(Continued from August 7, 2013 —4:30 p.m.) 1. Call to Order/Roll Call Mayor Duke called the meeting to order at 2:00 p.m. Present: Mayor: Walter B. Duke, III Vice-Mayor: Albert C. Jones Commissioners: Chickie Brandimarte Bobbie H. Grace City Manager: Robert Baldwin City Attorney: David Wolpin City Clerk: Louise Stilson 2. Discussion and Possible Action 2.1 Commission Vacancy Mayor Duke confirmed that no discussion will be held without a motion and second. He reviewed the names of the seven applicants who received a motion and second at the August 7t' meeting, and noted that the Commissioners received a copy of a letter from David Nuby, Jr., one of the seven, asking to be withdrawn from the application process. David Nuby, Jr., said he did not submit the letter to remove his name from the list of candidates. Commissioner Grace motioned to shortlist the applicant pool to the seven applicants. Motion died for lack of second. Vice-Mayor Jones motioned to choose from applicants who have served on boards and not just those who received a second; seconded by Commissioner Brandimarte. A review of the list indicated 12 candidates were on boards or on the commission, which included the seven who received a motion and second at the last meeting. The motion carried on the following 4-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Jones Yes Commissioner Grace Yes Mayor Duke Yes II Commissioner Grace motioned to appoint Jean Cook. Motion died for lack of a second. Commissioner Grace motioned to appoint Robert Chunn. Motion died for lack of a second. Commissioner Brandimarte motioned to appoint Paul Fetscher; seconded by Vice-Mayor Jones. Vice-Mayor Jones spoke about Mr. Fetscher and his qualifications to serve. Mayor Duke commented he would like someone from west Dania Beach or who is currently on a board. The candidates he would support are not on the short list and he will not support this motion. The motion failed on the following 2-2 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Jones Yes Commissioner Grace No Mayor Duke No Commissioner Grace motioned for Boisy Waiters, Jr. Motion died for lack of a second. Commissioner Grace motioned for David Nuby, Jr. Motion died for lack of a second. Commissioner Grace motioned for Clive Taylor. Motion died for lack of a second. Commissioner Grace motioned for Bruce Hannover. Motion died for lack of a second. Commissioner Grace motioned for Ann Page; seconded by Mayor Duke, who passed the gavel to Vice-Mayor Jones. Mayor Duke noted Ann Page is well liked by everybody and speaks at every meeting. Although she does not live west, which does not currently have direct representation on the Commission, you have to be willing to compromise and not stick to your own picks. He added she is not one of his top three, but fills enough of the criteria for him to second the motion. Vice-Mayor Jones said Ann Page would be a great person to serve in this seat; she has run for office before and comes before the Commission and City on a daily basis with her concerns. He thought she was upset when they discussed his opposition to the person running for Commission if they are appointed and this, in itself, eliminated her in his mind even though she is a superb candidate. Mayor Duke commented Ann Page said she would not run for the seat and noted he personally does not care whether or not the person appointed runs. She will have to answer to the voters if she decides to run. Commissioner Grace said she does not care who is picked as to whether they say they would run or not;they have the right to run if they want. Motion died for lack of a second. Commissioner Grace motioned for Mark LaRocca; seconded by Mayor Duke, who passed the gavel to Vice-Mayor Jones. Mayor Duke said Mark LaRocca would be a great addition to the Commission in that he lives out west, under the flight path, and is a small business owner. He also serves on two boards and works closely with Code, BSO, and the City Manager on waste hauling issues. The motion failed on the following 2-2 Roll Call vote: Commissioner Brandimarte No Vice-Mayor Jones No Commissioner Grace Yes Mayor Duke Yes There were no motions for Douglas Hasty or Charles K. McElyea. Mayor Duke said this topic would be continued until the Commission meeting on Tuesday, August 1 P. Attorney Wolpin explained the 60-day deadline for an appointment to be made, as stated in the City Charter. He advised that under state statute, it is considered to be directory or advisory, rather than mandatory, and noted the Commission may appoint someone at a later date. 3.
