HomeMy WebLinkAboutR-2013-069 Authorized Public Services to Seek Three Proposals for Emergency Repairs to Southeast Second Avenue Sanitary Sewer Force Main not to Exceed $88,000.00 RESOLUTION NO. 2013-069 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE DIRECTOR OF PUBLIC SERVICES TO SEEK THREE (3) COMPETITIVE PROPOSALS FOR THE EMERGENCY REPAIRS TO THE SOUTHEAST SECOND AVENUE SANITARY SEWER FORCE MAIN, WAIVING COMPETITIVE BIDDING AND AUTHORIZING CITY OFFICIALS TO PROCEED WITHOUT ADVERTISEMENT FOR BIDS FOR AN AMOUNT NOT TO EXCEED $88,000.00; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and materials for the City government in amounts in excess of the established monetary threshold without competitive bidding and without advertisement for bids, if he is authorized to do so in advance by a resolution adopted by the City Commission; and WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10, "Monetary thresholds for certain purchases and payment disbursement authorizations", Subsection(a), set the monetary threshold or limitation at$25,000.00; and WHEREAS, the sanitary sewer force main on Southeast Second Avenue has had two major leaks since November 29, 2012, and has experienced another leak as recently as June 14, 2013; and WHEREAS, the Public Services Department has prepared construction plans, received the necessary environmental permits to make such repairs, and developed an estimated project repair budget of$88,000.00, which amount includes a 10%contingency; and WHEREAS, the Public Services Department recommends the necessary emergency repairs be made as soon as possible to avoid further leaks that have the potential to cause further sanitary and environmental threats, and with City Administration, requests that the City Commission waive competitive bidding and advertisement for bids, and allow City staff to seek three (3)competitive Proposals for the work; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing "Whereas" clauses are incorporated by reference and made a part of this Resolution. Section 2. That the City Commission authorizes the Director of Public Services to seek three (3) competitive Proposals; competitive bidding and advertisements for bids are waived, and the proper City officials are authorized to execute an agreement with the entity that provides the most cost effective, responsive and responsible Proposal, for the repairs to the Southeast Second Avenue Sanitary Sewer Force Main. Section 3. That funding for repair of the SE Second Avenue sanitary sewer force main was not planned or budgeted and therefore is to be funded by transfer and use of available Sewer Fund, Collection Division — Contingency account funds in the amount of$88,000.00 as follows: From To Contingency Account Infrastructure Improvements Account No. 401-35-02-535-99-10 - $88,000.00 No. 402-35-02-535-63-10 - $88,000.00 Section 4. That all resolutions or parts of Resolutions in conflict with the provisions of this Resolution are repealed to the extent of such conflict. Section 5.
