Call to Order/Roll Call Mayor Duke called the meeting to order at 7:00 p.m. Present: Mayor: Walter B. Duke, III Vice-Mayor: Albert C. Jones Commissioners: Chickie Brandimarte Bobbie H. Grace City Manager: Robert Baldwin City Attorney: Thomas Ansbro Deputy City Clerk: Tom Schneider 2. Invocation and Pledge of Allegiance Pastor Faye Williams, Ebenezer Temple, gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Legislative Update—Representative Joe Gibbons Representative Joe Gibbons gave an overview of this year's legislative session, which included discussion of the billion dollar surplus going into the session, the legislature's refusal to accept federal money for Medicaid expansion and the resulting consequences, and eminent domain legislation. 3.2 Special Event request from the Broward County Natural Resource Planning and Management Division for an "Ocean Conservancy International Coastal Cleanup", to be held at Dania Beach on Saturday, September 21, 2013 from 9:00 a.m. - 12:00 p.m. The applicant is also requesting the City to pick up trash collected by the volunteers. Commissioner Grace motioned to approve the Special Event request for the Ocean Conservancy International Coastal Cleanup; seconded by Vice-Mayor Jones. The motion carried on the following 4-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Jones Yes Commissioner Grace Yes Mayor Duke Yes 3.3 Special Event request from Broward Sheriffs Office Rescue Division for a Carwash to benefit the American Cancer Society Relay for Life/Dania Beach. The carwash will be held on Saturday, July 13, 2013 from 8:00 a.m. - 5:00 p.m., at the North end of Dania Beach. The applicant is requesting a special event fee waiver of$100.00. Commissioner Grace motioned to approve the Special Event request for the Broward Sheriff's Office Rescue Division Carwash, including fee waiver; seconded by Vice-Mayor Jones. Proclamations There were no roclamations .at this meeting. g 5. Citizen Comments Rae Sandler, Melaleuca Gardens, spoke of the void left by the resignation of Pat Flury and issues needing to be addressed, such as erosion of the tax base due to airport expansion, flooding, traffic congestion on US-1, changing aesthetics due to discount hotels, and appointment of a commissioner who can represent the City with professionalism and respect for the residents. Pat Wright, 4391 SW 340' Lane, spoke about Pat Flury's qualifications and service, and the loss to the City caused by her departure from the Commission. George Jason, 4549 SW 37 h Avenue, spoke of his concern for Dania Beach, who will fill the open seat on the Commission, and corruption that has developed in the City over the last few years. Ann Page, 38 SW 5 h Street, President of Friends of the Library, commented the library is two weeks into its summer reading program and has 167 children signed up. She noted the program was funded and 100 books purchased because of the generosity of the City. 6. Public Safety Reports Captain Kevin Granville, BSO Chief of Police, reported there was only one residential burglary in the City last week; however, vehicle burglaries are holding steady and residents should be mindful to not leave anything of value in sight. 7. Bids and Requests for Proposals Addendum 8.1 RESOLUTION#2013-070 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, RELATING TO AWARD OF THE OASIS 11 NEIGHBORHOOD IMPROVEMENT PROJECT BID TO DP DEVELOPMENT OF THE TREASURE COAST, LLC, IN THE AMOUNT OF $227,952.59; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. 8.2 RESOLUTION#2013-071 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, RELATING TO AWARD OF THE OASIS III NEIGHBORHOOD IMPROVEMENT PROJECT BID TO STRAIGHTLINE ENGINEERING GROUP, LLC, IN THE AMOUNT OF $195,040.00; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the titles of Resolutions#2013-070 and#2013-071. City Manager Baldwin explained both projects had been awarded to the respective lowest bidder, but due to problems with securing the proper insurance, staff is recommending the bids be awarded to the next responsive bidder for each project. Vice-Mayor Jones confirmed this is within the approved budget. Commissioner Grace motioned to adopt Resolutions #2013-070 and #2013-071; seconded by Vice-Mayor Jones. Corinne Lajoie, Principal City Planner, explained the change made to the ordinance from first reading, as requested by the Commission, to withdraw duplexes from being exempt from site plan review and approval. Mayor Duke opened the Public Hearing. Seeing as there was no one to speak in favor or opposition,he closed the Public Hearing. Commissioner Grace motioned to adopt Ordinance #2013-004, on second reading; seconded by Vice-Mayor Jones. The motion carried on the following 4-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Jones Yes Commissioner Grace Yes Mayor Duke Yes 9.2 ORDINANCE#2013-002 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING CHAPTER 18, ARTICLE III, ENTITLED "EMPLOYEES' RETIREMENT PLAN AND TRUST" BY SPECIFICALLY AMENDING §18-1 TO MODIFY THE CONDITIONS FOR A RETIREE'S PARTICIPATION IN CITY'S GROUP INSURANCE PLAN; AMENDING §18-29.7 TO PHASE OUT THE DEFERRED RETIREMENT OPTION PLAN (DROP); PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (SECOND READING) City Attorney Ansbro read the title of Ordinance#2013-002. Mayor Duke opened the Public Hearing. David S. Casasanta, 2010 N. 52°d Avenue, Hollywood, President of Local 3535, commented the Union did not want to eliminate the DROP; this was imposed by the previous commission. He noted there will be no legal challenges and the City can always bring it back to the table. Seeing as there was no one else to speak in favor or opposition, Mayor Duke closed the Public Hearing. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,June 25,2013—7:00 p.m. Responding to Commissioner Grace, City Manager Baldwin said there are 20 active employees remaining in the pension plan; seven are eligible today to enter DROP. Jim Cherof, Labor Attorney representing the City, noted anyone eligible to enter may do so before September 30''; after that date they cannot, pursuant to the Collective Bargaining Agreement that was ratified by the Commission and the Union. Vice-Mayor Jones asked what would happen if the Commission does not adopt this Ordinance. Attorney Cherof responded this would be inconsistent with the action of the Commission to ratify the Collective Bargaining Agreement and would send a bad message regarding the bargaining process. There was an agreement reached with the Union and it is important that the ordinance be adopted; the Commission is obligated to honor the terms of the Collective Bargaining Agreement. He noted that if there was a violation by either the Commission or the Union in retreating from the terms that were agreed to, an unfair labor practice charge could be brought. Commissioner Brandimarte questioned the effect of not adopting this ordinance on other contractors who do business with the City. Attorney Cherof responded it would send the wrong message that any agreement reached and ratified could be turned away from. Commissioner Brandimarte felt backsliding is never the way to go because the bargaining table was the place to negotiate. Vice-Mayor Jones asked about the cost if this were to go to litigation. Attorney Cherof noted a traditional unfair labor practice charge could involve legal fees alone in the $10-15,000.00 range. Vice-Mayor Jones commented about the consequences of not phasing out the DROP, noting it is a great program,but not at the expense of the taxpayers. Vice-Mayor Jones motioned to adopt Ordinance #2013-002, on second reading. Motion died for lack of a second. Mayor Duke reiterated this matter was previously ratified by the Union and the City; we have to balance fairness to the long-term employees with the long-term financial sustainability of the City. He explained why he voted no on first reading and recommended adoption of the ordinance with the DROP elimination effective date extended by six months, which would allow those few long-term employees to take advantage of this benefit. Vice-Mayor Jones asked about the impact of a 6-month extension. Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,June 25,2013—7:00 p.m. Attorney Cherof responded that there would be an inconsistency between the ordinance and the Collective Bargaining Agreement; a Memorandum of Understanding could be done to modify the term of the agreement, which the Union would likely agree to, in order to have consistency. City Manager Baldwin noted the alternative would be for staff to bring this ordinance back when there are five Commissioners seated. Commissioner Grace motioned to defer Ordinance #2013-002, on second reading. Motion died for lack of a second. Mayor Duke confirmed the ordinance would be brought back to the Commission when there are five members. 10. Discussion and Possible Action There were no discussion items on this agenda. 11. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte commented that with Pat Flury's resignation, the Commission representative on the Police & Fire Pension Board is vacant and she would like to volunteer to serve. Vice-Mayor Jones motioned to approve the appointment of Commissioner Brandimarte as Commission representative on the Police& Fire Pension Board. Motion died for lack of second. Commissioner Brandimarte said at the last meeting there was verbal agreement that all four Commissioners must be present in order to make an appointment to the vacant Commission seat. She would now like this to be approved by a vote of the Commission. The Commission unanimously agreed by voice vote. Commissioner Brandimarte commented that she also would like a vote on Vice-Mayor Jones' suggestion that the person appointed to fill the Commission vacancy be required to agree to not run in the next election. City Attorney Ansbro noted this is permissible, but it will not preclude the person appointed from changing their mind and campaigning for the seat. The Commission unanimously agreed to this requirement by voice vote and on the following 4-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Jones Yes Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,June 25,2013—7:00 p.m. Commissioner Grace Yes Mayor Duke Yes Commissioner Brandimarte spoke of a recent seminar she and Vice-Mayor Jones attended where she learned that if requested, police agencies must disclose on-duty officers' names and locations or else be subject to a lawsuit. She noted she disagrees with this law. 11.2 Commissioner Grace Commissioner Grace commented on her attendance at ethics classes recently held here and in Coconut Creek. Commissioner Grace spoke of the Backyard Bible Club being held at CW Thomas Park. Commissioner Grace commented on numerous social and community happenings. 11.3 Vice-Mayor Jones Vice-Mayor Jones spoke about a recent Institute of Elected Municipal Officials he attended and the County ethics ordinance. He noted there are new ethic laws on the books that we need to be aware of. Vice-Mayor Jones noted the Commission had, in the past, required a replacement commissioner to agree to not run for the seat. He hopes voters will be looking and listening if the candidate chosen to fill the current vacancy agrees to this requirement and then changes his or her mind. Vice-Mayor Jones commented about leaving the dais when Pat Flury stepped down and noted he did not like doing it, as we need to put our best foot forward no matter what. He added Dania Beach is going to move forward and City business will be done, as this is what the Commission was elected to do. If the business is not done, we are impeding progress. 11.4 Mayor Duke Mayor Duke commented the people voted for the Commission to sit and finish out the meetings, even if it is uncomfortable to do so. Mayor Duke thanked Pastor Williams and her congregation for their good work in the community and for staying for the entire meeting. 12. I have never been arrested except for some over-due parking tickets and 2 speeding tickets in my 85 years... 68 or 699 years of that driving. I have never been in jail or even inside a police station. I've never stalked nor been stalked by anyone in my life. I chose to become part of Dania Beach in 2001 because I loved this town and liked the people I met that lived here. I've never lied about my history, education or volunteer service to my community. Why am I telling you all this? I am not interested in the open seat on our commission, but I am interested in who will be seated. My only concern is for this city I love... Dania Beach. I must speak, because of this festering corruption we have in our city that has developed over the last few years. We have a stalker... predator... slime that is out to destroy good people including a commissioner that has served our city with much concern and during our country's economic breakdown, Pat Flury has worked to give us a sound budget and financial stability that many similar size towns have envied. I'm sorry to see our Mayor and a commissioner that I had great respect for, support this corrupt sore in our Dania Beach. I will not give the respect of naming this cancer in our community. We all know who he is! I fear he considers himself a vigilante, when his own life and history has been far less than honorable.... Who will be next? I have spent my life serving my country, community and my friends and neighbors. It hurts me when scum like we are witnessing can ruin our city.
