Call to Order/Roll Call Mayor Duke called the meeting to order at 7:00 p.m. Present: Mayor: Walter B. Duke, III Vice-Mayor: Albert C. Jones Commissioners: Chickie Brandimarte Bobbie H. Grace City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Pastor Mario Cinelli, Lighthouse Community Church, gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 American Cancer Society Presentation Tawny Winslow, American Cancer Society, thanked the City of Dania Beach for its support of the Relay for Life and presented a packet of amenities the City received through its gold level of sponsorship. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Kristopher Corey Fleming, 211A SW 12t' Street, addressed the cost of licenses and inspections for property he recently purchased. He felt it is unrealistic to accomplish everything that is being required within the given deadlines, and this may be a case of selective enforcement. Mayor Duke suggested he contact Marc LaFerrier, Director of Community Development. Matthew Archibald, 1740 NW 191" Street, Miami Gardens, addressed the condition of a property adjacent to 801 SW 0 Street that has multiple code violations. He noted he has contacted the City twice and nothing has been done. Mayor Duke suggested he contact Marc LaFerrier, Director of Community Development. Tom Popescu, 38 SE 15d' Street, expressed his disgust with the current Commission. George Jason, 4549 SW 37t' Avenue, suggested the Commission go down the list of candidates for the vacancy and vote them up or down. Tamara James, 255 NW Tamara James Avenue, said the Commissioners should respect each other, and encouraged the residents to come out and see who they voted for. Ann Page, 38 SW 5"' Street, commented that the recommendation by the Charter Review Board to eliminate the election process to fill a commission vacancy was well-intentioned, but was a mistake. She encouraged everyone to be more vigilant in knowing what is going on. Charles Camacho, 121 NE P Street, advised of the 211 Broward program and also noted that he is concerned with the loss of integrity on the Commission because they are not united. Mayor Duke apologized to the residents for the Commission's lack of ability to move forward in finding a solution to fill the commission vacancy. 6. Jones to attend the 2013 Florida League of Cities 87th Annual Conference on August 14-18, 2013, in Orlando,Florida(estimated cost$1,569.70) Request of Commissioner Chickie Brandimarte to attend the 2013 Florida League of Cities 87th Annual Conference on August 14-18, 2013, in Orlando, Florida(estimated cost $1,569.70) Commissioner Grace commented that the Commissioners are able to provide pertinent information to the City after they attend these conferences. She noted she withdrew her application because two other commissioners were attending and would bring back the same information. Vice-Mayor Jones said he welcomes the opportunity to come back and report after attending conferences. Vice-Mayor Jones motioned to approve the travel requests; seconded by Commissioner Grace. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,July 23,2013—7:00 p.m. City Attorney Ansbro read the title of Resolution#2013-072. Vice-Mayor Jones wanted to bring to the public's attention that the children at Collins Elementary will now be able to swim in a heated pool without having to be transported to another facility. Vice-Mayor Jones motioned to adopt Resolution #2013-072; seconded by Commissioner Brandimarte. City Attorney Ansbro read the title of Resolution#2013-074. Vice-Mayor Jones asked to whom reports of the driver's behavior or actions should be addressed. Mark Felicetty, Director of Parks and Recreation, responded that he is the person to complain to regarding the bus drivers. He noted new bus routes will be brought to the Commission in August. Corinne Lajoie, Principal City Planner, gave an overview, noting the text amendments are due to errors found in the code and requests from the development community. After a brief discussion, the Commission concurred that site plan approval for duplexes should be brought before the Planning&Zoning Board. Mayor Duke opened the Public Hearing. Bobbie Walker, 137 NW 14t' Avenue, noted her house was built in 2006 with CRA money, the City issued a Certificate of Occupancy, and Broward County approved it. She advised the house is an electrical hazard and she is filing a complaint against Dania Beach and Broward County with HUD. Mayor Duke asked staff to follow up with this matter. Seeing as there was no one else to speak in favor or opposition, Mayor Duke closed the Public Hearing. Commissioner Grace motioned to adopt Ordinance #2013-007, on first reading, with the recommended change for duplexes; seconded by Commissioner Brandimarte. He asked the Commission to disclose any communication they had on these matters. 9.4 RESOLUTION#2013-075 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE VARIANCE REQUEST SUBMITTED BY THE PROPERTY OWNER, THE BROWARD COUNTY BOARD OF COUNTY COMMISSIONERS, FROM THE CITY OF DANIA BEACH LAND DEVELOPMENT CODE PART 2,SECTION 240-20(B),FOR PROPERTY LOCATED AT 2701 WEST STATE ROAD 84,IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2013-075. Commissioners Grace and Brandimarte noted they had been contacted on this matter. Corinne Lajoie, Principal City Planner, gave an overview of the request. Daniel Yaffe, Chairman of the Broward County Marine Advisory Committee, spoke on behalf of the applicant, Broward County. John Fiore, Broward County Parks & Recreation, gave a brief presentation. Mayor Duke opened the Public Hearing. Clive Taylor, Chairman of the Dania Beach Marine Advisory Board, noted the board supports the request. Seeing as there was no one else to speak in favor or opposition, Mayor Duke closed the Public Hearing. Dillon Larson, Miller Legg, applicant's agent, responded to Vice-Mayor Jones that the proposed dock would not interfere with navigation. The motion carried on the following 4-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Jones Yes Commissioner Grace Yes Mayor Duke Yes 9.5 RESOLUTION#2013-076 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE VARIANCE REQUEST SUBMITTED BY WALGREENS COMPANY FROM CHAPTER 28, "ZONING", Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,July 23,2013—7:00 p.m. SECTION 110-50 "PROXIMITY OF BEVERAGE ESTABLISHMENTS TO OTHER ESTABLISHMENTS AND USES",FOR PROPERTY LOCATED AT 501 EAST SHERIDAN STREET,DANIA BEACH;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2013-076. All members of the Commission noted that they had been contacted on this matter. Corinne Lajoie, Principal City Planner, gave an overview of the request and noted that the applicant agreed to staff conditions. Dwayne Dickerson, Attorney at Fowler White Boggs, representing Walgreens, noted that they will not be coming back for liquor sales; they are only requesting sale of beer and wine. He noted that by right, they are allowed to sell beer, and the request is only for wine. He spoke to several residents and Walgreens has voluntarily made concessions beyond what was made by staff. Today, they agreed that there would be no sale of malt liquor at this location. He introduced Melissa Gross, store manager, and noted she would be the contact person for any issue regarding this request. Johanna Lundgren, Special Counsel from Weiss Serota, in response to Mayor Duke, explained the Code exempts the sale of beer from spacing and location requirements because the City is expressly preempted by state statute from enacting such requirements. Mayor Duke opened the Public Hearing. Charlotte Newbury, 1314 SE 5ffi Court, spoke against the request due to the potential for attracting an unwanted element. Nancy Bebon, 1354 SE 5 h Court, spoke against the request, in part because BSO does not regularly patrol this area. Patricia Rafacz, 610 Trafalgar Court, spoke against the request on the behalf of her community due to safety and security concerns. Catherine Willshire, 1346 SE 5t'Court, spoke against the request. Danny Pinzon, 1318 SE 5U' Court, spoke against the request. Dr. Cory Montgomery,Assistant Principal at Olsen Middle School, spoke against the request. Ann Page, 38 SW 5 h Street, spoke against the request. Seeing as there was no one else to speak in favor or opposition, Mayor Duke closed the Public Hearing. Commissioner Grace commented she wants the community to be safe and will vote on the side of the residents of Dania Beach. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,July 23,2013—7:00 p.m. Attorney Dickerson responded to Vice-Mayor Jones that the corporate policies would remain regardless of the approval of wine sales. Walgreens will continue to monitor the location once beer and/or wine are introduced and will revisit the security issue if it becomes a necessity. Vice-Mayor Jones noted he will vote on the side of the residents who were previously promised there would be no beer sales. He recognizes that Walgreens can now sell beer by right and suggested that Walgreens withdraw this request as there would be no detriment to them from not being able to sell wine. Commissioner Brandimarte spoke of an incident at a different Walgreens location and noted she will vote for the people. Vice-Mayor Jones motioned to deny Resolution #2013-076; seconded by Commissioner Brandimarte. Mayor Duke noted there is a homeless problem in that neighborhood and although Walgreens has a legal right to sell beer, he felt they should stick to their concessions regarding single servings and hours of sales. The motion carried on the following 4-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Jones Yes Commissioner Grace Yes Mayor Duke Yes 9.6 RESOLUTION#2013-077 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN MODIFICATION AND PLAT AMENDMENT REQUEST SUBMITTED BY MIKEL ISAAC REPRESENTING STIRLING STATION, INC., FOR PROPERTY LOCATED AT 4051 STIRLING ROAD, DANIA BEACH;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2013-077. Corinne Lajoie, Principal City Planner, gave an overview of the request. Discussion ensued regarding possible traffic congestion caused by the new access off of SW 4& Avenue due to the absence of a turn lane into the property. Mikel Isaac, owner's agent, noted this came before the Commission three years ago for approval of the turn lane; however, the County made them come back to the City because they were required to move the access 40 feet to the north. He confirmed there would be a turn lane to access the driveway. Mayor Duke opened the Public Hearing. Seeing as there was no one to speak in favor or opposition,he closed the Public Hearing. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,July 23,2013—7:00 p.m. Commissioner Grace motioned to adopt Resolution #2013-077; seconded by Vice-Mayor Jones. Discussion and Possible Action 10.1 Dania Beach Airport Advisory Board—Chair, Randy Wright Randy Wright, Chairman of the Airport Advis ory Board requested that the City Commission consider the recommendation of the board to approve hiring an independent licensed General Contractor who specializes in quality control, to act as a representative for the homeowners participating in the Broward County Sound Mitigation program. Commissioner Grace motioned to approve staff looking into the request; seconded by Vice- Mayor Jones. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte commented the Commission agreed on everything tonight. 11.2 Commissioner Grace Commissioner Grace commented on personal and community events. Commissioner Grace thanked the CRA, Parks & Recreation, and Public Services for the outstanding work they have done in the past several weeks. 11.3 Vice-Mayor Jones Vice-Mayor Jones noted his father's surgery was successful and he is doing well. Vice-Mayor Jones apologized to staff for last night's Commission meeting. He said there was no process established going into the meeting and the City Manager should have polled the Commission for input and brought some rules forward. He added there needs to be leadership on the Commission and that has to come with some accord. Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,July 23,2013—7:00 p.m. Vice-Mayor Jones spoke of the Dania Beach Community Garden and noted the Broward Regional Health Planning Council supported the grant for the garden. 11.4 Mayor Duke Mayor Duke had no comments. 12. Appointments There were no appointments at this meeting. 13. Administrative Reports 13.1 City Manager City Manager Baldwin noted the Oasis projects have begun. City Manager Baldwin commented that the Commissioners showed leadership during the Budget Meeting. 13.2 City Attorney City Attorney Ansbro noted the City lost the federal court case against the Army Corps of Engineers and the decision can be appealed within 60 days. The court case on the 1995 settlement agreement is set for trial on December 9ffi.
