark Felicetty, Director of Parks and Recreation, presented a Certificate of Appreciation to Barbara Clark for her 18 years of loyal and dedicated support to our youth and community. 3.4 2013 Comprehensive Emergency Management Plan (CEMP)/Hurricane Annex - Battalion Chief Sean Brown, BSO Fire Marshall's Office Battalion Chief Sean Brown, BSO Fire Marshall's Office, provided an overview of the 2013 Comprehensive Emergency Management Plan PowerPoint presentation that was included in the agenda packet. Vice Mayor Jones motioned to approve the 2013 Comprehensive Emergency Management Plan (CEMP)/Hurricane Annex; seconded by Commissioner Grace. Parker Community Center fee waiver of$600.00 for The Elite Social Group to have a fundraiser for back to school supplies, backpacks and haircuts, to be held on August 10, 2013, from 5:00 p.m. - 11:00 p.m. Commissioner Flury motioned to approve the I. T. Parker Community Center fee waiver for The Elite Social Group; seconded by Vice-Mayor Jones. A special event fee waiver is requested, as well as BSO Police to escort the Parade. Commissioner Flury motioned to approve the Special Event request for the Attucks All School Reunion, including fee waivers and BSO Police escort; seconded by Vice-Mayor Jones. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Teddy Bohanan, 312 SW 15t' Street, commented about the southwest area and noted Sheridan Street is on the decline again. She felt everything is allowed in the southwest and it is time to stop it for the sake of the children. 6. Public Safety Reports Captain Kevin Granville, BSO Chief of Police, addressed recent burglaries in Dania Beach and noted there will be noticeable police activity coming soon that should help decrease crime on Federal Highway. 7. City Attorney Ansbro read the title of Resolution#2013-060. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,June 11,2013—7:00 p.m. Vice-Mayor Jones commented that the Solar Light Policy would be followed and the Commission would make the decisions on placement of solar lights in any given community. Vice-Mayor Jones motioned to adopt Resolution #2013-060; seconded by Commissioner Flury. The motion carried on the following 5-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Jones Yes Commissioner Flury Yes Mayor Duke Yes Commissioner Grace Yes Ordinances (Titles read by City Attorney) 7.9 ORDINANCE#2013-002 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING CHAPTER 18, ARTICLE III, ENTITLED "EMPLOYEES' RETIREMENT PLAN AND TRUST" BY SPECIFICALLY AMENDING §18-1 TO MODIFY THE CONDITIONS FOR A RETIREE'S PARTICIPATION IN CITY'S GROUP INSURANCE PLAN; AMENDING §18-29.7 TO PHASE OUT THE DEFERRED RETIREMENT OPTION PLAN (DROP); PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING) Commissioner Grace asked for assurance that this ordinance conforms to what was put in place from the final discussion with the Union. Assistant City Manager Donnelly explained the ordinance would enact two items, both of which are in the collective bargaining agreement, concerning new retirees entering DROP being required to pay 100% for health insurance once they reach Medicare eligibility and employees who have not yet entered DROP upon adoption of this ordinance or September 301h, whichever is later,will no longer be able to do so. Commissioner Grace questioned the number of long-term employees and whether they could be excluded or put into DROP before the cutoff date. Assistant City Manager Donnelly responded there are approximately 20 active employees in the pension system who have not entered DROP and seven who are not in the Union. He noted amendment of this ordinance would be up to the City Commission. Terry Peterson, 4632 SW 37 Avenue, asked the Commission to not approve eliminating DROP for current employees in the General Employees Retirement Plan. Commissioner Flury asked for clarification whether or not the Commission already voted on the DROP. Assistant City Manager Donnelly confirmed the Commission voted to approve phasing it out and there is an executed labor contract in place. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,June 11,2013—7:00 p.m. David S. Casasanta, 2010 N 52nd Avenue, President of Local 3535, requested the Commission vote against eliminating DROP due to the impact on younger employees who have already served 15-25 years. Tammie James, 255 NW Tamara James Avenue, commented that the Commission should be mindful of the impact to the employees involved and their families. Louis Brown, 1304 NW 2nd Street, remarked he is a 26-year employee and it is not fair to eliminate the DROP for those who do not have the required time or age; the Commission should consider something different for them. Julie Klahr, attorney with Goren, Cherof, Doody & Ezrol, representing the City, clarified that this ordinance simply codifies into the pension plan what has already been ratified by the Union via the Collective Bargaining Agreement. Commissioner Brandimarte questioned why this would be subject to change if it has already been voted on by the Commission and ratified by the employees. Vice-Mayor Jones asked for clarification of the criteria for going into the DROP. Attorney Klahr responded an employee has to be qualified to retire; that is, has attained a certain number of years of service or reached a certain age. Responding to Vice-Mayor Jones, Assistant City Manager Donnelly explained the fiscal consequences to the City from DROP and why it was felt necessary to eliminate the program during the collective bargaining process. Vice-Mayor Jones reiterated there are criteria to be met to go into DROP and an employee cannot participate if the requirements have not been met. Elimination of the program was negotiated and agreed upon; the issue cannot be resurrected. Mayor Duke commented both sides did agree to this; however, it has come to his attention there is a handful of employees who will have just missed the DROP and it is not unreasonable to take a look at the possibility of altering the agreement even though it was ratified. Commissioner Flury motioned to adopt Ordinance #2013-002, on first reading; seconded by Vice-Mayor Jones. Bids and Requests for Proposals 8.1 RESOLUTION#2013-056 Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,June 11,2013—7:00 p.m. A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, RELATING TO AN AWARD OF A BID TO CLOSE CONSTRUCTION LLC,IN THE AMOUNT OF$857,830.00 FOR LIME SOFTENING PLANT REHABILITATION FOR THE REPAIR OF TWO(2)ACCELATORS UNDER CITY BID NO. 13-002; PROVIDING FOR ADDITIONAL BUDGET FUNDS' APPROPRIATION; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2013-056. Dominic Orlando, Public Services Director, explained the prior bid process that had occurred and noted this project is one of several components that were put out to bid separately in order to save money. In response to Vice-Mayor Jones, Public Services Director Orlando addressed the financing arrangements utilizing the SRF loan and sewer funds. Vice-Mayor Jones motioned to adopt Resolution #2013-056; seconded by Commissioner Flury. IN THE AMOUNT OF $199,792.00; PROVIDING ASSURANCES; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2013-062. Dominic Orlando, Public Services Director, noted the low bid on this project was approximately $30,000.00 higher than the budget amount; therefore, staff is proposing to award the budget amount, reduce the allowance amount, and delete the optional trees, bushes, and sod, which would instead be done in-house. Commissioner Flury commented these are great projects, and felt the difference of approximately $30,000.00 between the budget amount and the low bid amount should be taken out of contingency funds in order to do the project right. Commissioner Flury motioned to adopt Resolution #2013-062 and to take approximately $30,000.00 out of contingency to award the low bid amount; seconded by Commissioner Grace. (FIRST READING) City Attorney Ansbro read the title of Ordinance#2013-004. Corinne Lajoie, Principal City Planner, gave a PowerPoint overview of the proposed text amendments. Commissioner Grace questioned allowing duplexes to be built without requiring site plan approval and a public hearing. Ms. Lajoie explained duplexes are considered lower scale and lower impact type of development. She noted with adoption of the new zoning code, the CRA Plan, and some of the CRA zoning districts, more intense development is allowed and encouraged. Mayor Duke asked about fees to build a duplex and the process that would replace site plan approval coming before the Commission. Ms. Lajoie responded site plan application fees are around $4,000.00 and explained what would occur at the staff level for site plan review. Commissioner Flury commented about the numerous studies done throughout the City and noted the conclusion is that the percentage of rentals versus home ownership is out of balance. The goal for a long time has been to try to reverse this balance. She felt it is a big mistake to encourage further development of duplexes and she would not be in favor of this provision in the Code. Commissioner Brandimarte said this change would take away people's opportunity to object and she cannot support it. Ms. Lajoie concluded the overview presentation. Mayor Duke opened the Public Hearing. Gordon Ditzel, 2000 Stirling Road, spoke in support of the proposed changes to the Code. Seeing as there was no one else to speak in favor or opposition, Mayor Duke closed the Public Hearing. Commissioner Grace noted she is happy with the proposed changes, but is not comfortable with the changes recommended for duplexes. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,June 11,2013—7:00 p.m. Vice-Mayor Jones motioned to adopt Ordinance #2013-004, on first reading, with the exception of allowing duplexes to be built without requiring site plan approval; seconded by Commissioner Grace. The motion carried on the following 5-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Jones Yes Commissioner Flury Yes Mayor Duke Yes Commissioner Grace Yes 10. Discussion and Possible Action 10.1 Martin Luther King Committee—Mayor Duke Mayor Duke provided a recap of this item and commented it is a well-intended idea and everyone supports education, but he is concerned about the fact that the funds being discussed are taxpayer monies, particularly since this is one of the toughest budget years coming up. Additionally, the Charitable Donation Board was established as the mechanism to process City funding of charitable activities. He felt the proper path is to return the $8,000.00 balance to the General Fund, budget an appropriate amount for next year's activities, and invite Vice-Mayor Jones and his wife to form a 501(c)3 with privately solicited funds or make application to the Charitable Donation Board. Vice-Mayor Jones clarified this request is not his; rather it is from the MLK Committee. Commissioner Brandimarte suggested the excess money go into a Carolyn Jones scholarship fund. Commissioner Flury commented the $15,000.00 was budgeted for the MLK Committee to spend on their festivities, so there was no need for that to go through the charitable committee. The MLK Committee likely held back somewhat this year so they could form a 501(c)3 corporation in order to proceed with obtaining charitable funding. Commissioner Grace spoke of the Grant Advisory Board workshop and noted no one from the MLK Committee attended. She felt we have to be accountable for taxpayer money being spent and approval of this request would lead to other organizations soliciting funding for scholarships. She suggested the committee first set up the 501(c)3, establish a board of directors, and do what is proper. Vice-Mayor Jones spoke of the Dania Activity Committee and the FAU Scholarship, and felt the MLK scholarship would be beneficial for our kids from now moving forward. He noted the 501(c)3 has been put in place and there might come a time that the MLK organization would not need to come to the City for funds. Carolyn Jones, MLK Committee, explained the request and the fact that they already have their 501(c)3 corporation in place. The next step is completing IRS forms and paying the associated Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,June 11,2013—7:00 p.m. fees. She added the corporation would like to name the scholarship the City of Dania Beach/MLK Scholarship. Mayor Duke questioned why the taxpayers are being asked to fund the formation of this foundation, reiterating there is already a process in place for this and it can be done without spending$2,000.00 in taxpayer money. Commission Flury motioned approval of the request by the MLK Committee, and of the committee using remaining funds from this year and from the upcoming budget year's allocation of $15,000.00 for the scholarship fund, said fund to be named by the MLK Committee; Commissioner Brandimarte seconded. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte addressed the flooding last Friday night and remarked we are not prepared for a rain storm, much less a hurricane. She noted flooding on SE 3`d Avenue was particularly bad and flooding issues should be a top priority in this City.
